Draft Minutes Fossoway and District Community Council
6th September 2016, Fossoway Primary School
Attending: Community Cllrs: Angus Cheape, Trudy Duffy and Graham Kilby; Cllrs Dave Cuthbert, Joe Giacopazzi and Willie Robertson; 10 Members of the Public (MoP).
Apologies: CCllr Graham Pye; Cllr Mike Barnacle.
Declarations of Interest: CCllr Duffy declared an interest in planning application 16/01352/FLL. CCllr Cheape declared an interest in planning application 16/01373/PN.
Police report: Unfortunately no Officer was able to be present at the meeting. There was one incident to note, received via Perth and Kinross Community Watch, which was the theft of a number of copper reels from Bankhead Farm, Fossoway between 23rd August and 26th August.
Minutes of the previous meeting: The minutes were signed off without amendment.
Matters Arising
A977 Defects and Mitigation Measures: Work has been done to repair the road between Crook of Devon and Balado. Ongoing is the work between Rumbling Bridge and Crook of Devon, an earlier repair there left the road with patches that were too high. This now has to be scraped off and redone. Cllr Cuthbert reports that mitigation measures continue to be worked on, which will include gateway features for all the villages, and that there is money in the budget for this to go ahead.
Rumbling Bridge Hydro Scheme: The Community Benefit Group have had initial meetings and sent the following resolution to the Community Council:
A community group shall be established for the purpose of disbursing any income received from the Rumbling Bridge Hydro Scheme and any other income received from similar sources for the communities covered by Fossoway and District Community Council.
The community group shall be a subsidiary group of the Community Council appointed by Fossoway and District Community Council. The group shall remain in existence indefinitely or for the period determined by the Community Council.
The initial membership of the sub-group shall comprise of:
Independent Chairperson: John Wheatley
Community Councillor: to be nominated by the Community Council
Members: number to be determined by the Community Council
The members of the sub-group, with the exception of the Chairperson and the Community Councillor, will all stand down after six months or whenever the Community Council finds this appropriate. A review of the membership shall then take place to ensure diversity and representation from all parts of the community. Existing members will be eligible for re-appointment.
The initial group will be responsible for carrying out the community engagement exercise and for preparing the draft terms of reference, operating procedures etc., for approval by the Community Council.
The resolution was unanimously approved by the CCllrs present. The currently assembled group will initially concentrate on creating policies and procedures for the group to follow, and then it may be appropriate to repopulate the group with members who are representative of the wider community.
Approval for connection to the grid is expected by 9th September and there are plans for an opening event around 28th/29th October. Cllr Cuthbert advised that that an agreement with a different local group should be made, so in the case of this CC folding, Hydro funds would be transferred to the local group and not to PKC.
Crook and Drum Growing Together: CCllr Duffy reported that the group had been successful with their application for a grant to the Kinross-Shire fund, and an award of £600 has been approved. This will go towards autumn and spring planting. Cllr Cuthbert suggested using a turf cutter when planting bulbs on the green space in the middle of Crook of Devon. Representative of Powmill in Bloom informed the meeting that Powmill had achieved 4th place in the best kept village hamlet and has requested criteria with the aim to improve next year. It was also noted that the Powmill in Bloom group had lost a bench, four various containers, a wheelbarrow, and a bicycle. Despite the disappointment of these items being taken, they are determined to carry on and looking to recruit new members.
Dunning Glen: CCllr Duffy had contacted Cllr Robertson with her concerns regarding the bridge at Dunning Glen, as there appeared to be further damage to the wall of the northern part of the bridge, and more parapet stones missing. Cllr Robertson has reported this to both the Police and PKC. PKC advised the use of motion sensor cameras but highlighted that these maybe stolen. The bridge structure is safe and work will be carried out to repair the bridge in due course. This cannot go ahead until late spring as due to it being a historic building only lime mortar can be used and this will not set in colder temperatures.
Sports Hub: There was a meeting of the Hub on August 11th, where the launch event was discussed and finalised. The hub will be officially launched on 17th September at Kinross Community Campus. CCllr Kilby reminded the meeting that there was a consultation survey in progress and this could be completed on line. (http://pkc.KCSH.sgizmo.com/s3/) Fossoway CC has links to this on their Facebook page and there are also paper copies if required. Cllr Barnacle has also requested a meeting for various local sports and community groups within Fossoway, with the view of setting up a sub group to the larger Sports Hub and to look how the sports field in Crook of Devon can be best used. This is to take place on 21st September at Crook of Devon Village Hall.
