Community Council Minutes - January 2022

Proceedings of the Virtual Meeting of

Fossoway and District Community Council 4th January 2022

Attending: Community Cllrs Sarah Bruce-Jones, Angus Cheape, Trudy Duffy, Carol Farquhar, Nicola Marchant, Gillian Mudie and Graham Pye; P&K Councillors Richard Watters and Willie Robertson; Members of the Public (MoP): None.

Apologies: Community Cllr Faiza Hansraj; P&K Councillors Callum Purves and Michael Barnacle; PC Ashley Mitchinson.

Declarations of Interest: None.

Police report: CCllr Bruce-Jones reported on a serious incident at the Crook Moss travellers’ site on Wednesday 29th December involving attendance by the police, three fire appliances and an ambulance.

Minutes of the previous meeting: The minutes of the November 2021 meeting along with the minutes of virtual meetings since then will be reviewed at the next physical meeting.

Matters Arising

Access to Cash in Kinross-shire: Further hub locations have been announced, including one in Carnoustie. Despite indicating our interest, Kinross-shire was not included. Liz Smith’s office has written to the Access to Cash team to ask how these locations were chosen and why we were not informed. Not further update yet on the Bank of Scotland community banking pilot.

Community Development Trust: CCllr Duffy will up-date at the February meeting.

Fossoway Area Transport/DRT: Cllr Watters advised that Bay Travel would be replacing the First Bus service between Tillicoultry and Kinross providing five daily return journeys. CCllr Bruce-Jones added that the proposed timetable was inadequate for the purposes of the regular school run. Cllr Watters emphasised the need for viability and sustained public support.

A977 Mitigation Measures: Cllr Robertson reported on the long delayed realignment at the junction with the B9097 opposite Fossoway Garage now due to commence in the spring. As an aside CCllr Duffy commented on incomplete works to the footpath alongside the A977 at the Crook of Devon hall crucial to the safety of children walking to school.

Flooding in Drum: Cllr Barnacle had asked PKC for a ditch management programme and a response was awaited pending re-opening of P&K offices. Meantime CCllr BruceJones is organising a public meeting of Drum residents and canvassing opinion to produce a prioritised list of issues.

Community Speedwatch: CCllr Duffy reported that volunteers for more areas were being sought ahead of police vetting (low level check) and there had been informal consultation on procedures with Portmoak.

Blairingone War Memorial: Cllr Barnacle had been contacted by PKC’s Estates department and an estimate of the cost involved in the work was still awaited.

Kinross-shire Area Committee (previously known as the Kinross Forum): CCllr Bruce-Jones reported that a Teams Meeting had been arranged for Thursday 20th January and this would be live streamed enabling public participation.

Seamab School New Build (21/01467/FLL): CCllr Marchant commented on a proposal to adopt the access road (in private ownership) and provide adequate turning space in the car park for emergency services. Meanwhile neighbouring proprietors maintained expressions of concern generally.

Devonshaw Whinstone Quarry: CCllr Marchant was in touch with the applicant who will contact the CC once a PAN date has been agreed.

Rumbling Bridge Gorge Bridge: The Flood Risk Assessment has been completed by the consultants, and their report received. As a result the line of the bridge is now proposed to follow the line of the previous bridge but at a higher level, meaning it will now be 9m longer than previously planned. TRACKS are obtaining estimates for the Tree, Bat and Otter surveys required by PKC prior to the planning application submission. It will also be necessary to obtain a licence from SEPA. CCllr Duffy would progress matters assisted by CCllr Cheape.

Possible Adoption of Spur of U241 Road, Drum: Cllr Barnacle was going to ask Andy Brown of PKC whether it is currently adopted or not, and ask Community Greenspace if they own the trees.

Matters Arising with no update since last meeting:

Crook & Drum Growing Together, Fossoway and District Community Council Benefit Fund (a.k.a. Hydro Scheme Fund), Ivy Cottage Powmill, Crook of Devon Skate Park, and Cemetery Car Park Extension: CCllr Marchant proposed that Ivy Cottage, which is being developed, should now be removed from any ongoing agenda.

New Business: None to report

Community Council Business:

Minutes Secretary: The search for a volunteer continues, but with no candidates. CCllr Bruce-Jones volunteered to take a minute of the meeting scheduled for Tuesday 1st February.

P&K Councillors’ Reports:

Richard Watters: Advised that the Climate Action Plan was underway and a report would be posted on the P&K website. This entire exercise was a considerable challenge but of fundamental importance.

Willie Robertson: Reported that PKC had been looking at the draft budget for 2022/23 and commented that the drive towards net zero in the coming years would be very expensive.

Callum Purves: (Written report)** Speed monitoring: no further update. 

Carnbo speed limits: we will seek to progress these changes through the local committee. 

Grit bins: roads maintenance have advised that they do not believe Aldie Road is a suitable location for a grit bin and would not usually put one on such roads. They will continue to dump grit as they have done previously when it is thought to be needed. They are looking for a grit bin for Back Crook Road, but have to move one from another location. 

Planning:

Appeals

21/00001/FLL S42 application to delete condition 6 (access upgrade) of permission 20/01319/FLL at Land 180 metres southwest of Powmill Cottage, Rumbling Bridge. At the 14th September LRB meeting the application was deferred. Still awaiting decision.

LRB-2021-38 Planning Application 21/00947/FLL – Siting of 4 holiday accommodation units, formation of parking area, landscaping and associated works, land 70 metres south east of Coup Steps, Powmill.

Decision – Review upheld unanimously; The CC had made a neutral comment.

Planning Applications

21/01997/FLL Extension to dwelling house at Merryhills, Rumbling Bridge, Kinross KY13 0PX. No CC comment

21/02078/FLL Alterations and extension to dwelling house, erection of garage, formation of vehicular access and decking at Rosewood, Naemoor Road, Crook of Devon, Kinross KY13 0UH. No CC Comment

Planning Decisions

21/01162/FLL Formation of outdoor riding arena at Appleburn, Vicar's Bridge Road, Blairingone, Dollar FK14 7LR. The Application was approved; The CC had not commented

Enforcement Notices

CCllr Marchant will contact PKC seeking an update on progress against enforcement notices prior to our next meeting.

AOCB:

Notice Boards: Concern was expressed at the poor condition of a number of the notice boards and repairs would be put in hand.

M90: CCllr Bruce-Jones drew attention to the great benefit that would arise from an improvement to the junction of the M90 with the A91 at Milnathort. Cllr Robertson responded that whilst this would do much to ease traffic congestion in Kinross such a project was unlikely to become a priority in the foreseeable future given the proximity of the north and south junction at Kinross and funding problems (absence in the immediate future of essential Developer Contributions).
