						 <h1><span>Fossoway and District Community Council</span></h1> <p><strong>Minutes of Meeting, Moubray Hall, Powmill, Tuesday 10th January 2012 (postponed from 3rd)</strong></p> <p><strong>1. Attending:</strong> S Morrison, T Wigman-Duffy, A Lavery, K Bothwick, S Anderson, 3 Members of the public.<br /> <strong>Apologies:</strong> R Paterson, A Cheape, Cllr. M Barnacle, Cllr K. Baird, Cllr W. Robertson.</p> <p><strong>2. Declarations of interest:</strong> There were no declarations of interest.</p> <p><strong>3. Community Policing:</strong> Constable Sadie Allan attended.</p> <p>No reported crime in our local area. Attempted housebreaking in Kinross area, recommend that people take extra care and report any suspicious activity.</p> <p>The fire raising incidents in Kinross are still under investigation.</p> <p>Tanker collision in Drum (near Blue Cedars) – investigations continue, householders concerned about pollution should contact SEPA or Scottish Water. Fossoway and District Community Council would like to extend their sympathy to the family of the lorry driver who was killed in this accident.</p> <p>MoP asked about speeding in Carnbo, no information available, but will be brought to attention of the local officers.</p> <p><strong>4. Minutes of the last meeting:</strong> The Church had completed the plans for the Car Park. The minutes will be amended accordingly.</p> <p><strong>5. Matters Arising</strong><br /> <strong>a. War Memorial, Blairingone:</strong> S Anderson reports that John McCrone is away until the end of January.<br /> Action: Sheila to follow up</p> <p><strong>b. Olympic Flame through Crook of Devon:</strong> Trudy has contacted the Community Police, but they don’t currently have any details, also contacted Primary school.<br /> Action: Trudy to follow up</p> <p><strong>c. Community Speed Watch Programme:</strong> Trudy reports we have been invited to take part in a pilot programme. Volunteers will be trained by Tayside police to do speed checks and report offenders for possible further action. Trudy has advertised this widely and already ten volunteers have come forward. Plan is to cover Crook of Devon and possibly other areas later. Initial meeting this Sunday with the police at the Church Hall.<br /> Action: Rod and Trudy to follow up</p> <p><strong>d. Devon Lade:</strong> Trudy contacted SEPA who told us that the landowner is responsible for clearing obstruction. Sandy reports that part of a retaining wall has collapsed, but machine access is very difficult, requiring some tree trimming and the lade to be fairly dry. Landowner has requested assistance in trimming branches, etc., but is planning to do work when feasible.<br /> Action: Sandy to follow up, volunteers requested</p> <p><strong>e. Church Car Park:</strong> Sandy reports that the legal implications are being processed, and funding being sought, by the Church. Although the CC is not the lead, it may need to lead on funding.<br /> Action: Sandy to follow up</p> <p><strong>6. Community Council Business:</strong> CC will be attending the Kinross-shire Community Council Network (this is an information exchange network and not an executive body.) 18 January (Sandy and Alastair)</p> <p><strong>7. Other meetings:</strong> T-in-the Park community Liaison 24 January(Kevin and Trudy), Dunning Glen meeting 7 February (Sandy, Kevin and Trudy).</p> <p><strong>8. PKC Business, Councillor’s Report:</strong> No councillors were present at the meeting; however Trudy has a report from Cllr Barnacle that the local plan has been approved to include 80 houses in Powmill.</p> <p><strong>9. 						 <h2><span>Community Speed Trap</span></h2> <div class="image-container floatleft"><img src="http://farm1.staticflickr.com/18/22782885_61e83db851_d.jpg" alt="22782885_61e83db851_d.jpg" class="image" /></div> <p>Fossoway and District Community Council have been offered the unique opportunity to take part in a pilot project by Tayside Police: ‘Community Speed Watch’. A group of approx. 10 volunteers will be vetted and trained by Tayside Police to carry out <em>speed checks</em>. The start date is in <strong>March</strong> and the duration of the pilot is <strong>three months</strong>. It will be accompanied by a media campaign, which can only be beneficial for our village.<br /> We will need a group of 10 volunteers. Checks will be carried out on different times and days, so anyone can volunteer.</p> <p>This is a unique opportunity to make a real difference to our village. We all have seen the road getting busier and busier and I know many of you are worried about the speed of the traffic through our village. Please consider giving up a little time to support this initiative. 						 <p>Fossoway and District Community Council<br /> Minutes of Meeting, Fossoway Primary School, Tuesday 6th December 2011</p> <p><strong>1. Attending:</strong> S Morrison, T Wigman-Duffy, A Lavery, K Bothwick, R Paterson. Cllr. M Barnacle<br /> S Anderson has been co-opted onto the committee.<br /> 10 Members of the public<br /> <strong>Apologies:</strong> A Cheape.</p> <p><strong>2. Declarations of interest:</strong> There were no declarations of interest.</p> <p><strong>3. Community Policing:</strong> Euan Mitchell attended.<br /> There has been little reported crime in the area apart from a road traffic offence dealt with recently. Tayside Police are beginning their yearly drink-driving campaign for Christmas and New Year. They are also highlighting the need for safety measures in winter driving conditions. There is a “winter watch” strategy whereby people can help neighbours in times of severe weather.<br /> Action: Trudy to put Winter Watch on the Fossoway Website</p> <p><strong>4. Minutes of the last meeting:</strong> The CC knew about the 20mph limit at Crook of Devon School and the minutes would be amended to reflect this.</p> <p><strong>5. Olympic Flame:</strong> The Olympic Flame comes through Crook of Devon, 13th June 2012 and there was discussion as to whether the CC should be involved. There are no notices from the council as yet. Mike Barnacle will find out if there is any guidance and report back.