Draft Minutes of Fossoway & District Community Council Meeting
Tuesday 5th March 2024 – 7.30pm, Carnbo Village Hall
Attending: Community Councillors (CCllrs) Sarah Bruce-Jones , Adrian Carter, Tony Lamb, Nicola Marchant (Chair); Assoc CCllr Carol Farquhar; Perth & Kinross Councillors (Cllrs) Dave Cuthbert, William Robertson; eight members of the public (MoP).
1. Apologies: CCllrs Angus Cheape and Graham Pye; PKC Cllrs Neil Freshwater and Richard Watters.
2. Declarations of interest: None
3. Community Police report: Since 6th February 2024 (the last meeting) there have been approximately 46 calls to Police from the Fossoway area and no crimes recorded on Police systems. A 22 year old man was charged and remanded for committing a number of Housebreakings in the Kinross areas during October 2023. Community Police Officers often post on their Twitter page @PSOSPerthKin with updates on what they are doing out and about in the local area under #KinrossCPT.
On Friday 1st March PC Samson dropped off pop-up PC Kirsty to Fossoway Primary School to assist pupils as part of their ongoing local Road Safety awareness campaign.
CCllr Carter reported that he had observed a police car going through Powmill at above the speed limit.
4. Approval of minutes of the last meeting: The Minutes were approved and signed off.
5. Progress & matters arising
Windfarms
The CC welcomed Jason and Alex from Galileo and Craighead Wind Farm who gave an update on progress towards their future planning submission to PKC. Details of the proposed development are on their website: https://craigheadwindfarm.co.uk/
If approved start date for construction will be dictated by when a connection date is agreed with National Grid. It is likely that electricity generated will be connected at Westfield, Lochgelly and how this 15mile connection will be made is completely within remit of SSE.
The CC have agreed to engage with Planning Aid Scotland who offer free advice on planning matters to ensure we are fully cognisant of how to respond to the application, once it is submitted to PKC, which is anticipated to be at the end of April or early May. We and other CCs will be consulted and will have 28 days to respond. The CC will continue to engage with other CCs regarding potential Community Benefit.
Fossoway Community Development Trust (FCDT)
The Trust met on the 20th Feb and heard about progress on the Community Asset Transfer of the Blairingone School and Community Action Plan. A website with logo is currently being designed and a Newsletter and Questionnaire on future use of Blairingone School will be delivered to all households shortly.
The Trust is hosting public engagement events on 19th March in Moubray Hall, 20th March in Carnbo Hall and 26th March in Crook of Devon Hall all from 7-9pm. The purpose is to raise awareness of the Trust and hopefully to increase membership before the CAP and LPP process is started.
Community transport is being progressed by CCllr Lamb and Mike Barnacle. They are currently in discussions with Glenfarg Community Transport to run a community bus for Fossoway District, using the PKC community bus based at Loch Leven Campus. We are currently looking for volunteer drivers. Glenfarg is prepared to fund drivers obtaining their D1 licence. If anyone is interested please email info@fossowaytrust.com
Road Safety in FDCC area including A977 mitigation measures:
Carnbo: The previous closure of the A91 at the bridge has now ended. There will be a future closure of the A91 for road repairs. The CC will continue to push for the extension of the 40mph limit east of Carnbo to the Village Hall and for a footpath to the west of the village.
Drum Crossroads: Feedback from residents is that they are pleased with the traffic lights, but they are awaiting changes to signage and extension of the 30mph limit to the east of Crook of Devon. PKC are reviewing the outcomes. Road survey strips have been in place recently to measure actual speeds and we will ask to see the results.
A MoP had emailed to complain about speeding on the back Crook of Devon road. Another MoP said that there is still excessive speeding in the Crook of Devon area and they found it challenging to cross the road. MoP raised concern regarding the closeness of the two sets of lights in Drum. This is being monitored by PKC and we understand that there is still some signage to be changed.
Speed Watch: No update while awaiting Police Scotland taking on the administration working with the secretary of Milnathort CC.
Review of A977 Mitigation: The Only remaining project is the proposed realignment of the B9097 Junction. We have previously received representation from the community that this is no longer a preferred option. MoP and CCllrs proposed a number of additions to our list of further action along A977, in particular in Powmill.
Road Improvement Projects in Ward 8 -Kinross-shire: The CC has updated its list of priorities for Fossoway, including corrections to location of Carnbo projects, and addition of proposals for Rumbling Bridge and Aldie Road.
Fossoway area transport – 202 bus service: It appears that the Stagecoach has returned to using older buses which cannot meet the times on the timetable. They have also changed the route in Dollar which has added time to the route. Consequently the service has once again deteriorated. Discussions are ongoing with PKC to improve the service. Associate CCllr Farquhar reported that a MoP had written regarding their frustration at the lack of reliability of the 202 service.
Cllr Cuthbert requested that we once again write our complaints to PKC Margaret Roy. CCllr Lamb has agreed to do so by email.
The Stagecoach bus service from Kinross is being reduced making travel to Ninewells virtually impossible.
A survey about experience of rural transport is open and we encourage everyone to respond. A link to the survey is on the CC Facebook page.
Yellow grit bins: Unfortunately, our requests for new grit bins on Aldie and Craigend roads have been refused although PKC have advised that they will ask Tayside Contractors to drop a pile of grit at these locations. PKC roads department do not have the resources to fill the grit bins.
Crook Moss Travellers Site: Tracey Ramsay is now the community liaison with the Travellers and has reached out to CCllr Farquhar to discuss engagement with them. CCllr Farquhar will meet with Tracey. MoP reported that emergency services were at the site again today and there have been several incidents of fires at the site.
Red Diesel and Snow Clearance: PKC have advised that this is an issue for HMRC and that farmers should check directly with HMRC.

