Draft minutes for Fossoway and District Community Council Meeting
7th June 2022, Moubray Hall, Powmill
Attending: Community Cllrs Trudy Duffy, Sarah Bruce-Jones, Angus Cheape and Faiza Hansraj-Jackson; Assoc. Community Cllr Carol Farquar; P&K Councillor Dave Cuthbert and six members of the public.
Apologies: P&K Cllrs Richard Watters, Freshwater and Robertson; CCllrs Graham Pye and Nicola Marchant

Police report: There were no incidents to note in our area since the last CC Meeting from the Commander’s Reports received via Perth and Kinross Community Watch.
Minutes of the previous meeting: The minutes of the previous meeting were reviewed and signed off
Matters Arising
- Welcome and goodbyes: We welcome Richard Watters and Willie Robertson, who were re-elected as PKC Cllrs, Dave Cuthbert who has also been re-elected as a PKC Cllr but after a gap. We welcome them and look forward to working together. CClr Gillian Mudie has had to resign from the Community Council due to time pressure. We thank her for her work.
- Community Development Trust: At the public meeting on 18th May in the Crook of Devon Church Hall 38 members signed up and as there are three directors as well the Trust can go ahead. One of the first projects is to investigate the possibility of taking the old school building in Blairingone into community ownership to use as a community hub. The trust encourages membership from the Fossoway area at a cost of £5 annually.
- Fossoway Area Transport/DRT: Cllr Watters will enquire into use of Bus 202. The current survey on bus 202 has been shared on the CC Facebook page. Some issues were raised around the reliability of the DRT.
- Closure of road to Fossoway Primary School during school hours: Reports that there are plans for the road to the primary school to be closed during school hours for parking and safety reasons. Cllr Cuthbert will enquire what plans the council has for the school road, if any.
- Speed limit at Millennium Walk: this is accessed via the A977 which is currently the national speed limit at 60mph and if the speed limit of 30mph at the entrance to Crook of Devon were to be extended a short distance, this would make crossing the road much safer. Cllr Cuthbert to investigate and report back.
- Crook Moss Travellers Site: CCllr Farquar reported visiting the site and speaking to someone. Upgrades are in progress, but there is room for the site to be tidier.
- Community Speedwatch: This is paused due to a change of police officer for our area. Questions were raised around how to go about speed limit reductions in Drum from 40mph to 30mph and whether the community speedwatch campaign can take place on safe spots in 40mph zones (instead of being limited to 20mph/30mph roads). Cllr Cuthbert to investigate these queries. Cllr Cuthbert reported that from the police perspective, work on this is progressing, with funding needed for vests and speed measuring guns. CClr Duffy to liaise with the police for further updates. No updates on speedwatch at Carnbo, PKC committed to having the speed lines at Carnbo set up by the end of June 2022 at the last local committee meeting. Cllr Cuthbert to investigate this.
- Devonshaw Whinstone Quarry: The consultation process is ongoing.
- Rumbling Bridge Gorge Bridge: The quote received for this was very high. Discussions around whether other quotes for the bridge could be sought. CCllrs Cheape and Duffy to investigate other funding. It was suggested this could be considered as another project for the Community Development Trust.
- Crook & Drum Growing Together: There will be a stall selling plants at the Aldie farm open day on 19th June, alongside Fossoway Gathering. Entry is £3, with proceeds going to CHAS.
- Hedges from Rumbling Bridge to Muckhart: This CC is still waiting for a response from Muckhart CC.
- Road Adoptions: We still need to find out whether the spur of the U241 road in Drum is currently adopted by PKC.
- Access to Cash in Kinross-shire: The CC agreed that CCllr Marchant would contact Bank of Scotland to seek an update on the services they operate in Kinross.
