Proceedings of the Virtual Meeting of
Fossoway and District Community Council 1st February 2022
Attending: Community Cllrs Sarah Bruce-Jones, Trudy Duffy, Carol Farquhar, Nicola Marchant and Graham Pye; P&K Councillors Callum Purves, Willie Robertson and Richard Watters.
Apologies: CCllrs Angus Cheape, Faiza Hansraj-Jackson and Gillian Mudie; Cllr Michael Barnacle; PC Ashley Mitchinson.
Community Council Membership: CCllr Carol Farquhar tendered her resignation from the CC, but was then adopted as an Associate Members to continue her special relationship with the residents of Crook Moss. The appropriate time having elapsed, CCllr Marchant is now a full member of the CC.
Declarations of Interest: None.
Police report: There were no incidents to note in our area since the last CC Meeting from the Commander’s Reports received via Perth and Kinross Community Watch. CCllr Duffy will make contact again as we need feedback and information on the Community Speedwatch Project.
Minutes of the previous meeting: The minutes of the previous virtual meetings will be reviewed at the next physical meeting.
Matters Arising
Access to Cash in Kinross-shire: Cllr Purves updated that Bank of Scotland have progressed the community project with the opening of a Community Hub at Millbridge Hall, Kinross. Details will be published in the Kinross Newsletter and on social media channels. CCllr Marchant advised that the CC will continue to be proactive on the subject of access to cash as feedback from users of mobile banking was that they were feeling uncomfortable about doing large transactions online or in a open location.
Community Development Trust: CCllr Duffy reported on a public meeting held in Crook of Devon. Unfortunately it was not well attended by the public and only three members of the Steering Committee were available to attend. There has been discussion about possibly combining with Muckhart CDT. The view of CCllrs present was that this was not an avenue to pursue as it was different local authority areas, there was a risk that outlying area of the CC would miss out and need to get local commitment. All CCllrs present voted to recommend that Fossoway CDT is maintained as a separate identity.
CCllr Marchant emphasised the need to communicate aims and objectives to the Fossoway community and need to secure funding for leafleting. Need to get a commitment locally and identify suitable projects.
Fossoway Area Transport/DRT: The new bus service 202, operated by Bay Travel, is now up and running, from Tillicoultry to Kinross. Cllr Watters explained that a review of the usage of this service will be taken shortly after the trial period. Bay Travel are currently using hired in buses and drivers and unlikely to invest in vehicles for a short term contract. It was agreed that the CC would take the lead in communicating with other CCs on the route to promote the use of this service, possibly by posting the schedule on Noticeboards, Facebook, via the schools, etc. Since travel is now free for young people this may be an incentive for increased use as for example there are just over 400 young people in Fossoway alone.
A977 Mitigation Measures: Cllr Purves has made an application to request speed measuring lines to the west of Crook of Devon and east of Drum, but this has not been done yet. He will follow up. CCllr Mudie has expressed concerns about the realignment plans for the B9097 and A977 junction and if there could be a better use of resources. However as the work has already been agreed and budgeted it will go ahead.
Crook Moss Travellers Site: CCllr Farquhar updated that there appears to be more derelict caravans and damage caused by storms is not being cleared. CCllr Marchant confirmed that there have been four Enforcement Notices served on the site which appear to have been ignored and that none have been followed through by Planning. Requested information on the process. Cllr Robertson explained that whilst the Council could issue further Enforcement Notices if residents appealed it is likely to go to Scottish Government and be overturned. It was very difficult in these particular circumstances for an Enforcement Notice to be upheld. Cllr Robertson agreed to write to Planning. Advised that CC should write to P&KC Chief Executive directly with our concerns about the process.
Speeding in Carnbo: Cllr Purves said that he hadn’t received any response to the proposal to extend the 40mph buffers further out of the village. It will be progressed through the Transport Committee
Flooding in Drum: CCllr BruceJones been in contact with several Drum residents to hear views on how flooding issues can be addressed. The main concern was what implications being assessed as Flood Vulnerable would have on residents and how can it be done. They supported the proposal that a flood assessment for sites and neighbouring areas be a requirement for any planning application in Drum
Community Speedwatch: A Facebook post has been created, asking for suggested locations and volunteers.
