Draft Minutes Fossoway and District Community Council

Declarations of Interest: None.
CCllr Duffy’s Situation Post Brexit: As previously noted, CCllr Duffy, being a citizen of the EU, will currently lose the right to vote in local council elections, and hence the right to be a Community Councillor, after Britain leaves the EU. Cllr Watters with the support of Cllr Barnacle raised a motion with PKC to address this issue, and the motion was unanimously passed. Both CCllr Duffy and this CC are grateful for this action.
Police report: Unfortunately, no officer was able to be present at the meeting. There was one incident to note in our area since the last CC Meeting from the Commander’s Reports received via Perth and Kinross Community Watch: A patio table went missing from a garden on Station Road, Crook of Devon between Wednesday 13th and Friday 15th June, however according to a MoP present at this meeting it was later discovered that the wind had blown it away.
Minutes of the previous meeting: The minutes from the May meeting, not available at the last meeting were signed off; the minutes from the June meeting were signed off without amendment.
Matters Arising
A977 Mitigation: Lachlan MacLean, PKC’s Project Officer sent an update. The signalisation of the School Road junction in Crook of Devon is provisionally scheduled for 15th October. The work at the Saline Road, Blairingone junction will follow, probably around November. The A977/B9097 junction realignment has attracted some concerns from MoPs, and hence a safety audit of the proposed works will take place first. Finally, the work at the Drum crossroads should take place early next year. Meanwhile, works to upgrade the directional signage along the A977 are taking place now. The CC had previously requested a VAS on the A91 as well, but there is no information about this at the moment.
Blairingone School Estate Transformation: Cllr Barnacle informed the meeting that the next step after the decision to close the school is to hold a statutory consultation. Cllr Barnacle is also concerned that the decision should not be finalised until after the Reporter has approved LDP2.
Lambhill: Application 17/01227/FLL Change of use of agricultural shed to general storage and distribution, was refused and the applicant has made an appeal against this decision. The reporter carried out a site inspection on 11th June. Subsequently the reporter has requested further information from the applicant, and it is expected that a decision will be made shortly.
Application 17/00737/FLL, Siting of static caravan for use as staff accommodation, was refused on 14th June 2017, however PKC have decided not to enforce the breach of this rejected application until the application described above has completed its passage through the appeal process.
Hydro Scheme Fund: TRACKS have investigated the resurrection of the Devon footbridge. CCllr Pye attended the TRACKS Committee meeting on 20th June to hear about the progress. The previous location of the bridge could not be re-used for various reasons: Concern that funders would think it unsafe; need to obtain CARS licence to permit works in the river bed; closeness to 200 year flood level. Consequently a new location has been selected for further design.
The TRACKS committee members pointed out that it was important to establish who would be responsible for ongoing maintenance of the bridge, and it may be necessary for the Hydro Scheme fund to commit to this expense if no other body can be found to maintain it.
CCllr Pye reminded the TRACKS committee that the CC felt that it was important to allow as easy an access as possible to the new bridge, and hence creation of access paths needed to be included in the design and pricing. This was agreed.
The CC hopes that George Lawrie will be able to attend the next meeting of this CC to update us with the plans for the new bridge.
Powmill in Bloom: CCllr Farquhar reported that a mower has been purchased and is being used to mow verges. A disused trailer has been acquired and will be refurbished as a large planter. A solution needs to be developed to ease the problem of watering plants remote from any houses. The village hope to enter the Best Kept Village competition next year.
Crook and Drum Growing Together: CCllr Duffy reported that Crook and Drum Growing Together have entered three competitions this year. Update on results will follow.
Fossoway Gathering: CCllr Duffy reported that at the meeting on 14th June it was decided to hold the gathering on 25th May 2019 as the previously considered date of 22nd June would clash with the Royal Highland Show. The proposed location is Waulkmill Park, but this is not yet confirmed. PKC have agreed that the site could be used, although a formal application to them will need to be made. Consideration of parking, etc., also needs to be resolved. There are a number of enthusiastic people involved, but more are always welcome, and it’s important that all areas of Fossoway are represented.
LDP2: Cllr Barnacle wants Landscape Designations of Rumbling Bridge Gorge and Devon Gorge to be reintroduced, but thought that will probably not happen. The Reporter’s final decision is expected by the end of year.
Crook Moss Travellers Site: Cllr Barnacle wanted a review of PKC’s Gypsy Travellers’ policy, but this doesn’t seem to be likely. Cllr Barnacle has reported the presence of two caravans in the paddock area at Crook Moss to the planners. The Crook Moss residents previously obtained financial assistance from a PKC fund to make their connections to mains services – Some settled residents have recently asked Cllr Barnacle if they can get similar assistance to replace their septic tanks with a mains drainage connection.
Blairingone War Memorial: Cllr Barnacle reported that the owner’s recent planning application (18/00704/FLL) to realign the vehicle entrance was rejected because it didn’t also include Listed Building Consent. Approval of this application is necessary to unlock the developer’s contribution to moving the memorial. There will be a meeting on 9th August between the applicant, highway department, planners and Cllr Barnacle to try and find a compromise planning application that could be approved.
Matters Arising with no update since last meeting:
Ivy Cottage Powmill - No information at present.
New Business:
Roadworks: The planned two week closure of Rumbling Bridge from 20th August for resurfacing work will cause difficulties for local farmers at this time of year – MoP asked if there was any sort of compensation scheme. Cllr Barnacle will investigate.
Powmill Play Park: CCllr Farquhar notes that the park is to be refurbished during the next Financial Year, is there anything else that could be done at the same time? All suggestions are welcomed. CCllr Duffy suggested that the Hydro Scheme Fund might be able to help.
Community Council Business - Meetings Attended
Crook of Devon Commemoration Committee: CCllr Cheape attended a meeting of this committee on 13th June at which it was decided to hold the main anniversary event on the 10th November with the usual Remembrance Day service on the following day. The anniversary event will include an exhibition in the Crook of Devon Village Hall. There was a further meeting on 18th July, details to follow. Cllr Barnacle attended a meeting of Cleish CC and their village will take part in the Commemoration event too. Anybody who has information about anyone included on any of the memorials should let the committee know so it can be included in the exhibition.
Sports Hub: CCllr Farquhar reported that there has been no face-to-face meeting in the last two months; however email communication included news that the 5k run is up and running, and that there are plans to upgrade the existing Skate Park in Kinross along with raising its profile in the community.

Mike Barnacle: The new 40mph speed limit on the B9097, eastwards from its junction with the A977, which was recommended by the Action Plan, came into force on the 4th August.

Correspondence - All correspondence was available for viewing:
The B9097 from the A977 to East Coldrain will be closed for five weeks from 11th September. A consultation on imposing waiting restrictions at Waulkmill in Crook of Devon is taking place. The U241 from the A977 to the B9097 will be closed for five days from 7th September.
AOCB: MoP reported that the quarry at Powmill is full of litter, remnants of fires, etc. It was suggested that this might be as a result of new restrictions displacing visitors from Loch Lomond. Cllr Barnacle said that is an Environmental Health issue, and he’ll get PKC’s department to investigate. There was some doubt amongst those present about who owns the land, does it need to be fenced? Another MoP noted that visitor’s cars parked nearby are also causing problems.
CCllr Duffy asked Cllr Barnacle about the bump in the road outside the pub in Crook of Devon. Cllr Barnacle replied that it was left over from BT work, but it is now too late to get their contractor to return and fix it. Consequently it will now need to be fixed by PKC’s Highway Department, but unfortunately not until the budget is available in the next Financial Year.