<br /> Action: Mike to contact PKC, Trudy to contact Tayside Police and Fossoway Primary</p> <p><strong>6. Matters Arising</strong></p> <p><strong>a. War Memorial, Blairingone:</strong> Sheila Anderson has agreed to take this forward and contact John McCrone from the council and the previous sub-group in order to begin the planning application process.<br /> <strong>Action: Sheila to contact sub group to start process</strong></p> <p><strong>b. Dunning Glen:</strong> 1.7 tonnes of rubbish were removed in the clean-up and a large sign will be erected warning people to keep the area free of rubbish, or penalties will be imposed. The CC were congratulated on their campaign and Kevin Bothwick was thanked for all his hard work to resolve this issue.<br /> Action: Kevin will oversee the erection of the sign and we will attend the multi-agency meeting next year.</p> <p><strong>7. Traffic Issues:</strong> Tayside Police are beginning an experimental ‘Community Speed watch” programme and are looking for volunteers to help to monitor speeding. Rod Paterson will liaise with Trudy to take this forward.<br /> There is to be a 30mph speed limit on the A823, several roads around Kinross will have a 40mph limit and traffic calming measures to be put in place on the A977. The positioning of the VAS location was discussed as it is thought that it is too far away from the school road entrance. A barrier along the pavement in the village was requested by Victoria Sutherland, as children sometimes walk in groups along the road on the corner between the shop and the school. A barrier might discourage children wandering dangerously into the road. The bus stop at Drum was also causing concern as there is little space for the children to wait. Mike Barnacle and the CC will take these matters forward.<br /> Action: Rod and Trudy to take forward the ‘Community Speed Watch’ initiative. The CC to write in favour of the latest traffic calming measures and the barrier along the bend.</p> <p><strong>8. Ken Thomson Homes:</strong> Ken Thomson addressed the meeting with further information on the proposed development in Rumbling Bridge. He had held a public consultation meeting in November. Ken Thomson was questioned as to why he had not delivered leaflets to publicise the event as he had said he would. Some residents had only found out about the meeting from Mike Barnacle. Ken Thomson said he placed a notice in the Courier. Concerns were raised at the meeting regarding the density of housing, and he has reduced the planned 30 houses to 24.<br /> At the CC meeting, some members of the public raised concerns over the proposed 6 houses for older people. They felt that Rumbling Bridge offered no amenities, such as regular buses or nearby shops.<br /> A planning application will be lodged in the New Year.</p> <p><strong>9. Community Council Business:</strong> A Cheape attended a Kinross-shire Fund meeting on 12th December and will report back in January.</p> <p><strong>10. PKC Business, Councillor’s Report:</strong> Mike Barnacle said that there would be a sign at the Blairingone/Muirhead road end to indicate Tethyknowe and Muirhead. The flooding further down that road would also be seen to in January/February. He has been involved with a speed limit review but has had no response to his communication with Darrell McEwan yet. There will be a CC network meeting 18th January 7.00pm at the Kinross Campus. There has been a request for increased capacity for “T in the Park” for the Friday. 20,000 more tickets to be sold. Mike’s meeting with Nick Brian on planning matters was postponed. There has been council briefing on the emerging local plan. In the landward area there are plans for 30 houses in Scotlandwell, 120 houses in Powmill and none in Crook of Devon.</p> <p><strong>11. Planning Applications</strong><br /> 11/01839/FLL. Cairnfold Farm Blairingone. Erection of an indoor horse arena building for equestrian business and erection of a dwellinghouse and garage.<br /> An objection has been lodged by the Community Council following an email consultation.</p> <p>11/01854/FLL. Former Farm Steadings Claysike Fossoway. Proposed amendment to house type (plot 3). Former Farm Steadings Claysike Fossoway.<br /> Recommendation. No Community Council comment</p> <p>11/01973/FLL. Blairingone Sewage Works Blairingone. Upgrading of Blairingone waste water treatment works, installation of lights and boundary fencing.<br /> Recommendation. No Community Council comment</p> <p><strong>12. General Correspondence:</strong> All outgoing and incoming correspondence was available for viewing.</p> <p><strong>13. A.O.C.B:</strong> The Devon Lade in Crook of Devon has been damaged by storms and this may be a problem as a number houses may still use this as an outflow for their septic tanks. The CC will look into it. The Post Box in Carnbo has been removed for maintenance which is particularly unhelpful before Christmas. 						 <div class="image-container floatleft"><img src="http://www.fossoway.org/local--files/forum:thread/winterwatch.bmp" alt="winterwatch.bmp" class="image" /></div> <p>I was sent some information about <strong>Winter Watch</strong> earlier this week and would like to spread the word around Fossoway, and beyond, of the benefits that it brings.</p> <p>With the cold weather setting in, it seems like a good time to remind everyone to watch out for their neighbours, who might appreciate a helping hand to deal with the challenges that a Scottish Winter can bring.</p> <h2><span>What Is Winter Watch?</span></h2> <p>Winter watch is a new scheme, run by <strong>Voluntary Action Perthshire</strong>, which is designed to put helpers in touch with those needing a bit of a hand to deal with wintry conditions.</p> <p>The scheme is looking for volunteers who are willing to help people in the community who need extra support during the winter months. 						 <p><strong>HELP!</strong></p> <p>The Institute urgently requires VOLUNTEERS from the COMMUNITY to join the COMMITTEE.</p> <p>The Institute is a community asset which is owned and operated by the community.</p> <p>The forthcoming AGM is on Wednesday 23 November at 7.30pm.</p> <p>A number of the existing committee members are resigning at the AGM which will mean there will be requirement for new people to be committee members and fill some positions such as Treasurer. 						 <h1><span>Minutes of Meeting</span></h1> <p><strong>Blairingone School, 1st November 2011, 7.30pm</strong></p> <p>1. <strong>Attending:</strong> A Lavery, S Anderson, M Anness, K Borthwick, A Cheape, R Cooper, Cllr. M Barnacle.</p> <p>21 Members of the public</p> <p><strong>Apologies:</strong> S Morrison, T Wigman-Duffy, W. Robertson</p> <p>In Sandy’s absence Alastair chaired the meeting.</p> <p>2. <strong>Declarations of interest:</strong> There were no declarations of interest.</p> <p>3. <strong>Community Policing</strong> - The police officer warned the meeting that theft of farm equipment had been reported, and that extra vigilance was needed. Farm gates, horse equipment, machinery had been stolen recently. Access roads to farms should be locked if at all possible. There was also a problem in the area with the theft of drain covers.<br /> The Police have launched a “Keep safe in Autumn” campaign.</p> <p>4. <strong>Minutes of the last meeting</strong> – The minutes were signed off without amendments.</p> <p>5. <strong>Matters Arising:</strong></p> <p><strong>War Memorial, Blairingone</strong> -Trudy has emailed the War Memorial Commission but has had no reply so far. Removal of the memorial will require a planning application. John McCrone is the council member to contact.<br /> Action: Trudy to follow up. Planning application (who?)</p> <p><strong>Dunning Glen</strong> - A grant has been obtained to fund a “clean-up” and this will take place 15th November.</p> <p><strong>Seamab</strong> -Trudy has raised the matter of children from SEAMAB climbing on neighbours’ roofs with the Police Community Officer.</p> <p><strong>Pollution of the River Devon</strong> - PKC would like to take the up the CC’s offer of talking about an early warning system, and have suggested a meeting. Kevin and Trudy will attend. Clackmannanshire Council issued a warning of pollution (which is down- stream from PKC) and Crook of Devon received no warnings at all. Scottish Water won’t comment because of the investigation into the incident.<br /> Action: Trudy and Kevin to organise a meeting and report back.</p> <p>6. <strong>Ken Thomson Homes</strong> - Ken Thomson Homes gave a presentation showing the proposed development of 31 homes in Rumbling Bridge. This is on the Braehead Farm site. The development is to be sustainable, containing eco- friendly houses built to gold standard, with heat pumps and photovoltaic panels. There are 6 affordable homes planned aimed at the restricted mobility market. There is a public consultation meeting on 17th November 12 – 8&#160;pm in Moubray Hall, Powmill. Everyone is welcome. More details on the Fossoway website. Ken Thomson will organise a leaflet drop in Rumbling Bridge to publicise the event. Mike Barnacle stated that the development was contrary to the local plan and the emerging plan. Rumbling Bridge was not one of the options in the PKC plan. The local plan is still the guiding influence until 2014.<br /> Ken Thomson was thanked for his presentation.</p> <p>7. <strong>Community Council Business</strong> – From next month onwards there will be a new CC. Marion and Ramsay are stepping down and were thanked for their contribution. Sandy, Alastair, Kevin, Trudy and Rod Paterson have been nominated and thus elected unopposed. The CC may co-opt some members who have been unable to get their nominations in on time. A meeting should be held within 28 days from 3rd November to announce the results of the election and appoint a chairperson.<br /> Action: Extra-ordinary general meeting to be called. (Mike)</p> <p>8. <strong>PKC Business, Councillor’s Report</strong> – Mike Barnacle announced that a meeting of the Kinross network of CCs would take place on 18th January at the Campus. This will create a forum for CCs with common interests in the area.<br /> Some councillors have had a planning meeting with David Littlejohn to discuss procedure. He took on board the concerns of the councillors. The emerging plan and the work on the local strategy groups formed part of the discussion. There will be a further meeting on 7th December to discuss what’s in the local plan.</p> <p>9. <strong>Planning Applications</strong> -</p> <p><strong>11/01604/FLL</strong>. Also hedges overhanging roads. There was also a question raised regarding having adequate road-salt supplies for the winter.<br /> There will be “T in the Park” meeting 16th November, Windlestrae Hotel, Kinross.<br /> The CC wasn’t informed about the removal of the 20mph limit at Fossoway School. The main points were the break in at the school with laptops and various other items stolen, incidents of vandalism and an accident at the crossing at the hall which is under investigation.<br /> A scam letter involving a Chinese bank was highlighted. The Sports for All on Saturday 8 October in Crook of Devon public park between 6 and 8&#160;pm was highlighted. It was pointed out that it would be dark at that time.<br /> A member of the public raised a problem regarding runaways from Seamab with children being on people’s roofs and throwing stones at the school building. He was advised to contact the Community Police Officer at the time of any incident. The Secretary will report the matter to the Community Police Officer.<br /> Action: Trudy Duffy-Wigman</p> <p>Minutes of the meeting of 6 September were signed off without amendments</p> <h2><span>Matters Arising</span></h2> <h3><span>Blairingone Play Park Refurbishment</span></h3> <p>Action: revisit in December.</p> <h3><span>Blairingone War Memorial</span></h3> <p><strong>Action</strong>: Trudy Duffy-Wigman to contact War Memorial Commission. Community to raise money for the fee for planning application.</p> <h3><span><a href="http://www.fossoway.org/gallery:dunning-glen-problems" target="_blank">Dunning Glen</a></span></h3> <p>An article appeared in the Courier about <a href="http://www.fossoway.org/forum/t-369639/dunning-glen-wild-camping-mess:community-groups-work-togethe#post-1190892" target="_blank">Dunning Glen</a>, which resulted in a BBC interview with Kevin and Trudy on site. The emphasis was to re-look at the access code. An issue re Carnbo was raised and will be dealt with locally.<br /> <strong>Action</strong>: Alistair Lavery</p> <h3><span>Carnbo Bus Shelter</span></h3> <p>Branches have been cut back.