Draft Minutes Fossoway and District Community Council
2nd October 2018, Fossoway Primary School
Attending: Community Cllrs Angus Cheape, Jennifer Donachie, Carol Farquhar, Graham Pye (chair) and associate member Tam Carroll; P&K Cllrs, Callum Purves, Willie Robertson and Richard Watters; 10 Members of the Public (MoP)

Declarations of Interest: None.
Police report: Unfortunately, no officer was able to be present at the meeting. There were two incidents to note in our area since the last CC Meeting from the Commander’s Reports received via Perth and Kinross Community Watch. Between Wednesday 5th September and Saturday 8th September, a wire fence around a field containing horses was damaged near to Whistlemount, Powmill. As a result of the damage a number of horses escaped from the field. Between 8am, Monday 17th September and 8am the following morning, a chain and padlock which were securing a field gate at Blairingone were cut off and removed.
Chief Superintendent Paul Anderson has moved from the Division to a new post. From Monday 3rd September, Chief Superintendent Andrew Todd has taken on the role of Divisional Commander for Tayside Division.
Minutes of the previous meeting: The minutes of the previous meeting were signed off without amendment.
Matters Arising
Blairingone School Estate Transformation: Statutory consultation meetings were held on Thursday 6th September at Fossoway Primary School and Tuesday 18th September at Blairingone Primary School. Tam Carroll, associate member of this CC and CCllr Farquhar attended the Blairingone meeting. Associate member Carroll stated that in his view the meeting was fruitless and PKC representatives were not interested in local opinion. CCllr Farquhar reported that the purpose of the meeting was to set out the procedures for closure of the school and accordingly, to move pupils to Fossoway Primary School. Also, the purpose of the meeting was to provide an opportunity for interested parties to make their views known and these views would be accounted for. CCllr Farquhar stressed that the meeting was about closing the school and that PKC representatives were not there to respond to arguments about retaining the school. Cllr Watters emphasised that the recommendation from PKC is to close the school. The statutory consultation period is to enable comments to be registered, noted and taken forward. Cllr Watters stated that comments could be made via the PKC website and the closing day for the consultation is Friday 5th October. The next step in the process would be Education Scotland looking at the proposals, alongside the outcome of the Statutory Consultation and recommendations would be made to PKC. Ultimately PKC will have the final say regarding the closure of Blairingone school.
Lambhill: Planning application 17/02015/FLL to place a static caravan on the site was refused on 11th January. The applicant appealed to the LRB who upheld the decision, and this was made public on the 12th September.
Powmill in Bloom: CCllr Farquhar reported that the group had not met since the last CC meeting, however a get together to tidy up is planned for Sunday 7th October. A meeting is also planned for November to decide how the Bloom Groups can support one another regarding the Best Kept Village Competition.
Crook and Drum Growing Together: CCllr Farquhar reported that Amanda James, from Crook and Drum Growing Together, had informed her that the group were pleased to receive a bronze award on their first entry in the Beautiful Scotland Competition and a silver award for the Take a Pride in Perth & Kinross Competition. The group are concerned about an area of shrubs near West Crook Way and will consult with PKC to see how this area can be tidied up and maintained.
Hydro Scheme Fund: The CC has been notified that the Hydro Scheme’s AGM will be on the 27th October; there will also be a tour of the site, probably starting at 2pm from the Village Hall. More information will be forthcoming.
Powmill Play Park: CCllr Farquhar reported that there has been no movement on this item.
Fossoway Gathering: CCllr Duffy passed on the information that this CC will be the lead organisation for the Gathering.
Blairingone War Memorial: A new planning application for the realignment of the vehicular access at Blairingone church has been submitted and if successful may assist in moving this forward.
Ivy Cottage - A MoP asked if a freedom of information request could be made to PKC to find out if council tax is paid on this property. Discussion ensued however there is no clear-cut way of dealing with the cottage as the owners live outwith the UK.
Matters Arising with no update since last meeting:
Crook Moss Travellers Site, A977 Mitigation, and LDP2: - No information at present.
New Business
Blairingone Parking: A MoP reported to this CC that vehicles are frequently parked on the pavement in the village, both obscuring the view of other drivers of pedestrians on the crossing and requiring pedestrians to walk in the road instead of using the pavement. The problem is worst early in the morning (before 7am) and in the evening (after 5pm.) Cllr Watters has contacted the police about speeding cars in the village and they are committed to make Blairingone a priority. Cllr Watters will also contact the police regarding the issue of vehicles parked on the pavement. Cllr Robertson mentioned that a way of dealing with this would be for the CC to write back to the MoP, who should then take photos of the cars, email the photos to Cllr Robertson, who would then contact the police.
Carnbo Speeding: A MoP has contacted this CC to report on the increase in number of speeding vehicles passing through the village. Although it is proposed to install Vehicle Actuated Speed signs in Carnbo, they are not scheduled until next year. CCllr Pye asked if there was any way this could be brought forward. Cllr Robertson stated that there is a budget for this, however the money has been used up for this year. Cllr Robertson agreed to look into this.
Crook of Devon Village Hall: CCllr Donachie noted that the bottle banks in the recycling area in the hall car park are surrounded by broken glass, extending to parts of the car park itself. Cllr Robertson undertook to look into this.
Community Council Business - Meetings Attended
Sports Hub: CCllr Farquhar reported that all the activities previously reported were moving forward successfully and that she was encouraged by what is happening in the Kinross-shire area.
Community Investment Fund: A meeting of the Community Investment Fund will be held in January 2019 and CCllr Cheape will represent the CC at this.
P&K Councillors’ Reports
Willie Robertson: Cllr Robertson reported that at a recent TRACKS meeting the costing of the new bridge over the River Devon was discussed and this was not as expensive as was first anticipated. The bridge will need to be higher than the previous bridge to avoid flood damage. A meeting is to be organised to decide on the definitive location of the bridge at which CCllr Duffy and CCllr Pye will attend.
Richard Watters: Cllr Watters reported that there will be a full council meeting on 3rd October and a motion was to be considered regarding EU nationals and nominations to enable them to sit on Community Councils. This will mean changing the current rules. Mechanisms will also need to be put into place to allow EU nationals to be able to vote in elections.