Scottish Government
Proposals for a Heat in Buildings Bill: Consultation
The CC’s response will focus on the feasibility and cost effectiveness of moving all domestic households to clean heat sources before 2045. We are in general supportive of households being required to meet minimum energy efficiency standards by 2033, however, we think that this list could be - 270 mm loft insulation; draught-proofing; heating controls and 80 mm hot water cylinder insulation. BUT cavity wall insulation and suspended floor insulation should only be required if they are cost effective and reasonably feasible without major disruption to the property.
We oppose the proposal to require house buyers being made to convert to clean energy within a fixed time period following purchase of a house and also oppose enforcement of all of the proposals.
Climate change- draft Scottish National Adaptation Plan 3
We are all living with climate change. Coastal erosion, storms, flooding, wildfires and drought are putting increasing pressure on our everyday lives. These impacts change a lot depending on where you live. An island community in the Outer Hebrides will experience climate change differently to a community on the banks of the Clyde in Glasgow.
Local and lived experience is fundamental to shaping an effective response to climate change and its impacts. Your views will help ensure the final Adaptation Plan in Autumn 2024 is reflective of your priorities. The consultation closes 24th April 2024 – Cllr Carter will prepare a draft response.

9. Community Council Business – meetings attended
CCllr Lamb attended meeting with Glenfarg Community Transport on 1st March and Rural Transport Future Scotland on 5th March. CCllr Bruce-Jones attended Kinross-shire Committee on 15th February and Kinross-shire Community Investment Fund Panel on 21st February.
10. PKC Business – Councillors reports
Cllr Cuthbert reported that the Kinross-shire Committee have agreed to carry out an active travel plan for Kinrossshire. Current monies will be spent on footpaths. PKC have agreed a budget with no increase in Council Tax.
Cllr Robertson reported that TRACKS have been offered a Rennie Mackintosh bridge for the River Devon replacement bridge but the siting of this is challenging.
11. Planning Matters
23/00491/FLM Devonshaw Quarry Holiday Lodges
We have been informed that this planning application will be discussed at the Planning and Placemaking Committee on 13th March. PKC Officers have produced a report and they are proposing that the application be approved. The CC, who objected to the application, had been asked if we want to make an additional representation at the meeting. We agreed that we should and CCllr Marchant will give the presentation.

There were no planning applications for our district this month.
Planning Decisions
23/02082/FLL Erection of a dwellinghouse and associated works at Land 30 metres northwest of County Fabrics, The Water Mill, Crook of Devon. The application was approved the CC had made no comment.
23/00808/FLL Erection of office/storage building, formation of vehicular access, car parking, landscaping, and associated works at Land 110 metres southeast of 3 Birkfield Park, Rumbling Bridge. The application was approved the CC had made no comment.
12. Correspondence
We have received a letter from the Lord Lieutenant’s Office requesting nominations for attendance at the Kings Garden Party. CCllr Bruce-Jones proposed two individuals from our community which we endorsed.
