Draft Minutes of Fossoway and District Community Council Meeting
5th April 2022, Crook of Devon Village Hall
Attending: Community Cllrs Sarah Bruce-Jones, Angus Cheape, Trudy Duffy, and Nicola Marchant; Assoc. Community Cllr Carol Farquar; P&K Councillors Callum Purves, Willie Robertson Richard Watters, Mike Barnacle.
Apologies: CCllrs Gillian Mudie, Faiza Hansraj-Jackson and Graham Pye
Declarations of Interest: None.
Police report: There were no incidents to note in our area since the last CC Meeting from the Commander’s Reports received via Perth and Kinross Community Watch. A MoP stated that a quad bike had been stolen.
Minutes of the previous meeting: The minutes of the previous meeting were reviewed and signed off.
Matters Arising
Community Development Trust: Steering group met on 23rd March and agreed a target of 11th May to get three Board Members and 20 members from the Fossoway District Community. Membership will be £5 per household. Cllr Barnacle will email possible members. Draft constitution is ready for approval for members and will then be submitted to OSCR.
Fossoway Area Transport/DRT: 202 bus service trial timeline has been extended to end of June. Disquiet has been raised that the timings of the service are not joined up with other buses to facilitate commuting to work. Kinross-shire go greener is seeking funds to support improved commuter transport. Rural outreach, an established charity, has agreed to provide support to the DRT. There is an initiative to design a sustainable travel plan for Kinross-shire.
A977 Mitigation Measures: Cllr Purves had made an application to request speed measuring lines to the west of Crook of Devon and east of Drum - this has now occurred, and we will be sent results. CCllr Duffy has emailed Mark Craig regarding regulations for red-light cameras for the traffic lights. Ashley Mitchinson has moved to another area.
Crook Moss Travellers Site: There has been a change of ownership of one of the plots. PKC have informed us that there are no breaches of planning at any of the sites. Cllr Barnacle will write to PKC regarding this. We remain unhappy with the lack of landscaping and screening, which was one of the conditions.
Speeding in Carnbo: MoP informed us that the solar panel has now been repaired and speed alert now works.
Community Speedwatch: CCllr Mudie is taking the lead on this; names and locations have been forwarded to Mark Craig, who has taken over from Ashley Mitchinson. All volunteers will undergo a police check; we now have the forms and CCllr Mudie will distribute them. We are still looking for more people
Devonshaw Whinstone Quarry: CCllr Marchant submitted the CC’s response on 24th March including: Support the concept of developing it as a tourism site that builds upon natural features and safeguards the environment; Encourage partnering with local businesses e.g. farm shops to provide goods to visitors; Encourage carbon neutral – green tourism e.g. car chargers, solar panels, wind turbines.
Rumbling Bridge Gorge Bridge: There is no update as yet on the Otter and Tree surveys.
Crook & Drum Growing Together: CCllr Duffy reported that six trees were planted as part of community orchard and intends to do a grant application for more trees, a bench and an interpretation board. The orchard is situated on the left of the path from the Hall to the Church. Crook and Drum Growing together have liaised with the church.
Hedges from Rumbling Bridge to Muckhart: Still waiting for a response from Muckhart CC; we are disappointed with the lack of communication.
NPF4 Consultation: CCllr Marchant had developed the CC response and submitted it on 31st March. The focus of our responses was to ensure that rural developments were always supported by co-developing infrastructure. We did not support developments on prime agricultural land.
Community Ditches: CCllr Marchant had emailed Cllr Robertson about several ditches being blocked and he has reported that it has been put into plans for this year. A MoP has offered to help.
Possible Adoption of Spur of U241 Road, Drum: Cllr Barnacle will ask Andy Brown of PKC whether it is currently adopted or not, and ask Community Greenspace if they own the trees.
Matters Arising with no update since last meeting:
Access to Cash in Kinross-shire, Fossoway and District Community Council Benefit Fund, Kinross-shire Area Committee, Flooding in Drum: No information at present.
New Business:
CCllr Duffy received an email raising concern that primary school gates were closed outside school hours which blocks access to children to play. PKC reported that this was due to unsociable behaviour. Cllr Purves noted that the Lifelong Learning Committee was looking into making school playgrounds more accessible. Cllr Robertson stated that access is down to head teacher and advised that the CC should write to them.