</p> <h3><span>Hedge Cutting</span></h3> <p>The hedge opposite Fossoway School has still not been cut. Local landowner has been contacted. The Council will not cut hedges in summer unless they are a hazard because of wildlife.</p> <p>Jenny Cruick from the Forestry Commission gave a presentation regarding future plans for access to the forest area. Two maps were circulated. The commission was currently negotiating with two landowners re access and had considerable plans for further access. There was also some discussion re tree planting and she confirmed it would be conifers and broadleaf.<br /> <strong>Action</strong>: Marion to monitor progress</p> <h3><span><a href="http://www.fossoway.org/forum/t-388935/fossoway-community-council#post-1273249" target="_blank">East Coast 400KV Reinforcement Project</a></span></h3> <p>Councillor Mike Barnacle has written to SSE.</p> <h2><span>CC Business</span></h2> <h3><span>Elections</span></h3> <p>Five nominations had been received for Fossoway - Sandy, Trudy, Alistair, Kevin and Rod Paterson. It was understood that Sheila and Angus were willing to continue but were on holiday when the forms were issued and therefore could not sign them. They can both be co-opted. The Chair requested volunteers for the remaining vacancy. He thanked Marion and Ramsay for their contributions to date and regretted that they were unable to continue as CC members.</p> <h3><span>Kinross-shire Forum</span></h3> <p>Alistair, Kevin and Sandy had attended a meeting arranged by Mike to re-constitute the Forum. The meeting had been attended by Councillor Baird and all Kinross-shire CCs apart from Glenfarg.</p> <p>The meeting agreed that it would be useful to explore the formation of a Kinross-shire Community Council Network for the prupose of exchanging information, discussing best practice, providing mutual help and assistance to CCs and when necessary co-ordinating actions by CCs for the benefit of Kinross-shire. It would be a discussion network not an executive or decision making body. The meetings would include representatives from all Kinross-shire CCs and ward Councillors. Glenfarg CC would be invited to re-consider its position.</p> <p>The KCCN is approved of by PKC and room hire for 2 meetings a year will be paid for by PKC. A further meeting to progress the matter will be held in January 2012. The CC recommended that Fossoway should take part and this was agreed.<br /> <a name="Crook-Development"></a></p> <div style="background-color:#DAFAC5; padding: 0.5em 1.5em;"> <p>Sandy would be attending a Planning Users’ Forum at Pullar House tomorrow. He stated that he understood the planners were recommending a <a href="http://www.fossoway.org/strategy:crookofdevon" target="_blank">major development in Crook of Devon at the Deer Farm</a> which was at total variance with what the community wanted and had made clear through a petition and submission by the CC regarding the Local Development Plan. He did not expect the Councillors to comment as this matter was not yet in the public domain.</p> <p>There was considerable discussion and comment from all present. It was felt that the developer involved in Crook of Devon had never engaged with the community. The meeting authorised Sandy to raise the matter at the Users’ Forum and express extreme disappointment and <a href="http://www.fossoway.org/forum/t-204280/businessman-calls-for-changes-at-the-top-of-perth-kinross-co" target="_blank">lack of faith in the consultation process</a> if the information he had obtained was correct. It was generally felt that <strong>consultation by Fossoway CC with the planners was fruitless and was not listened to</strong>. There was considerable scepticism that the next 12 week period of consultation would have any effect. He was also asked to raise the matter of how Areas of Great Landscape value were being dealt with in the new process.</p> </div> <h2><span>Councillors’ Reports</span></h2> <p>Mike had written a number of letters on the following issues: East Coast 400KV, Play Park, speed limit Rumbling Bridge, roads, signage etc. He congratulated Crook of Devon for coming second in the Best Kept Village Competition. Local Councillors were having a meeting with the Head of Planning next week.</p> <p>Willie reported the builders yard at Simon Wilson Homes would be moved by spring 2012.</p> <h2><span>Planning Matters September 2011</span></h2> <p><strong>11/01584/FLL</strong> Balhousie, Rumbling Bridge Care Home, Rumbling Bridge, Kinross KY130XP. It was all available for viewing.</p> <h2><span>AOCB</span></h2> <p>The representative from TRACKS reported that work had stopped on the old railway line at Crook of Devon due to lack of funding but it was hoped further funding could be obtained. The final part of the heritage track round Loch Leven was to be officially opened on 31 October.</p> <h3><span>Street Name Carnbo</span></h3> <p>After considerable discussion it was felt that the most appropriate name was Pitcairnie Lane.</p> <h3><span>Loop Road U222</span></h3> <p>The Chair stated that there were forms for people to sign if they wished regarding the loop road. The intention was to try and have the road designated as unsuitable for HGVs apart from those involved in local business such as farmers, G M Baird’s fish haulage and local access. He was concerned to have something in place before the quarry at Glenquay was developed. In recent weeks Tayside Police has received a number of complaint, or intelligence reports in relation to people – sometimes elderly and vulnerable residents – being called or emailed by people claiming to be from banks, financial institutions, government bodies and even lottery operators with promises of ready cash. However, an upfront fee is invariably requested to allow the main transaction to take place.</p> <p>In many instances the householder has been advised to make a payment using Ukash. This involved buying a Ukash voucher and then providing the cold caller with the voucher’s serial number. Ukash provide a warning on their website about bogus callers, see www.ukash.com for more information.