Draft Minutes Meeting Fossoway and District Community Council
Tuesday 4th September 2012, Fossoway Primary School
Attending: S Morrison, A Lavery, S Anderson, K Borthwick, A Cheape, T Duffy-Wigman , Cllr Joe Giacopazzi, Cllr D Cuthbert and 12 Members of the Public (MoP).
Apologies: Rod Paterson, Cllr M Barnacle and Cllr W Robertson.

Community policing:
Community police officer reports: Pressure washer theft under enquiry; Suspicious person going door to door in Crook of Devon - car traced; Housebreaking under enquiry; Another Door to Door in Crook of Devon being investigated; Speed monitoring continues; Campaign against erratic driving in progress; Metal thefts – please report anything suspicious; Community Speed Checks – Still awaiting final report; MoP asks for attention to speeding in Carnbo, people doing Dollar Academy school runs so 8am to 9am would be a good time; Best contact number for local police is 0300 111 2222
Minutes of the previous meeting: There were no amendments so the minutes were signed off.
Matters arising:
• Blairingone War Memorial: Alastair reports that it’s still with the planners.
• Crook of Devon Church Car Park: Alastair reports that the planning application has been submitted, initially the planners said that they would be rejecting under delegated powers, however once they realised it was land belonging to council it will be discussed at meeting on 26th September with a recommendation from the planners for approval.
• Travellers’ Site Crook of Devon: to be discussed later this meeting – see below.
• Signposting Core Paths and Rights of Way: Several members of the public report that they have still not been notified that signs are due to be erected on their land. This CC has exhausted all methods of objection, so escalating to individual’s MP/MSP would be the next step - both Councillors present ask to be informed of any problems.
• Snowie Wood Chip Plant at Blairingone: Sheila passes on message from Alan Kinloch who suggests that a breach order should have been issued by now; item was on last planning meeting agenda, but not discussed, due for September meeting.
• Co-Option of CC Members: Kevin reports that procedure we followed wasn’t acceptable to PKC, so Sheila and Angus were required to fill in the normal forms used for election – this has been done and PKC now approve their membership of this CC. Sandy suggests that this could have been avoided if PKC allowed more time prior to elections to submit applications.
CC business: Meetings attended: Convention of Perth and Kinross Community Councils: Sandy and Kevin attended a meeting of this council, which is becoming increasingly poorly attended.
Councillors’ reports:
Cllr Giacopazzi: Crook Moss – will be speaking at the planning meeting.
Cllr Cuthbert: Nothing to report.
Crook Moss: The community mandated the community council to raise a formal complaint regarding the content of the Report of Handling on planning application 12/00546/FLL, and to write to Mr Littlejohn regarding the communities concerns over his department handling of this application, and the lack of engagement with the community over the issues that had been raised by members of the community and the community council.
The contents of the formal complaint were in regard to four significant errors which would mislead the Development Management Committee. These Were….
1. Failing to mention that the site is immediately out with the settlement boundary, and therefore Policy 48 applies.
2. It states no objections from statutory environmental consultees; When there was an objection from SEPA.
3. Miscalculation of existing travellers sites within the area of Kinross-shire.
4. Omission of key paragraphs in the national policy for gypsy/traveller sites.
There was extensive discussion on the content of the letter to Mr Littlejohn and eventually 12 items were agreed for inclusion. It was also agreed that copies of the letter and formal complaint should be sent to the area MP and area MSP, the four local councillors, the convener and vice convener of the Development Management Committee.
The Chair reported that he had spoken to SEPA and was re-assured that their objection stood, and they would ensure that all their concerns were addressed. He had also spoken to PKC’s environmental dep. Who stated that they could only make recommendations, and it was up to planning to decide whether to include their recommendations in planning conditions. It was then the responsibility of planning to enforce these conditions. The Chair thanked the community for its support and assistance in bringing forward points for the letter.

12/01526/FLL. Erection of a dwellinghouse. Land 50 Metres South West of Greenpark Church Road Crook of Devon. Recommendation: Refusal, as contrary to Policy 48 of the Kinross Area Local Plan.
12/01490/FLL. Modification of existing consent (10/02172/FLL) to vary condition 7 (drainage). Land 20 Metres West of The Brae Rumbling Bridge. Recommendation: No Community Council comment
12/01501/AML. Erection of a dwellinghouse (approval of matters specified in conditions) at Plot 1. Land opposite Devonbank Crook of Devon. Recommendation: No Community Council comment
12/01503/AML. Erection of a dwellinghouse (approval of matters specified in conditions) at Plot 3. Land opposite Devonbank Crook of Devon. Recommendation: No Community Council comment

12/01566/IPL. Erection of a dwellinghouse (in principle). Burnside Vicar's Bridge Road Blairingone Dollar FK14 7LR. Recommendation: No Community Council comment
12/01202/FLL. Siting of a catering kiosk. Land 70 Metres East Of Powmill Cottage Rumbling Bridge. Comments closed: There was significant feeling amongst the public that the siting of this Kiosk was inappropriate, and the entrance to it was at a dangerous location.
Correspondence: Kevin went through a list of all relevant correspondence and a total list was available in the table for public viewing.
AOCB: Angus urges people to support the Community Office which is struggling for survival, by volunteering to assist with the staffing.
Trudy has heard rumours that the Crook of Devon football field is to be lost – Can anyone help to increase its use both for football and other sports? Cllr Cuthbert will look into ownership and potential plans.
MoP asks about Farm Watch scheme – suggested to contact Police.
Kevin notes that speed signs on A977 don’t seem to be working correctly – Cllr Cuthbert agrees to investigate.