There was some discussion regarding application 18/01493/FLL as a MoP requested information about the intended use. CCllr Donachie reported that the application stated the care home is currently being prepared for use as a residential provision for 4 children. There is no indication as to the age of the children or if it is linked to another residential care home in the area.

Correspondence - All correspondence was available for viewing:
Dave Stubbs (PKC’s Greenspace Coordinator) informed the CC that he has arranged for path repairs/improvements along the railway path from Peat Gate to Church Road, Crook of Devon. These works are to restore the railway path originally built by the Countryside Trust 8-9 years ago and to tie in the path on PKC’s land to the path built by others at the Station Road end.

AOCB:
Defibrillator - There is now a defibrillator at the Crook of Devon Village Hall. Training courses are due to be arranged shortly. There is also one in Carnbo Village Hall.
B9097 & U241 - A MoP asked why the speed restriction on the B9097 has not yet been changed to 40mph. The MoP also enquired as to why the U241 has not had the speed restriction changed to 20mph. The MoP has corresponded with PKC regarding this, but nothing has been done. Cllr Robertson will act on this.
Community Transport initiative – A MoP stated that two local taxis organisations have now withdrawn from this scheme. Cllr Robertson said that rural transport has issues, but this was a definite concern. Cllr Watters will look into this.
A977 – A MoP asked about looking into the signage on the A977. Signs directed traffic along this route and yet the plan by PKC was to make the A977 a less desirable route to travel on. No action was agreed for this.
VAS – A MoP stated that the vehicle activated signs were not slowing the traffic down on some occasions. Cllr Robertson advised the MoP to take a photo of the car, with the VAS speed limit sign in clear view and email this to him. Cllr Robertson said he will alert the police to this.