<br /> Action Fraud provides a great deal of advice in relation to all types of fraud and advice about how to avoid becoming a victim of the fraudster. For further information see – www.actionfraud.org.uk<br /> Recent crimes/issues in the area:<br /> 30/08/11 – Fossoway primary school – vandalism – under enquiry<br /> 30/08/11 – Powmill Milk Bar – vandalism – under enquiry<br /> 03/08/11 – Gartwhinzean, Powmill – Vandalism to motor car – Under enquiry</p> <p><strong>Street Sports 4 All in Kinross</strong><br /> &nbsp;Tayside Police Community Officers&nbsp;in&nbsp; Kinross and Bridge of Earn have&nbsp;arranged to set up ‘Street Sports 4 All’&nbsp;during July and August&nbsp;in a bid to keep young people occupied, active, and divert them away from engaging in antisocial behaviour. The sessions are free and open to all school age children in the area. Places do not need to be booked.<br /> &nbsp;<br /> Saturday 10th September 2011 – held at Poakmoak funday at Scotlandwell between 1400-1600 hours (All welcome)<br /> Saturday 8th October 2011 – Public park at Crook of Devon between 1900-2100 hours (all welcome)</p> <p>Minutes of the meeting in August were signed off without amendments.</p> <p><strong>Matters arising:</strong></p> <p><strong><a href="http://www.fossoway.org/strategy:blairingone">Blairingone</a> Play Park refurbishment</strong><br /> Good turn-out on the fun/ consultation day. There is money to take this forward although the community will have to raise funds as well. Main problem is the location: the site is owned by Lt Col Stewart, who leases it out to PKC. Lt Col Stewart has the intention of developing his land (including the land where the play park currently is) for housing and is awaiting the Main Issues Report to see whether he will be able to put in a formal planning application in for his development. If that is the case, the play park would be relocated to a site with other amenities, such as a football pitch, a site including car parking for a village hall etc. If this transpires, it would be unwise to refurbish the play park at the current location. On the other hand, putting it all on hold would mean we would lose the momentum. Thanks to Lt Col Stewart for providing information about the site.<br /> Action: revisit in December, when the MIR is out; Marion to talk to parents in Primary School and see whether a committee could be set up. Trudy to inform Steven Kane.</p> <p><strong>Blairingone War Memorial</strong><br /> Meeting on Tuesday 30 August on-site with three PKC officials, the developers, Mike Barnacle, Marion Anness and Trudy Duffy – Wigman. Outcome was very positive: developer will re-site memorial to preferred site behind the church and built a plinth. Nice site for a memorial; PKC may develop surroundings with flowers and a bench. The developer will be granted access to and around the church, although the church grounds cannot be sold. CC will have to apply for planning permission (listed building)- but CC has no money for the costs involved. Are we sure all the relatives are happy enough with re-location of memorial? Last living relative in the area is happy enough. We will publicise process in the newsletter, notice boards and on the websites, allowing for a period for comments from relatives before going through the planning application process.<br /> Action: Trudy to phone War Memorial Commission. Publicise intentions before proceding with planning application.</p> <p><strong><a href="http://www.fossoway.org/forum/t-369639/dunning-glen-wild-camping-mess:community-groups-work-togethe">Dunning Glen</a></strong><br /> Full go-ahead to do the clean-up. Will be end of October, when the vegetation starts to die down. The clean-up is funded by a grant from PKC. The bunding put in place by PKC does not seem to have made a difference. We will also continue to take part in multi-agency meetings to keep managing the problem, as well as approaching MSPs for more fundamental solutions.<br /> Action: go ahead in October/ November and monitor the situation.</p> <p><strong>Pollution in the River Devon</strong><br /> These incidents are under investigation and may result in some prosecution of Scottish Water. The CC is unhappy with the actions PKC has taken to warn those affected by the spills. A letter to K. Steven (PKC) has been sent to that effect. We will follow this up once the report is finished. With thanks to Angela Heidemann for alerting many neighbours.<br /> Action: await PKC response.</p> <p><strong>Verge cutting</strong><br /> See Kathleen Baird’s report in the newsletter. Some verges have been cut twice, despite PKC saying only one cut was provided for. CC still unhappy with road-ends cutting.</p> <p><strong><a href="http://www.fossoway.org/forum/t-310087/proposed-lambhill-development-combined-heat-and-power-plant">Biomass plant</a></strong><br /> CC does not know what is happening or who owns the site at the moment. Gates are closed, prohibiting access to walks.<br /> Action: Marion to contact Forestry Commission to clarify.</p> <p><strong>Church Car Park <a href="http://www.fossoway.org/strategy:crookofdevon">Crook of Devon</a></strong><br /> Technicians have now measured up. PKC will prepare plan to be sent to the Church. The Church then has to mark up the plan and apply for planning permission (change of use). The car park surface would be the same as the existing path. Notices would be erected prohibiting overnight parking. The whole process of obtaining change of use was unlikely to be completed before the end of the year. Church has also put in spaces for disabled people near the entrance of the church and asks the community to respect those spaces.<br /> Action: await return of outline plan</p> <p><strong>CC Business</strong><br /> Elections for all the CCs now on the same day and are organised by PKC. Nomination forms available from half September; have to be in by 29 September for election in November. There will be a postal vote but the exact procedure is yet unclear. Community Policing – A report has been sent in advance in case police presence at this meeting can’t happen for operational reasons. New Community Officer is Victoria Riches. Issues mentioned:</p> <p>Between 11/7 &amp; 13/7 – Theft of construction and plant equipment from Lambhill farm, Rumbling Bridge – under enquiry.<br /> Between 27/06 &amp; 30/06 – Theft of construction and plant equipment from a plot of land formally known as Craigend farm, Powmill – under enquiry.<br /> 20/6 – Theft of construction and plant equipment from building plot at Back Crook, Crook of Devon – under enquiry.