Draft Minutes of Fossoway & District Community Council Meeting
Tuesday 6th May 2025 -- 7.30pm, Carnbo Village Hall
Attending: Community Councillors (CCllrs) Sarah Bruce-Jones, Tony Lamb, and Nicola Marchant (Chair); Ass CCllr Farquhar; 12 members of the public (MoP).
Apologies: CCllrs Adrian Carter, Angus Cheape, Graham Pye and Kaye Williamson; PKC Cllrs Neil Freshwater, Richard Watters and Dave Cuthbert; PC Ben Samson.
Declarations of Interest: None.
1. Community Police Report:
From 1st April 2025 (last report) there have been approximately 19 calls to Police from the Fossoway area and three crimes recorded on Police systems. On the 15th of April there was a RTC on the A977 where a driver failed to stop and provide details following the RTC. This is subject to a live investigation.
Community officers are aware of regular areas where there are complaints about speeding in and around Fossoway. These have all been added to our speeding matrix and we will continue to make efforts to carry out speed checks across the area during our patrols. The community team have had complaints in the last month regarding speeding in Carnbo. This area is already on our matrix to give attention to when available. Since the last report, road traffic officers have been carrying out speed checks on the M90 notably at junction 5. In this period, five tickets were issued and two reports to the Procurator Fiscal were made for speeding offences.
On Thursday 10th April, Community Officers PCs Samson and Duncan carried out a day of action in relation to warrants across the area and were successful in getting one person arrested on an outstanding apprehension warrant.
Statement regarding filming: "Kinross Community Policing Team are aware of community tensions in relation to males allegedly filming in playparks in the Kinross-shire area. We can confirm we have not had any reports of this."
2. Approval of minutes of the last meeting:
There is an amendment to the minutes in relation to Police Matters. CCllr Bruce-Jones noted that on the 1st March a 20year old woman was reported doing 90mph on the A977. There may have been a miscommunication here because the location of this was the M90 near Junction 5 (Crook of Devon) and not the A977 itself. The Minutes of the 1st April meeting were amended, approved and signed off.
3. Progress and Matters Arising:
Windfarms
Brunt Hill - ECU -- Following an initial extension granted by Scottish Ministers to PKC to respond by 20th November in response to the Applicant's ongoing discussions with Consultees a further extension was given to 23rd April. Following the Applicant's submission of Additional Information which will require to be advertised and require a further round of consultation a further extension has been granted to PKC to respond by 10th September 2025 to allow the application to be considered at their Planning and Placemaking Committee on 3rd September 2025.
Craighead - PKC -- The Transport & Planning response has raised several queries and has asked for responses to these before it can make a decision. We think that the planning application for access road which we have received is aimed at in part providing a response and we will review this in Planning Matters.
Local Place Plan (LPP) Update
The CC has been in email dialogue with a MoP who raised concerns about the process used to develop the LPP and whether or not it was democratic. The CC has responded. The MoP has informed the CC that they have made a formal complaint to PKC.
The next step in the LPP process is for PKC as planning authority to check that the LPP contains all the required information for it to be declared valid. Once that is done then they will accept the Local Place Plan and proceed to register it. The CC has received a request from PKC for the following information in order to complete the registration of our LPP:
1. Evidence of compliance with the requirements of regulation 4
2. Evidence of comments received.
Both of the above have been submitted.
Community Development Trust (CDT)
The Trust is in the process of finalising the design and printing of the Community Action Plan.
Road Safety in FDCC area including A977 mitigation measures
Speeds and safety on our roads continue to be a concern to all residents and following the RTC on the A977 last month Cllr Cuthbert raised these again with PKC officers including confirmation of what remained in the Mitigation Budget and how it could be spent. The response from Officers was that there was a remaining Budget of £173,000.
Officers implied that their understanding was that there is unlikely to be sufficient room within the public road boundary to proceed with a roundabout at the A977 / B9097 junction although they had not carried out an options appraisal or initial design work. Notwithstanding this they thought that a roundabout would exceed what is left in the budget.
The Officers also stated that it is their intention to carry out further surveys ONCE the national 20mph strategy has been implemented, and then to arrange a meeting to discuss the results and options for the remaining budget.
In the CC's opinion it is therefore unlikely that we will see any progress on this in 2025 which is very frustrating considering that the lights have been operational for nearly 18 months already.
We have received a number of suggestions for further measures on the A977 and A91 plus other roads within Fossoway and these have been included in our Roads Priority list given to Councillors and in both the CAP and LPP.
