Draft Minutes of Fossoway & District Community Council Meeting
Tuesday 1st October 2024 -- 7.30pm, Crook of Devon, Village Hall
Attending: Community Councillors (CCllrs) Sarah Bruce-Jones, Angus Cheape, Tony Lamb, Nicola Marchant (Chair), Graham Pye; Perth & Kinross Councillors Dave Cuthbert and William Robertson; nine members of the public (MoP).

1. Community Police Report: From 3rd September 2024 (last meeting) there have been approximately 32 calls to Police from the Fossoway area and 12 crimes recorded on Police systems. 9 of these are for traffic offences
Crimes of Importance
25/09/2024 Vandalism at Seamab, Lendruick Muir, subject to live investigation.
26/09/2024 Take and drive away a vehicle, Main Street, Blairingone, 1 x charged and reported to
the Procurator Fiscal.
26/09/2024 Theft of tools from motor vehicle (Powmill), subject to live investigation.
[From the Commander's Report] Between 27th August and 10th September around 50 fence posts were stolen from a farm in the Rumbling Bridge area -- under investigation.
Traffic Statistics
Community officers are aware of regular areas where there are complaints about speeding, we will continue to make efforts to carry out speed checks across the area during our patrols. The Kinross Community Policing Team have been carrying out speed checks in Powmill following complaints of speeding after track days at Knockhill. Roads Policing officers have been carrying out patrols in the area, mainly on the A977 at Crook of Devon and have charged drivers for driving whilst using a mobile phone and driving without a seatbelt.
Police Appeals for Information
An 85-year old man has died following a two vehicle collision, involving a car and a lorry, around 5pm on Thursday, 19^th^ September 2024. His family have requested their privacy be respected. The driver of the lorry was not injured. Incident number 2752 on 19^th^ September.
At some point between Monday, 8^th^ July, and Wednesday, 31^st^ July 2024, 20 ewes and 20
lambs worth an estimated £5,400, were taken from a farm in Fossoway near Kinross. Reference
CR/0329442/24.

Seamab
MoPs reported several incidences of children from the school riding bicycles around the school and development site being nearly hit by contractor's and farm vehicles. The CC advised that these events should be reported to Roddy Ross at PKC's Safer Communities Team (RRoss@pkc.gov.uk or SCT@pkc.gov.uk).
2. Approval of minutes of the last meeting: The Minutes of the 3rd September meeting were approved without change and signed off.
3. Progress & matters arising:
Craighead Windfarm (search for 24/01193/FLM at: https://planningapps.pkc.gov.uk/online-applications/)
The CC's Draft response was discussed - the Fossoway and District CC objects to the planning application on the following grounds: Impact on the landscape (which must consider the cumulative effect with Brunthill); detrimental impact on our local economy especially businesses that rely on access to the Ochils (£150,000 per year on the Gliding Centre); mitigation measures described in the application do not satisfactorily answer objections we have made during the consultation with the developers -- e.g. traffic plans, proposed site access, etc.
A vote was taken on the draft response:
CCllrs: four agree with the objection; one is neutral.
MoPs: seven agree with the objection; one supports wind farm in general; one is neutral with conditions.
Therefore, the draft response as presented to the meeting will be submitted.
Community Development Trust (CDT)
The Survey is now complete and there were over 250 responses. The results will be used to create the Community Action Plan and inform both LDP3 and our new Local Place Plan. The analysis of the responses will be shared at a Community Drop-in Event between 2pm and 5pm on 17^th^ November in Crook of Devon Village Hall, where the community will vote on priority projects for consideration by the Trust.
Development of LDP3 The PKC Economy and Infrastructure Committee will review the timetable for LDP3 at their meeting on the 21^st^ Oct. Currently they are in the evidence gathering phase for submission to Scottish Government gateway review. LPPs will need to be registered with PKC by 31^st^ Jan 2025 to be considered in LDP3. As part of the LDP3 process PKC will seek input from developers and landowners on sites for development and consider what sites in LDP2 have and haven't been developed.
Road Safety in FDCC area including A977 mitigation measures
Road Improvement Projects in Ward & Kinross-shire:
The CC has re-sent our prioritised list of road improvements to PKC as there appears to be a difference between their current list and our agreed priorities.
Potholes
Cllr Freshwater had received complaints about Waulkmill and the state of the road surface at the last meeting, so he did a walkabout. It is particularly bad, both the road and some of the roadside walls etc. He has raised this with both PKC's housing (walls) and roads departments regarding the condition and both have agreed to follow it up.
Roadworks
U221 Gelvan Moor Road in Carnbo: the end date for closure is now 12th October 2024.
Amey is undertaking surfacing improvements on the M90 northbound carriageway to the north of Milnathort from Friday 4th October to Tuesday 8^th^ October: there will be overnight road closures between 7.30pm and 6.30am each night. Diversions will be in place leaving the M90 at J8 then following the A91 and A912 to re-join at J9.
Craigend Road (U223) in Powmill will be closed from its junction with the A977 for its entire length from the 21st October 2024 for a period of ten days for surface patching.
20mph Limits: Cllr Cuthbert reported that local Councillors will be briefed later this month and proposals will then be made public.
Pavement Parking Ban will start to be deployed in November.
Fossoway area transport -- 23 bus service & Community Bus
The new 23 bus service, run by Glenfarg Community Transport Group, began on 2nd September. The service is developing well and the drivers are reporting an uptake of people. There is a review meeting with PKC and Glenfarg on 9^th^ October. CCllr Bruce-Jones noted that the new service connected well for onward day trips to Edinburgh.
Seamab School Construction Work
MoP reports that no-one will engage with them, emails are unanswered, planning conditions are ignored, etc. The CC reiterated that Safer Communities is the route for engagement and Planning Enforcement for breaches of planning conditions.
Crook Moss Travellers Site CCllr Cheape spotted an abandoned vehicle near the site. This has been reported to the Police.
Warm Space Fund PKC's Community Learning & Development Group has announced the return of the Warm Welcome Fund, aimed at supporting community groups and organisations with the provision of warm spaces during the winter period. Tracey Ramsay will be co-ordinating a workshop at the LLCC on 16th October between 6:30 and 8:30pm to discuss applications. Any queries to TRamsay@pkc.gov.uk or CLD@pkc.gov.uk.
CCllr Lamb is intending to attend the workshop to apply for funding for events at Moubray Hall, Powmill.
4. Matters arising with no update since last meeting: Power capacity in Fossoway District.
5. New Business:
Kinross and Glenfarg Stronger Communities The Perth and Kinross HSCP General Practice Premises Public Survey took place in September and October 2023. Based on the consultation findings, the Primary Care Team are implementing an action plan to improve primary care premises across Perth & Kinross. Moubray Hall Repairs are need to the Hall, which is a Category C listed building. The Hall is owned by the Community and SWI manage it on behalf of the Community. CCllr Marchant will arrange a discussion with the Powmill SWI and the CDT to understand how ownership/management of the Hall and upgrades can be progressed.
Seamab Defibrillators
Seamab School have advised the CC that they have had two defibrillators fitted: One mounted to the rear of the existing school building, at the side of the big courtyard gates; One fitted to the side of the first house on the right as you enter their Care Campus on Naemoor Road, near to Lendrick Muir. Access codes will be provided to a 999 call.

