Draft Minutes for Fossoway and District Community Council (FDCC) meeting

Tuesday 2nd May 2023, Carnbo Village Hall

Attending: Community Councillors (CCllrs) Sarah Bruce-Jones, Trudy Duffy and Nicola Marchant; Ass CCllr Angus Cheape; Perth & Kinross (P&K) Councillors Neil Freshwater and Richard Watters; 11 members of the public (MoP); Police Scotland – Ben Sa

Apologies: CCllrs Faiza Hansraj-Jackson and Graham Pye; Ass CCllr Carol Farquar; Cllrs Dave Cuthbert and William Robertson.

Declarations of interest: None

Police report. Community Officer Ben Samson attended the meeting. 17 calls to police and two crimes recorded including theft of steel gates at Powmill, report of suspicious vans going around the area. Speeding is still actively being monitored.

There is no update on the sheep worrying incident but investigations are ongoing. Police Scotland are doing days of action to raise awareness of this issue.

Minutes of the previous meeting: The minutes of the previous meeting were reviewed and signed off.

Matters Arising

  • Road Safety in FDCC Area (Including A977 Mitigation and Carnbo) CCllr Marchant has requested a report from Cllrs on the recent traffic surveys in our district. MoP queried the current A977 mitigation measures and whether the current minor changes would slow traffic. CCllr Duffy stated that the school traffic lights project was due to commence in August; followed by Drum traffic lights. MoP asked what was the cost of the nine bollards that have just been installed in Crook of Devon. CCllr Duffy replied that the MoP could make a FOI request.
  • Community Speedwatch we still only have enough volunteers for one team which is disappointing. For our district we need at least 12 volunteers. There are continuing reports of speeding through our villages.
  • Wind Farms Nature Scotland has submitted a response to the Brunt Hill wind farm scoping opinion. The Developers, E Power Ltd, have notified the CC of the dates of their public exhibitions and we encourage everyone to attend:

17 May 3:30pm – 6:30pm Milnathort Town Hall

28 June 3:30pm – 6:30pm Milnathort Town Hall

The developer has also sent us a map of the proposed turbines.

Cllr Freshwater has suggested to the developer that they engage with CCs.

MoP informed us that he had written to PKC regarding the landscape impact and the height of the turbines. The MoP received a response from PKC that there was potential for policy incompatibility between PKC LDP2 and NPF4 and that they were seeking a view on how this will be progressed and resolved. The MoP has forwarded this response to some MSPs. The Kinross-shire Civic Trust is also engaged in this topic.

  • Community Development Trust Update Meeting on 19 April at 19.30 in the Church Hall was attended by the majority of the membership. A key topic was the future of the Blairingone School as someone has noted an interest in purchasing the School as an alternative to the Community Development Trust taking on a lease.

There are now 42 members (households) of the CDT.

A request for members of working groups was made – the groups are Path networks; Blairingone School; Partnering with CC on developing local place plans.

  • Community Transport update – a member of the Fossoway Area Transport has retired. Cllrs present said that there was a lot of focus on the Glenfarg area. The Scottish Gov has just launched a community transport fund.

New Business

  • Local Place plans We will be holding a series of events, in partnership with the CDT, to make Local Place Plans on the following dates:-

21st May 13:00 – 16:00 – Wilkie Hall, Crook of Devon

4th June 13:00 – 16:00 – Carnbo Hall

11th June 13:00 – 16:00 – Moubray Hall, Powmill

Each meeting is three hours. The first meeting will be led by PKC Officers and subsequent meetings by CCllr Marchant or CCllr Duffy together with a PKC member. Timeline is that information gathering will continue until July, will be collated by FDCC, next phase is Finding solutions (September – October) which will lead into Local Place Plan.

  • The Crook of Devon Old Village Pump A location has been found for this and it is hoped that the school children can put a time capsule under it.
  • PKC Winter Provision – it was noted that the minor roads can still be an issue.

Consultations

PKC: The Big Place Conversation – Let’s Talk Transport

PKC are currently developing a Mobility Strategy that will set out their vision for managing and developing the transport network over a minimum period of 10 years. Stage 1, commonly known as a main issues report, was approved by the Council’s Environments, Infrastructure, and Economic Development Committee on 29th March 2023. The report will be used as evidence for the Mobility Strategy, alongside feedback gathered from public consultation. PKC are now seeking your feedback by 11th June 2023 on the report which you can download from: https://consult.pkc.gov.uk/communities/lets-talk-transport/user_uploads/lets-talk-transport---main-issues-report-2.pdf

Scottish Government: Review of National Outcomes

The Scottish Government are undertaking a review of the National Outcomes. This is a requirement every five years, under the Community Empowerment Act (2015). The National Outcomes are laid out in the National Performance Framework. This is Scotland’s wellbeing framework, which sets out the type of Scotland we want to see, and measures progress towards the National Outcomes. See: https://nationalperformance.gov.scot/what-it

The CC’s response focuses on equal support for rural and urban economy and careful consideration in balancing green energy with retention of our landscape.