- War Memorial: This is moving towards a conclusion
Matters Arising with no update since last meeting
- Fossoway and District Community Council Benefit Fund, Kinross-shire Area Committee, Flooding in Drum and A977 mitigation measures: No updates
New Business
- Fossoway Primary School Gates: The CC had received an email raising concern that the school gates were closed outside school hours which blocks access to children from playing there. PKC reported that this was due to antisocial behaviour. CCllr Duffy has written to PKC seeking their views but is still awaiting a response. A second email, sent after a report that a member of the public had approached a child telling them they were not allowed to play in the school playing ground has also gone unanswered. No evidence of consultation or mediation in place. The parent council also note that the school gates shouldn’t be locked as it provides the children somewhere safe and not muddy to play, especially as the A977 is a busy road and it would not be safe for the children to cross the road. CCllr Duffy and Cllr Cuthbert will discuss this and investigate further.
- Cycling routes: A local resident has been looking at options to extend safe cycling routes to add a route for cycling from Carnbo to Fossoway primary school and shared a questionnaire on Facebook which was shared from the Fossoway CC Facebook page to get more responses.
- Library survey: PKC libraries are carrying out a survey to find out more about how their services are used. The survey is available on the Fossoway CC Facebook page.
Community Council Business
- Meetings Attended: CCllr Cheape shared updates from the Kinrosshire fund meeting. Funds were awarded to Penney’s community woodland, Fossoway Tennis Club and the Duke of Edinburgh Award P&K.
- Minutes Secretary: CCllr Hansraj-Jackson is going to be minutes secretary for the time being.
P&K Councillors’ Reports
- Dave Cuthbert: many council workers are still working from home, which may see a move of council sites to more remote areas. Cllr Cuthbert will chair the local area committee after 6 months to give him time to settle in. He is currently the lead for the community transport group which includes buses.
- No reports received from Cllrs Watters, Freshwater or Robertson.
Planning
Planning Applications
- 22/00540/FLL Erection of fence at Linnbank Main Street Crook Of Devon Kinross KY13 0UQ. The applicant currently has a 630mm parapet wall fronting their garden onto Main Street. They are seeking to add a trellis fence which will add a further 800mm in height to the wall. They are requesting this as their garden sits below street level and want to have more privacy. No CC Comment
- 22/00768/FLL Extension to garage at 2 Braehead Rumbling Bridge Kinross KY13 0PX. Extract from Design Statement: the clients brief is to create additional ancillary space within an extended garage. This will provide a gym space, games room and additional living space with connection to the large garden. The proposed extension is to the rear of the garage and does not appear to impact the neighbours with respect to light nor overlooking them. No CC comment
- 22/00823/FLL Alterations and extension to dwelling house at 1 Barnhill Farm Powmill Dollar FK14 7NS. This application is for an extension to an existing 4 bed 2 storey farmhouse. The extension will be physically linked to the existing house via a shared utility room and will be single storey providing a fully fitted 2 bed annexe with kitchen. In addition the existing house will be reclad with a mix of powder coated and wood cladding. The farm sits in a rural location behind Devonshaw Quarry. N.B. The application does not contain a design statement which would be expected for this size of extension and which is inferred in the policy. No CC comment
Planning Decisions
- 21/01209/FLL Erection of a dwelling house and garage/studio (revised design) at Land 50 Metres South West Of Mitchell House Main Street Crook Of Devon. Application APPROVED. CC had made a neutral comment regarding flooding concern as this house will be very close to the River Devon. The PKC Flooding Team also initially objected to the application for exactly the same reason as ourselves. This resulted in a request for a new flood risk assessment which has led to planning conditions and the plans were then approved.
- 22/00556/FLL Extensions to dwelling house, erection of porch and formation of raised decking at Ivybank Drum Kinross KY13 0UN. Application REFUSED mainly due to size and detrimental impact on neighbours. CC had made no comment
- 22/00823/FLL Erection of replacement clubhouse at Fossoway Tennis Club Church Road Crook Of Devon. Application APPROVED. CC had made a supportive comment