Community Noticeboards The CC has been advised that many of our community noticeboards are in a poor state of repair. The CC will see if the CDT can raise monies for repairs.
6. Consultations
The significant workload associated with the wind farm applications means that the CC will not be responding to any consultations before December 2024.
Boundaries Scotland Consultation: The CC has been advised of proposed constituencies and provisional proposals changes. 8. PKC Business -- Councillors reports
Cllr Cuthbert: PKC are starting to look at Budget as there is a £1M overspend this year. He advised that CC looks at spending the remaining A977 mitigation money in case it's impacted. He attended a briefing from the Health and Social Care Partnership which revealed that that there is no NHS Dentist anywhere in Kinross‑shire which he's going to look into.
Cllr Robertson: Attended a meeting of the Scrutiny Committee that produced massive reports which must have cost a fortune to create -- surely this could be reduced? A report about homeless people shows 165 families on the waiting list at the end of September. The average time to move people out of temporary accommodation across Scotland is 278 days, and although it's only 65 days in PKC this is still too long.
Cllr Robertson reminded landowners that hedges at pavement/road edges should be cut back. A MoP asked who was responsible for the Rumbling Bridge path? Cllr Robertson said that if he was sent a picture of the location, he would arrange for the hedges to be trimmed by PKC.
9. Planning Matters
Local Place Plan CCllr Williamson joined a webinar on 24th Sept with the Ordnance Survey (OS) which was also attended by quite a few members of other CCs. Many sought more training on the software package we have been asked to use. OS were quick to recognise this need but it's not clear when they may be able to provide it. Meanwhile, CCllr Williamson will reach out to Planning Aid Scotland and see if they can possibly help.
CCllr Marchant received advice on preparation of the LPP at the Planning User's Forum: The LPP should be a series of settlement maps with future requirements plotted on them; The focus should be on affordable housing needs, active travel opportunities, tourism, protecting natural assets, responding to climate change, and improving or making better use of assets; The CC should take the opportunity to engage with landowners and developers.

23/01794/FLL Change of use, alterations and extension to sawmill to form dwelling house and formation of vehicular access at Land 40 metres south‑east of 1 Nursery Cottages, Solsgirth, Dollar FK14 7NB. The Application was approved, the CC had made no comment.
Local Review Board
Application Ref: 23/01275/FLL -- Erection of 5 holiday accommodation units, a managers accommodation unit and workshop/garage, formation of vehicular, parking areas, landscaping and associated works, land 150 metres north west of Barnhill Farm, Powmill, Dollar.
The CC has submitted the following additional comment: We strongly believe that additional holiday accommodation is not required in this locality following the approval of 124 holiday accommodation units at Whinstone Quarry, Devonshaw, Powmill (23/00491/FLM) which is in very close proximity to this application. In addition, access to this location is via rural single‑track roads which are predominantly used by our farming community; without passing places access will be problematic.
Application Ref: 23/01619/FLL -- Formation of access track, erection of stables, siting of caravan, and associated works (temporary period) (in part retrospect), land 250 metres north of The Farmhouse, Easter Muirhead Farm, Blairingone, Dollar.
The CC had objected and our objection on the grounds of road access will be passed to the LRB. Insufficient information has been presented by the applicant to demonstrate the proposal accords with LDP2 Policy 53E Water Supply and the proposed development will not prejudice existing users of the private water supplies serving the area. It should be noted that an alternative planning application for the same area minus the onsite caravan is awaiting a decision - 24/00974/FLL. The CC will not make any additional comment.

The CC had received a copy of a Proposal of Application Notice, which was submitted to Clackmannanshire Council on 1^st^ October 2024. There will be public consultation events on 6th November and 4th December.
Nettly Burn Solar Farm
This 78MW development on land adjoining the A823, opposite the Knockhill Motor Racing Circuit is expected to be submitted to the Scottish Government later this year. https://www.nettlyburn.com/