<br /> Also, be aware of bogus callers: over the past few weeks Tayside Police has received a large number of complaints, or intelligence reports in relation to people – sometimes elderly and vulnerable residents – being called by people claiming to be from banks, financial institutions, government bodies and even lottery operators with promises of ready cash. This also includes one local resident.</p> <p>4. Minutes of the last meeting – Burnside Wind Farm: Cllr Barnacle said that he had said “The Council had made a landscape assessment and decided that only one farm was appropriate”, but he had not made any comment about financial issues. With this amendment noted, the minutes were signed off.</p> <p>5. T-in-the-Park (T-i-t-P) Debrief – Police thought that it went reasonably well. Seemed to be more traffic than before so more areas were policed to control it. MoP commented that the security guards at the junctions were very helpful in helping local people to get out.</p> <p>Some back roads weren’t grass cut so made it very difficult to pass oncoming traffic. Cllr Baird explained that the contract for grass cutting has changed this year (starting 1st July) and there were some issues so things got behind. There is only going to be one cut per year for budget reasons. Sandy comments that even if there is not enough budget to do all verges, then road ends/junctions need to be done more extensively for road safety reasons. Kevin wonders if T-i-t-P couldn’t do some of this prior to the festival?</p> <p>MoP commented that on consulting a member of PKC to get advice about directions they were given bad advice to use a road that was actually closed.</p> <p>Alastair felt that there was a problem with traffic (especially heavy goods) during set-up (using new entrances) being a bit arrogant – needs to be brought up with Committee. MoP observes that this caused a few problems during morning rush-hour prior to start of festival.</p> <p>Some junctions weren’t properly controlled Thursday night, security not always stopping non-residents. Police observed that there were a lot more resident’s passes handed out than before – it appears that Sands give them out fairly freely – this needs addressing. MoP thinks that more people are using Rumbling Bridge to avoid some of the queues. Perhaps it would make sense to have lights/police officer at A977/Rumbling Bridge junction.</p> <p>Cllr Barnacle observes that issues should be brought up at forum – especially verge cutting. Noise louder this year because site re-oriented to avoid pipeline.</p> <p>Sandy had complaint that the published Police T-i-t-P hot-line just went to Tayside police. A car parked on pavement at Fossoway garage was alleged to be working on behalf of Police, and caused pedestrians difficulty in passing it.</p> <p>6. Spill and Pollution of the River Devon Trudy had received email from A. Heidemann about dead fish in river, and contacted K. Stevens from PKC Environment Department who said that there were ongoing investigations into three unrelated incidents: Castle Hill reservoir turn-over; Acid spill; High amount of Aluminium Sulphate. Trudy asked why people hadn’t been notified, e.g. Scouts from nearby camp swimming in River. Clacks Council has given out a warning but PKC hasn’t. PKC could have given warning via CC.</p> <p>Kevin reported that his angling association contacted SEPA who, as a result, had put up a notice for the attention of the Scouts. It’s not just a question of the dead fish but the long term effects. MoP observed the report in the Dundee Courier was very vague about the location so next to useless.</p> <p>Sandy spoke to Scottish Water and told them we expected someone to come to the CC and explain – this can’t happen until the investigation is complete because of legal position, but they have agreed to do this later on.</p> <p>Cllr Barnacle commented that his first notification was when a reporter asked him about it! Cllr Barnacle got in touch with Scottish Water, SEPA and Tom Brighton at PKC. He asked Tom why he hadn’t heard about it from PKC.</p> <p>7. Matters Arising</p> <p><a href="http://www.fossoway.org/strategy:blairingone">Blairingone</a> Biomass Plant: No planning applications received, rumour that it has been sold back to Oran.</p> <p>War Memorial, <a href="http://www.fossoway.org/strategy:blairingone">Blairingone</a>: Cllr Barnacle reports that John McCrone from PKC emailed him so Cllr Barnacle phoned him – situation is that PKC won’t provide land nor sell land at front of Church to developer because Historic Scotland want to retain control of what’s in front of the listed building. Planner says that developer and council are happy for memorial to stay where it is. This CC , reflecting the community view, wants it moved. Planners say that someone from the community should make a listed building application to get consent to move the memorial, then apply for funds. Cllr Barnacle is still trying to arrange meeting with Council officials, the developers and the <a href="http://www.fossoway.org/strategy:blairingone">Blairingone</a> sub-group, preferably on site to find a solution to this problem. Developer is considering legal action to obtain land to get access to the house. Planners are saying that there isn’t enough community support.</p> <p><a href="http://www.fossoway.org/forum/t-369639/dunning-glen-wild-camping-mess:community-groups-work-togethe">Dunning Glen</a>: Trudy reports that the CC’s press release, including photos, had been published in some local papers. PR also sent to MSPs. Some measures have been taken to prevent parking, but they’re not working.</p> <p>Accessibility Path Around Crook of Devon: Cllr Barnacle mailed Dave Stubbs (Access Officer) and planners about core path between Old Railway Institute and Church. Path is secured by existing planning conditions and hence the current signs are in breach of that. Cllr Barnacle has proposed signs to dissuade horse users by explaining that it’s a footpath and a safe route to School. PKC would agree to self-closing gate but not kissing gate, even though the former would not prevent horses.</p> <p>Church Car Park: Malcolm Hill has been most helpful and is progressing this. It should be completed soon. Note that this will be available to all members of the community not just church users.