Fossoway and District Community Council Meeting Minutes - September 2022

Draft Minutes for Fossoway and District Community Council (FDCC) meeting

Tuesday 6th September 2022, Moubray Hall, Powmill

Attending: Community councillors (CCllrs) Sarah Bruce-Jones, Angus Cheape, Trudy Duffy, Nicola Marchant and Assoc. Community CCllr Carol Farquar; Perth & Kinross (P&K) Councillors (Clr) Richard Watters and 13 members of the public. Emma Irons & Megan Adam from Police Scotland (for their agenda item only).

Police report

  • There were over 26 traffic incidents over the previous 4 weeks
  • 14th August: assault in Crook of Devon, suspect identified but released due to insufficient evidence
  • 19th -22nd August: vandalism to Fossoway School; suspects identified and dealt with
  • 29th August: car crash in Drum; both vehicles were moved off the road for recovery. No offences and details exchanged.
  • 31st August: closure of A977 due to HGV off the road. Road policing attended and the HGV was cleared on 01/09. No offences.
  • 1st September: vandalism in Braughty farm; enquiries are ongoing

Discussions with police

  • A member of the public (MoP) informed police of issue at Seamab School which occurred in July and a more recent incident where a child cycled rapidly out of the school car park requiring the MoP to perform an emergency stop. Police have agreed to discuss this with Ben Samson (the new community police officer)
  • An MoP reported the large number of traffic incidents on A91 early in the morning.
  • CCllr Duffy reported there is a large stag roaming around Drum. MoP reported a concern in case the animal ran into the road. Police Officers will consider how best to deal with this.
  • Ben Samson is our new Community Police Officer and he is going to set up a coffee with a police officer on a Saturday afternoon in Fossoway District.

Minutes of the previous meeting: The minutes of the previous meeting were reviewed and signed off with the following amendment – Seamab school name to be included in the statement regarding the Rumbling Bridge incident. Also the location of the meeting on the minutes was incorrect.

Matters Arising

  • Fossoway Gathering: CCllr Duffy reported that the Fossoway Gathering was a success, despite the weather. The organisers were congratulated on their efforts to get this event on the annual calendar of Fossoway. Next year this is planned for Saturday 2nd September. Ass CCllr Farquar noted that she was very impressed by the organisation of the Gathering.
  • Community Development Trust (CDT): The CDT took the opportunity to set up a stall at the 2022 Gathering to engage with the community. The event was supported by Mike Barnacle, Matthew Rice, Marion Anness, Liz Stenhouse and Nicola Marchant. The focus of the engagement was to gather ideas for projects, what Blairingone School could be used for; how Waulkmill Park could be better utilised and any other ideas. Members of the younger generation were encouraged to fill out a short survey, and several new members joined the CDT.
  • Fossoway Area Transport: There was initial issues with the 202 bus keeping to its timetable. This is being monitored and there have been some changes. Some buses will stop in Dollar and not go onto Tillicoultry. Discussions were had on other route changes, but none are being made. The Transport Forum is still to convene. Cllr Watters is leading a look at how PKC could better deliver a bus service. MoP reported that they were pleased there was now a bus service, and they believe it is being better used. It was noted that Clackmannanshire have not posted the 202-bus timetable at their bus stops; Cllr Watters will take this forward. Cllr Watters reported that PKC is monitoring when people are getting on and off the bus. MoP noted that buses leaving Kinross P&R all come together in a short time period and then none for 2 hours. This is a known issue.
  • Anti-social behaviour Fossoway Primary School: CCllr Duffy had a brief meeting with Paula Woods, the new Headteacher of Fossoway Primary School. The concerns regarding noise from the use of the basketball court were discussed and the Headteacher will convene a meeting as soon as possible. MoP said that their children were regularly ejected from the school playground during the daytime by a resident. The MoP has complained about the behaviour of the resident towards the children. It was agreed that children do need a safe place to play. Safer Communities stated that basketball and associated noise is the main issue.