Local Living and 20 Minute Neighbourhood Draft Planning Guidance

Local living and 20 minute neighbourhoods can help to deliver the healthy, sustainable and resilient places required to support a good quality of life and balance our environmental impact. Guidance has been published to assist and support local authorities, communities, and others with an interest in local living and 20 minute neighbourhoods. It provides further detail to support the National Planning Framework (NPF4) policy framework on these items. The guidance sets out the benefits and context, what local living looks like and the key considerations, and the ways in which to support it. It aims to encourage, promote and facilitate the application of the Place Principle and create connected and compact neighbourhoods which prioritise liveability, and environmental, social and economic sustainability.  The closing date for responses is 20th July 2023.

Meetings attended

  • CCllrs Duffy and Marchant attended a virtual meeting with PKC to agree plans for our local place plans conversations.
  • CCllr Duffy attended the Fossoway Community Development Trust.
  • Ass CCllr Cheape attended a meeting with MoP regarding the new Rumbling Bridge Gorge Bridge. This project has been paused due to cost but instead the team are looking at improving access to the gorge and also raising visibility of the car park. CCllr Bruce-Jones asked if they were considering adding a safe crossing from the car park to the gorge. MoP requested that the footpath on the side of the nursing home is cleared from over hanging vegetation. It was noted that the landowner is responsible for this.

P&K Councillors’ Reports – Cllr Freshwater noted that there were a lot of enquiries regarding the recent recycling bins audit.** Cllr Watters also noted that recycling for PKC was out for tender which may change what we are able to recycle. There is also a trial in some areas outwith our district for use of grey bins which will allow separation of paper and plastics. MoP noted that some communal bins are now being padlocked probably as a consequence of red tags being placed on them during the audit and them not being emptied.

Local Review Board Decisions

22/01009/IPL Erection of a dwellinghouse and garage (in principle) at Land 35 metres south-west of Tethyknowe House Blairingone. Appeal refused; CC had made a neutral comment.

22/01010/IPL Erection of a dwellinghouse (in principle) at Land 40 metres south-east of Tethyknowe House Blairingone. The Applicant has withdrawn appeal

Planning Applications

23/00290/FLL Formation of equestrian arena and associated works at Kingswood, Drum, Kinross KY13 0UN. No CC comment.

Planning Decisions

23/00090/FLL Alterations to dwellinghouse  at St Thomas Cottage, Crook of Devon, Kinross KY13 0UL. The application was approved, CC had made no comment.

Planning Consultations

There is a consultation on forestry commission for the Deer Farm area where they are seeking permission to fell fir trees and replace them with broad leaf trees.

Cllr Watters noted that Planning Committee meetings are now considerably longer as if a CC objects to a planning application then the application must be discussed at a full meeting and not decided via a delegation. The CC noted that we carefully consider applications and whether or not there is a material reason for an objection and in the main provide neutral comments.

AOCB

  • MoP reported a large pothole in the single track road onto the A977 from Gartwhinzean. There is an online tool to report a pothole on the PKC website. CCllr Duffy will add a link to the online tool on our Facebook page.
  • CCllr Duffy was notified of fly tipping on Aldie Road by a resident of Aldie Road.
  • CCllr Bruce-Jones raised a concern that in the context of the potential takeover of Sainsbury’s Bank, there was a possibility that Sainsbury Kinross would no longer have an ATM. The CC will seek clarity on this and the legislation that covers access to ATMs.
  • MoPs raised concerns about the grass verge creeping onto the footpath in Carnbo. This is a concern for many of our villages.
  • MoP from Carnbo reported that the primary school bus still reverses out onto the main A91 road using a private drive. There are at least eight children on the bus. This is a safety concern. MoP asked who in the council this can be raised with – Cllr Watters stated that the person is Margaret Roy and he has reported this to her CC’ing this CC. Historically the bus had turned around in the village hall car park.

Faiza Hansraj Jackson sadly has to step down due to work commitments. We thank her for her work in the last few months.

We intend to co-opt Angus Cheape during the June meeting.

MoP reported that a PKC vegetation cutting vehicle at the Tuffhill roundabout Kinross, last week, damaged their car from pinging stones. Cllr Freshwater said he would raise this with relevant PKC department.