</p> <p>8. CC Business – Meetings Attended</p> <p>Kevin reports that the Association of Scottish Community Councils is going to be disbanded because funding has been reduced such that they can’t continue. Will take about a year to wind up and arrange alternative insurance currently provided to members.</p> <p>Convention of Perth and Kinross Community Councils: Kevin and Sandy attended, nine attendees out of forty CCs in PKC. Not much happening, no chair, secretary proposes disbandment.</p> <p>PKC have issued CCs with new code of conduct, alignment of financial year, etc. CC Elections to be in November. PKC will now run elections – members are elected for four years. Sandy encourages people to come forward especially from <a href="http://www.fossoway.org/strategy:blairingone">Blairingone</a> which has a lot of issues at the moment. Cllr Barnacle points out that it’s important that people understand CCs are the first stage in the democratic process, especially for planning matters.</p> <p>9. PKC Business, Councillor Barnacle’s Report:<br /> Verge Cutting – contacted Lesley Anne Cassidy, and asked if road safety aspect had been considered. Replies that verge cutting must be tendered, delayed until 5th July. Service provision is the same everywhere, PKC’s standards are being met by the contractor. T-i-t-P area requested too late to do properly.</p> <p>Environment Committee Report in June proposed that one of the Crook of Devon play areas in Fossoway Glebe be closed, Cllr. Barnacle thinks this is acceptable because there is a main play area nearby. Equipment will be removed and reused if appropriate, then area grassed over and maintained. MoP suggests that barriers be erected near main play area to prevent children rushing on to road.</p> <p><a href="http://www.fossoway.org/strategy:blairingone">Blairingone</a> Notice Board – is now refurbished, thanks to John Anderson for doing that.</p> <p>Burnfoot Hill Wind Farm – no planning application yet, Cllr Barnacle will write to Ian Dogood, planning officer at Clacks, suggesting review of wind farms in Ochils as a whole.</p> <p>It seems unreasonable for applications for essential (farm) workers developments to have to pay planning levy.</p> <p>Mike thinks that the Kinross CCs should be talking to each other, at least twice a year, and is happy to facilitate getting a meeting going. What does the CC think? Sandy and Trudy agree that it would be useful, probably previous forum didn’t work because it was trying to cover too large an area.</p> <p>10. MoP suggests a press release like the <a href="http://www.fossoway.org/forum/t-369639/dunning-glen-wild-camping-mess:community-groups-work-togethe">Dunning Glen</a> one.</p> <p>MoP observes that the Kinross Fund will now only give money to “projects” rather than things like normal running costs. Note that T-i-t-P money goes to this fund and they think that they are benefitting the community. Trudy thinks that this has always been the case, although it’s possible that previously the fund was less robust about the definition of a project.</p> <p>MoP: School bus pick-up point at Carnbo has a new shelter and untrimmed grass surrounding it. Whose responsibility is this? Cllr. B will look into this.</p> <p>MoP: Trees overhanging road near school are scratching cars.</p> <p>A91/A977 Loop Road could get special designation for walkers, cyclists, and other non-vehicular use, which would prevent automatic rights of access for HGVs, etc. If community members support this they should contact the CC. You can click on the following link to view photos of the mess created by the <a href="http://www.fossoway.org/gallery:dunning-glen-problems" target="_blank">Dunning Glen Parties</a>.</p> <h1><span>Dunning Glen Wild Camping Mess: Community Groups work together to find solution</span></h1> <div class="image-container floatleft"><a href="http://www.fossoway.org/local--files/forum:new-thread/dunning2.JPG"><img src="http://www.fossoway.org/local--files/forum:new-thread/dunning2-small.JPG" alt="dunning2-small.JPG" class="image" /></a></div> <p>Community groups in the area of the well-known beauty spot of Dunning Glen are increasing their efforts to find a solution to the disruption and the mess created by irresponsible wild campers. The area has always attracted people who enjoyed being outdoors, but the last few years have seen an increase of instances of vandalism and littering.</p> <p>Sandy Morrison, chair of Fossoway Community Council explains that many locals know this beautiful area and have fond memories of days spent alongside the river Devon. ‘Nowadays,’ Sandy says, ‘it seems that large groups of predominantly younger people come out here to drink and to party. They don’t clean up their mess.’ The area is littered with cans, bottles, tent poles and other waste. Fossoway Community Council has successfully applied for a grant from Perth and Kinross Council to tidy up the area and to erect signs asking people to behave responsibly.</p> <p>Litter is not the only problem. Trees and bushes are cut down for firewood. Several times fences or gates are used to burn as well, leaving livestock to escape and creating expensive damage. Local landowners and farmers have joined the initiative to curb this behaviour. ‘We have nothing against the occasional wild camper,’ a landowner explained, ‘but for whole groups to come down the Glen with generators and marquees, bringing large amounts of alcohol is just outrageous. There is also a real risk of fires getting out of control. So far the summer has not been very dry, but we worry when we have a dry period.’</p> <p>Tayside Police is involved in this initiative. Sergeant Williams of Tayside Police is worried about possible criminal behaviour. Recently a car was found abandoned with the windows smashed in. A week later it was set on fire. During repairs on the old bridge damage was done to the scaffolding, and gates and fences have been vandalised. The Police have increased their patrols in this area. Sgt. Williams: ‘We are aware of the ongoing issues in Dunning Glen and have been working closely with our community partners to provide solutions. We are increasing our presence in the area and any person or groups of people found to have committed a crime or offence will be charged and reported to the Procurator Fiscal.’