    • Action: CCllr Marchant will meet with Kythe (Kinross and Glenfarg Stronger Communities Meeting).
  • Community Speedwatch: All the application forms for vetting have now been sent to the police.
  • Speeding in F&D area:
  • A977 Mitigation: We still have had no feedback since the speed lines on the A977 (in Drum) and on the B9097 have gone in. Cllr Watters reported that there is a meeting later on this month regarding this issue, signage and prioritisation of work.
  • Carnbo 30mph: MoP reported that the signs were promised at the end of March 2022 and questioned why road line painting was being done but change of speed signs was not. Cllr Watters reported that road painting is contracted out to Tayside contractors and that traffic regulations work has to be done by PKC staff and there is a shortage of staff. CCllr Bruce-Jones stated that 11 orders have to be legalised in the Ward. MoP noted that Carnbo is the only village that does not have a traffic calming system. MoP reported there has been an increase in the number of children boarding the school buses and villagers are concerned about speeding cars and potential accidents. Carnbo villagers again vocally stated their deepening concerns.
  • School Exclusion Zones: this is not happening in Fossoway.
  • Speed limit at Millennium Walk: no progress to report
  • Rumbling Bridge Gorge Bridge: no progress to report
  • Road Adoptions: It is now clear which part of the road has been adopted and which part has not.
  • Access to Cash in Kinross-shire: CCllr Marchant has had no success in finding a contact in the Bank of Scotland.
  • Crook and Drum Growing Together: have put in an application with PKC’s Nature Restoration Fund for the extension of the small community orchard.

Consultations

  • There are currently four open consultations from PKC, SG and Police Scotland which the community is welcome to comment on, details below:

    • Perth & Kinross Local Housing Strategy 2022-27: Draft Vision, Priorities and Actions: https://consult.pkc.gov.uk/communities/perth-kinross-local-housing-strategy-2022-27/ Closes 9th September 2022.

      • Proposed response from CC approved. CC will respond focussing on provision of affordable housing supported by renewable energy and appropriate infrastructure to support the concept of 20minute communities as proposed by Scottish Government in the draft National Planning Framework 4
    • Scottish Biodiversity Strategy 2022: https://consult.gov.scot/environment-forestry/scottish-biodiversity-strategy-2022/ Closes 12th September 2022.

      • A detailed response from the CC was approved
    • Land reform in a net zero nation: https://www.gov.scot/publications/land-reform-net-zero-nation-consultation-paper/ Closes 25th September 2022.

      • It was agreed that the CC would not respond to this due to the very technical nature of the paper. It is understood that the Scottish National Farmers Union has hosted webinars and will be producing an informed response
  • Gypsy Traveller Guidance: Gypsy/Traveller Site Standards - Perth & Kinross Council Citizen Space - Citizen Space (pkc.gov.uk). Closes 2nd October 2022. The Gypsy/ Traveller Site Standards guidance note provides guidance on how applications for private permanent sites or short/seasonal stay sites can address Policy 21 in Local Development Plan 2.

    • Proposed CC response approved. The proposed guidance is welcome and as well as providing detail on the policy it gives applicants an overview of when permission is required and what other requirements are needed including licenses and building permits to establish a traveller site.  It is suggested that a definition of short stay is included and also standards for multi-use sites. The guidance however does not address short term stopping places and minimum requirements for them. Lastly is there an expectation that existing sites will over an agreed period of time meet these standards. CCllr Farquar visited the site but there was no one there. She noted that it looked tidy, and the site is clearly being improved.
    • Managed for Wildlife Trials 2022: https://consult.pkc.gov.uk/communities/managed-for-wildlife/ Closes 31st October 2022.

      • Proposed response approved. The managed areas are a good idea and it is hoped that they can be expanded and local communities encouraged to create their own areas. It was good to see that there were several information boards explaining how this activity can increase biodiversity and also pointers to Nature Scot which has pages on how to encourage wildlife and pollinators in your garden. A useful addition would be a QR code so that people can more easily access this information.

New Business

  • Community council elections are due to take place in October/November 2022. Members of public are invited to stand for election.

Community Council Business

  • Kinross-shire Local Area Committee: CCllr Bruce Jones attended a virtual meeting of the Kinross Local Area Committee on 18th August. The main agenda items were the possible Community Asset Transfer of the former Blairingone Primary school building, Road Safety and update on Traffic Orders and the distribution of grants from the Kinross Community Good.

Planning Applications

  • 22/01432/FLL | Extension to dwellinghouse, erection of garage and formation of steps | 6 Drummond Park Crook of Devon Kinross KY13 0UX. This is currently a single storey house where the applicant is proposing to rearrange the ground floor and build into the attached garage as well as extend out the back. A new separate garage will also be built.