Matters Arising With No Update Since Last Meeting
Safer Route to School – Drum; Ivy Cottage, Powmill; Station Road Adoption; Travellers Site: No update.
Bollards Opposite Crook Village Hall: Awaiting a report from PKC Roads Department on how the safety of this section of road could be improved. Cllr Giacopazzi will attempt to get a report for the next meeting.
Blairingone War Memorial: Awaiting report from Cllr Barnacle regarding second opinion.
New Business
Soul Survivor: This event was recently held at Lendrick Muir and although some neighbours were notified, the music from the event was heard over a wide area. CCllr Duffy asked if an entertainment licence would be required for such an event. Cllr Cuthbert advised that for the reported size of the event a licence would be required; however Lendrick Muir may have this in place to cover any events held there.
Naemoor Road-Path to School: A MoP reported (via Facebook) that this path had become seriously overgrown. CCllr Kilby passed this on to local members, and Cllr Cuthbert raised the issue with PKC. It has been reported that this has been dealt with.
Dog Waste: MoP had contacted CCllr Duffy highlighting issues with dog waste not be cleared away by some dog owners. This was confirmed at the meeting by other MoPs who were dismayed that some would bag the dog waste then leave it hanging on trees and fences. It was suggested to form a ‘poop patrol’ however due to lack of members on the CC CCllr Duffy felt this would not be achievable at this time. A reminder to be responsible will be added to the CC Facebook page.
DRT: CCllr Duffy provided updated DRT booklets as there have been recent changes to bus timetables and the area covered by DRT has increased slightly. It was noted that service 23 is now running three hourly having previously been two hourly.
Community Council Business
Meetings Attended: CCllr Kilby attended the Sports Hub (see above) on August 11th; CCllr Duffy attended the Hydro Scheme Meeting (See above.); CCllr Cheape attended the Kinross-Shire fund meeting where awards for Crook and Drum Growing together, and Fossoway Pre-School Group were agreed.
Councillors’ Reports
Dave Cuthbert: Nothing not already reported above.
Joe Giacopazzi: Cllr Giacopazzi confirmed that he was making enquiries into the dip in the road by Devonshaw Cottage, Powmill, which is resulting in HGVs being taken towards the cottage, and why the vehicle activated sign in the same location is still not working.
Willie Robertson: Cllr Robertson informed the meeting about the Community Planning Action Partnership for the Almond and Earn ward. This will involve the Police, Fire service, health, PKC and Community Councils. Cllr Cuthbert has arranged a meeting on the 27th September for all the Kinross-Shire Community Councils to address inequality and local issues such as rural transport.
Planning Matters
CCllr Duffy sought to clarify the position of the CC regarding which planning applications the CC would comment on due to the current shortage of CC members, and the role of the CC in regards to planning. For example if it’s an extension to an existing property then the CC will not be seeking to make any comments. However if the application is for major, larger, contentious applications, or where conditions are set and have not been met, the CC may wish to comment if appropriate. Applications will be considered on merits.

AOCB:
Carnbo Speeding: A MoP highlighted their concerns regarding speeding vehicles travelling through Carnbo with pets are being killed. A speed survey was carried out around 10 years ago where the average speed was found to be 52 mph, she feels this has now increased. Speed signs are obscured from overgrown hedges and hedges beyond the village towards Clackmannanshire are in need of cutting back to provide adequate vision when exiting side roads and drive ways. It was also suggested that Carnbo should have a village gateway as well as the villages along the A977. Cllr Robertson acknowledged more enforcement is required and has recently written to the new Chief Constable asking him to consider the re-introduction of the Community Speed Watch Scheme. Cllrs and the CC are to write to PKC to request the monitoring of speeds through Carnbo takes place.
Electricity: CCllr provided information regarding who to contact when there are power cuts. There is one central number 105 that can be dialled and your call will be directed to the relevant supplier.
Safety Barriers: MoP asked why the safety barriers were still in place opposite the village hall where a car had previously hit the wall some weeks ago. The wall has now been repaired but the barriers remain and are causing a visual obstruction when exiting Station Road. Cllr Robertson will chase this up.