MoPs brought to our attention the following issues relating to A977 Drum Crossroads lights:
Corb Bridge Culvert (on the B934 in Dunning Glen) Will be closed for nine weeks from 2nd June 2025 for bridge strengthening works.
Fossoway area transport
Glenfarg Community Transport Group have been informed by the Community Transport Association that Glenfarg have been shortlisted for Bus Service of the Year for the Scottish Transport Awards being held in June for their 23 Bus Service. CCllr Lamb reported that the six‑day passenger usage of the combined 55/23 bus has now reached over 1800 people and the 23 service accounts for over 550.
PKC have advised that they will be releasing a further three community buses at the end of May and three more at the end of November. There have been over 45 applications for the buses but some of these have stepped back as they have become more aware of the challenges involved in running a community bus, and the amount of funding required. CCllr Lamb has prepared a detailed business case and the Trust has an active funding application to cover running costs for one year.
Seamab School Construction Work
It is important to note that local residents are supportive of Seamab as an institution but are concerned about the safety of the children during the construction phase and the impact on residents' daily lives and safety. The residents feel that they have not been heard when they have raised concerns in the past. The residents are now engaged with Safer Communities Team.
CCllr Marchant has received the following responses to her questions from Safer Communities Team PKC, which have been shared with close residents:
[Current intake and plan to increase this and age of young people]{.underline}: Current intake is 25 with a capacity limit of 25. The age limit of attending pupils has increased to 18. This doesn't necessarily mean that new older pupils will attend Seamab but will allow some existing children to continue with their education in situ.
How are calls regarding concerns handled: All calls relating to safety concerns will ultimately be dealt with by the School, if they are school or child related. Issues regarding the building site are managed by the contractors who keep Stuart informed. All pupils are supervised while they attend school with required safety plans in place.
A MoP advised that they had received confirmation, following an independent soil analysis, that asbestos was present in an open trench within the building site. A video showing this was shared at the meeting. Local residents were concerned about dust rising from the open trench and contaminated materials on the surface of the ground.
The CC agreed to write to elected Ward Cllrs and PKC Officers to seek their advice on how to deal with this. Concerns were also raised that planning conditions have not been upheld and the CC will include this in their email to PKC.
Fossoway Community Benefit Hydro Fund
CCllr Pye is arranging an onboarding meeting with the two new Trustees
4. Matters arising with no update since last meeting: Community Noticeboards, Rubbish at Gartwhinzean Hotel site Powmill and Crook Moss Travellers Site.
5. New Business:
Dog Fouling on Millenium Path A MoP informed the CC that the lack of dog bins on the millennium path is resulting in dog waste being left along the path. The CC provided the PKC website link on where this can be reported, however PKC has not responded yet. https://my.pkc.gov.uk/MyServices
PKC Grow Wild PKC are rolling out the Grow Wild Initiative to all of Perth & Kinross, there will be some new signage on sites that will identify that some areas of grass will be left longer. PKC would be happy to meet with communities to map areas and agree potential locations for tree, shrub, or wildflower planting. PKC have been fortunate to have allocated budget to allow them to roll this out with communities and they will be recruiting staff to accelerate this process. Nature Restoration Fund PKC has received £187,000 from the Scottish Government to support projects that help reverse biodiversity loss and restore Scotland's nature. The fund is open to both council led and community led projects, with a minimum funding threshold of £1000. Closing date is 2nd June 2025.

SEPA: are launching a consultation on a proposed Environmental Performance Assessment Scheme (EPAS) - a fairer way of reporting on how businesses are meeting their responsibilities. 7. Community Council Business:
Fossoway and District CC Elections There was a recent thread on social media about how CCllrs were elected and what they did. Main CC elections are held every 3 years with the option to coopt or hold byelections in between to ensure minimum numbers of Councillors are maintained.
The next CC elections will be held on 6th November 2025 and nominations and elections are managed by PKC (https://www.pkc.gov.uk/communitycouncilselections). The Fossoway and District CC has a minimum of four and up to eight CCllrs. 25/00217/FLL Extension to dwelling house Ardoch House, Fossoway, Kinross KY13 0UP. The Application was approved the CC had made no comment.
Planning Applications
25/00391/FLL Extension to dwelling house and installation of a flue at Townhead Cottage, Carnbo, Kinross KY13 0NX. No CC comment.
25/00301/FLL Formation of access track at Land 700 metres north of 4 Ashfield, Carnbo, Kinross KY13 0NX. The CC made neutral comments regarding flooding and safety of core path users during construction phase.
