6th December 2016, Fossoway Primary School
Attending: Community Cllrs: Angus Cheape, Jennifer Donachie, Trudy Duffy, Carol Farquhar, Graham Kilby and Graham Pye; Cllrs Mike Barnacle and Dave Cuthbert; 14 Members of the Public (MoP).
Apologies: Cllrs Joe Giacopazzi and Willie Robertson.
Co-option of New CC Member: The CC welcomes Cameron Brown as a new co-opted member – Proposed: CCllr Duffy; Seconded: CCllr Kilby.
Declarations of Interest: CCllrs Duffy and Donachie declared an interest in planning application 16/01313/FLL.
Police report: Unfortunately no Officer was able to be present at the meeting. There were three incidents to note, received via Perth and Kinross Community Watch and directly from PC Douglas Stapleton: Wooden slats were removed from a bench in Powmill on 9th November; There was a theft of a tractor from outside a farm near to Powmill; There was a theft of a quad bike from outside a farm on the B9097 close to Findatie – two males have been charged for this offence. Cllr Cuthbert reports that there is to be a new Community Police Sergeant in Kinross – hopefully that will mean more police attendance at these meetings in future.
Minutes of the previous meeting: The minutes were signed off with an amendment to minute the issue with the adoption of Craigton Lane (see new business below.)
Tullibole Castle’s Halloween Walk: Roderick Moncrieff described how this year 400 people walked through the woods on the weekend before Halloween. Roderick proposes to run a fund-raising event similar to the Enchanted Forest for the week leading up to Halloween next year, with the potential for a large number of vehicles and visitors during the week. The Rotary Club will provide the principal stewards and take a corresponding percentage of the proceeds. There is an opportunity for other local groups or individual volunteers to help with the stewarding - approximately twelve stewards would be needed each evening.
Matters Arising
Crook Moss Traveller’s Site: Cllr Barnacle is still awaiting a response from Scottish Water.
A977 Defects and Mitigation Measures: Cllr Giacopazzi arranged for drains to be cleared on the A977 to the south of Gairney Burn Lane. CCllr Duffy has received numerous complaints from MoP about the lack of white lines in the sections of the A977 that have been resurfaced. Cllr Barnacle will continue to chase this, especially the replacement of the cats-eyes; Cllr Cuthbert has been told that winter gritting would damage new lines, which is why they have not been replaced as yet. Ian Kipling, a new member of PKC’s highways department, is looking into the speed activated signs and the bollards opposite Crook Village Hall. Cllrs Cuthbert and Barnacle are seeking a meeting with Mr Kipling to discuss the A977 Mitigation Measures before proposals are published, and the CC will hopefully join this meeting. MoP reported that the grass verge is being dug up along the A977 between Crook of Devon and Powmill – Cllrs will investigate.
Rumbling Bridge Hydro Scheme: The Community Benefit Group are still finalising their organisation and preparing for the public consultation next year. A MoP reports that there is rubbish left over from the construction – CCllr Duffy will mail Hugh Wallace to ask for this to be addressed.
Speeding Through Villages: CCllr Duffy has been assured that we can apply for surveys of vehicle speeds through the villages. Cllr Cuthbert has been pursuing the deployment of “pop-up policemen”, however the lack of any documented proof that they actually work is holding this up.
Crook and Drum Growing Together: CCllr Duffy reported that they are still waiting to receive their grant.
Powmill Bloom Group: CCllr Farquhar reported that, as reported in the police report above, wooden slats have been removed from a bench they have placed opposite Aldie Road. Additionally, the bench opposite the Milk Bar has also been attacked by vandals. The group is proposing to adopt the red telephone box in Powmill, however Cllr Cuthbert suggested that it would be better if the CC acquired it, however we have concerns about whether the CC would then be liable for any accidents, and it’s also not clear whether we are allowed to fund this sort of project from our administration allowance, both initially and ongoing.
Station Road Adoption: Cllr Barnacle reports that letters containing the new contribution amount have been sent out, and already two people have agreed to it. He is hopeful that the scheme will soon go ahead.
Blairingone War Memorial: Cllr Barnacle has not yet received a written reply from Profile Projects, confirming their financial contribution, although this has been verbally promised. Once this has been received, the next step is to contact a local mason to confirm the proposal of using high pressure water jets to detach the memorial without causing any damage.
B9097 Route Action Plan: Portmoak CC had proposed that the section of the B9097 to the east of the M90 should receive a 50mph speed limit; Cllr Barnacle supported this, and proposed that the limit should be imposed on the entire length of the road, however PKC’s Road Safety Officer has rejected this on the grounds that this was not raised as a road safety issue by Police Scotland. The community present noted that the current speed of vehicles is already often in excess of the National limit, but the limit seems to be rarely, if ever, enforced.
Ivy Cottage, Powmill: PKC have issued a repair notice to the owner, who lives in America.
Matters Arising With No Update Since Last Meeting
Sports Hub, Safer Route to School – Drum, Dunning Glen: No update.
Bollards Opposite Crook Village Hall: We are still awaiting a report from PKC Roads Department on how the safety of this section of road could be improved, however local Cllrs are pressing them for a prompt response.
New Business
Craigton Lane Adoption: Cllr Barnacle is trying to get Eddie Jordan, PKC’s Enforcement Officer, to clarify the position about the preparation for adoption of this road, which was started on earlier in the year but no work has been done since June.
Community Council Business
Meetings Attended: CCllr Duffy attended the Living Streets Workshop on 15th November where the “walkability of a community” was discussed. The tool enables identification of areas that could be improved to make them better for pedestrians. CCllr Duffy hopes to adapt this tool so it can also be applied to rural environments.
CCllr Brown attended the Planning User’s Forum on 9th November – PKC will publish a Whitepaper in December containing guidance for CCs on input to planning decisions. The Place Standard tool may be useful to identify local issues.
CCllr Cheape was due to attend a meeting of the Kinross-shire fund, but this has been postponed until the New Year.
Councillors’ Reports
Mike Barnacle: Cllr Barnacle reminds us that the delay to the Main Issues report allows the possibility of further consultation in some areas.
Dave Cuthbert: Cllr Cuthbert notes that the budget setting period is approaching, and uncertainty about future finances are resulting in further cuts being proposed, with some areas already at critical staffing levels. The Action Partnerships seem to have stalled at the earliest stage of identifying issues, without any significant progress in actually addressing the issues already identified. Perhaps these groups would work better if done at a more local level, where the issues are already well known.

Object on grounds of over-development (discussed by email prior to this meeting, following a lack of quorum at an earlier meeting.) Several MoPs noted that the applicant has felled a large number of large trees on the site and also cleared other vegetation. Cllr Cuthbert will report this to the enforcement officer.

AOCB: The Rumbling Bridge Car Park has changed owners; Cllr Barnacle is seeking written confirmation of the enforcement position.