Community Council Business:
Meetings Attended: None this month.
Use of Social Media: In future, all Facebook Messenger queries will be responded to by requesting that the author use the CC’s email address and thereafter any correspondence will be via email or will be added to next meeting agenda.
Minutes Secretary: The search for a volunteer continues, but with no candidates. In the interim the CC members will continue to undertake the task in rotation.
P&K Councillors’ Reports:
Callum Purves: Nothing not already covered above.
Willie Robertson: A constituent has asked why we don’t use the former Devon Valley railway line to link Rumbling bridge to the cycleway at Dollar. It passes over the amazing Gairneyburn Viaduct. Apparently when raised previously landowners objected. CC would support this.
Richard Watters: Broke not Broken reported the pressures they are under as more people, even those in more affluent areas, are being pulled into the poverty trap. People don’t necessarily know that help is available.
Michael Barnacle: Blairingone War Memorial – PKC is funding strengthening the cemetery wall and Profile Projects has pledged money to move the memorial. Planning has been given. PKC’s contractor will then move the memorial.
Drummond Park adoption scheme: all residents have signed up to it. Legal agreement is being drawn up. Currently there is a shortage of bitumen which may delay this being done.
West Crook Way has houses that border Glebe field owned by the Church. Scottish water put in a pipe and drain across the field which has resulted in flooding of some houses in West Crook Way.
The bridges near the Aldie Road and the Naemoor Bridge need attention, some of the parapets are damaged.
B9097 fly-tipping now occurring in layby near junction of Aldie Road. Also occurring on A91 near Carnbo. CCllr Bruce-Jones asked whether or not PKC would reconsider definition of commercial vehicle for purpose of refuse tips.
The CC is disappointed that fly-tipping is not pursued more rigorously; despite finding evidence of addresses in the waste there are very few prosecutions.

Note that the first application below was discussed by email as the comment due date was before this meeting.

22/00229/FLL Erection of a dwelling house and office (class 4) (revised design) at Burn View, Rumbling Bridge, Kinross, KY13 0QG. No CC Comment.
22/00448/FLL Erection of a dwelling house and garage with ancillary accommodation at Land 40 metres northwest of Dunollie, Fossoway. No CC Comment
22/00541/FLL Erection of 3 agricultural buildings and stables, formation of access track and associated works at Land 360 metres southwest of Craigton House, Rumbling Bridge. No CC Comment
Appeals:
21/00001/FLL S42 application to delete condition 6 (access upgrade) of permission 20/01319/FLL at Land 180 metres southwest of Powmill Cottage, Rumbling Bridge. At the 14th September LRB meeting the application was deferred pending a view from the legal team.
Decided Applications:
22/00105/IPL Erection of dwelling house (in principle) at Land 50 metres west of Hallhill Farm, Carnbo. The application was approved, the CC had made no comment
21/02069/FLL Erection of 7 dwellinghouses, garage, formation of landscaping and associated works at Land 480 metres southeast of No 4 Pitfar Steadings, Powmill. The application was refused as contrary to Policy 19 Housing in the Countryside of the Perth and Kinross Local Development Plan 2 (2019) and the associated Housing in the Countryside Supplementary Guidance – The CC had made a neutral comment.
Enforcement Issues:
20/00809/FLL Craigton Farm Lane: David Rennie (PKC’s Enforcement Officer) had advised the CC that the enforcement notice had not been appealed. Further, the owner’s architect is working to discharge the conditions relating to the planning permission for the houses on the adjoining land and the owner intends to commence development thereafter. David Rennie notes that when the building of the houses commences, the unauthorised development subject of the notice is likely to become lawful as permitted development rights allow temporary development on adjoining land during construction works.
20/00972/FLL Erection of two dwelling houses and garages at Land 100 metres southwest of Easter Muirhead, Blairingone (enforcement ref: 21/00236/PLACON) - The agent has been in contact with Transport Planning regarding the widening of the road. CCllr Pye had asked David Rennie for an update as houses are almost complete.