Kinross-shire Area Committee (previously known as the Kinross Forum): CCllr Bruce-Jones reported on the 20th January meeting that was held online. This was a successful meeting attended by representatives of all Kinross-shire CCs. Presentations were made with papers submitted by Council Officers on the 20mph Speed Limit Trial, Issue of Speed Mitigation measures on the A911 East of Scotlandwell, Options for a Community led solution for the former Blairingone Primary School, Coordination of Planning and Management in the Lomond and Ochill Hills and Future Development of Kinross Town Centre. Next meeting will be in March but it is hoped to have an interim meeting of CCs before then. Items for discussion are welcome from all CCs.
Devonshaw Whinstone Quarry: CCllr Marchant reported that the owners have been in contact with the CC and have suggested we meet them onsite to discuss their proposals. They have asked for our availability weeks commencing 14th and 21st February.
Rumbling Bridge Gorge Bridge: The flood risk survey has been completed. We are awaiting quotes for the otter and tree surveys.
Possible Adoption of Spur of U241 Road, Drum: It was confirmed that if the road is adopted by the Council, it remains a public right of way
Matters Arising with no update since last meeting:
Blairingone War Memorial, Seamab School New Build (21/01467/FLL), Fossoway and District Community Council Benefit Fund (a.k.a. Hydro Scheme Fund), Crook of Devon Skate Park, and Cemetery Car Park Extension: No information at present.
New Business:
Local Review Board: The minutes, and hence decisions, from the LRB are very hard to obtain. Can Local Councillors get anything done about this? Cllr Robertson offered to write to Planners and suggested that the CC write directly to Planning and the Chief Executive.
Crook & Drum Growing Together: Permission has been granted to start planning and planting a Community Orchard in conjunction with St Serf’s Church on land beside the Cemetery
Community Council Business:
Minutes Secretary: The search for a volunteer continues, but with no candidates. In the interim the CC members will continue to undertake the task in rotation.
P&K Councillors’ Reports:

Planning:
New Applications:
21/02133/AML Erection of ten dwelling houses, six garages and associated works (approval of matters specified in conditions of 18/01855/IPL) at Land 70 metres west of Innerdownie, Crook of Devon. CC Object on grounds of no sewage capacity, no affordable housing, traffic issues and over development.
21/02187/IPL Renewal of permission 18/01855/IPL (Residential development) at Land 100 metres northwest of Schiehallion, Crook of Devon. CC Object – same site as 21/02133/AML, hence same grounds.
Appeals:
21/00001/FLL S42 application to delete condition 6 (access upgrade) of permission 20/01319/FLL at Land 180 metres southwest of Powmill Cottage, Rumbling Bridge. At the 14th September LRB meeting the application was deferred – it was not on the agenda for the January meeting.
21/01168/FLL Erection of garage/workshop/garden machinery store at Craigend House, Powmill, Kinross. Appeal dismissed, the CC had not commented.
Decided Applications:
21/01997/FLL Extension to dwelling house Merryhills, Rumbling Bridge, Kinross KY13 0PX. The application was approved, the CC did not comment.
21/02078/FLL Alterations and extension to dwelling house, erection of garage, formation of vehicular access and decking at Rosewood, Naemoor Road, Crook of Devon, Kinross KY13 0UH. The application was approved, the CC did not comment.
Enforcement Issues:
20/00809/FLL Craigton Farm Lane –An Enforcement Notice has been issued, requiring the caravans and hardstanding to be removed and some fencing to be lowered.
20/00972/FLL Erection of two dwelling houses and garages at Land 100 metres southwest of Easter Muirhead Blairingone (enforcement ref: 21/00236/PLACON) - The agent has been in contact with Transport Planning regarding the widening of the road.
Crook Moss The new Enforcement Officer notes that four Breach of Condition Notices, a Temporary Stop Notice, an Enforcement Notice and an Amenity Notice have been issued at this site.
Site visits by Planning: Cllr Duffy expressed concern that CCllrs were being asked to visit sites and obtain evidence in relation to planning issues. Uncomfortable with this situation and keen that Planning site visits were fully recommenced.