</p> <p>Litter and vandalism is not the only worry. Kevin Borthwick of the Devon Angling Association explains: ‘This part of the river is very sensitive, and needs to be protected. The Glendey Burn is the last spawning tributary for the native brown trout. It flows into the river Devon just above the bridge where all the camping problems are and anything upsetting the natural balance of the river in this area could have a negative effect on the brown trout population.’</p> <p>The cooperation is not limited to Perth and Kinross-shire. Central Police is also involved, as is Muckhart Community Council and Friends of the Ochils. Stuart Dean, Chair of the Friends of the Ochils and Secretary of Muckhart Community Council says: ‘Finding a permanent solution to this problem proves to be difficult. The Scottish Outdoor Access Code promotes responsible behaviour when enjoying the outdoors, but in reality there are few consequences when people behave in an irresponsible manner. Farmers and landowners have little redress and while most of them welcome walkers and campers in the Ochils, there needs to be effective ways to deal with the minority of people who keep littering and vandalising.’</p> <p>Mike Barnacle, Independent Kinross-shire Member of Perth and Kinross Council states: ‘Since the Land Reform (Scotland) Act 2003 was passed, the spirit of which I endorse, it has become clear that there are a number of issues relating to access to land and water that require to be re-examined in the light of experience, not that the Act has been in force for some time. In particular the issue of interpretation of what is meant by wild camping, when large groupings if people are involved and the need for adequate sanctions against those not taking access to private land and water in a responsible manner. I intend to work with the community in seeking that MSPs look again at the access legislation. It should not be necessary to require bye-laws to control such matters.’</p> <p>Whilst it is clear that there is no quick fix for this problem, the community, in co-operation with Perth and Kinross Council, will continue to work together to find and implement solutions. Dunning Glen should be a beauty spot for all to enjoy.</p>

With these amendments noted, the minutes were signed off.</p> <p><strong>5. Presentation by Hugh Wallace:</strong> With the aid of a map showing a plan for a Hydro Scheme on the River Devon, Hugh gave an outline proposal for the development. It covered the main issues, the time frame and the Community benefit.<br /> <strong>Main Issues:</strong> visual impact, the position of the turbine house, the long term impact and the reduced flow of the river.<br /> <strong>Time Frame:</strong> Landowners agreements to be established, loan schemes from the government to be investigated and overall planning to be applied for.<br /> <strong>Community Benefit:</strong> A Community Fund to be set up, the recipients of the fund to be arranged ( CC possibly), and considerations as to the distribution of funds to be agreed.<br /> A discussion was opened to the floor and various issues were raised. How<br /> many landowners were involved,? Had SEPA been involved? Were there any safeguards for wildlife? Was Scottish Water involved? Where would the distribution connection to the grid be sited? What would the environmental impact be? All these questions would be answered by Hugh and he agreed to put all these proposals on the CC website.</p> <p><strong>6. Presentation by Sarah Dooley, Burnside Wind Farm</strong>: Sarah Dooley outlined the plan for an extension to the Burnhill Wind Farm comprising of a maximum of 22 turbines. The site straddles both Clackmannanshire and Perth and Kinross Councils. 9 turbines would be in the Perth and Kinross area. There is potential for expansion on the site with the final turbine layout to be decided by next month and planning submissions would follow. There would be considerable benefits to the community in the form of a trust fund. This particular wind farm was 85% productive as the wind was blowing most of the time. Mike Barnacle commented that the Main Issues Report was concerned with the visual impact of the wind farm and that no one had benefitted financially in the Fossoway CC area, although they were directly affected by the site. Comments from the floor noted the huge profits derived from these developments and wondered how more funds could be made available for the community. The proposals would be put on the CC website.</p> <p><strong>7. Matters Arising:</strong></p> <p><strong>Blairingone Biomass Plant.</strong> Nothing to report as the site has been sold and so far no one has put in any applications.</p> <p><strong>War Memorial, Blairingone</strong>. Mike Barnacle has finally heard from Historic Scotland who has no objections to the memorial being moved. A further meeting will be arranged by Mike at the beginning of July, with Council officials, the developers and the Blairingone sub-group, to find a solution to this problem. It was noted that this has taken place before and that the last meeting was inconclusive as the council officials never turned up.</p> <p><strong>Dunning Glen</strong>: Multi agency meetings have been useful with all the landowners now on board. Applications for funds to clear the site have been put forward for approval with various ideas to improve the site; namely signs to discourage camping, limited parking access, fencing and more police involvement. Members of the public are encouraged to report unsocial activity in the area to the police so that they can act more robustly.</p> <p><strong>Tay Plan Consultation</strong>: There will be a Consultation period from 6th June to 1st August. There will also be Public Information Event at the Loch Leven Campus 15th June, 2-8pm. There are no significant changes from the draft report.</p> <p><strong>8. PKC Business, Councillor’s Report</strong> – Mike Barnacle has a proposal that the Kinross Forum should be reinstated. It might be more beneficial for the Forum to stay local particularly on planning matters. He will put the suggestion to the Kinross CC.<br /> There has been tree damage on the River Devon during the latest storm. Ken O’Lone is the tree officer for the area.</p> <p><strong>9. 						 <h2><span>Minutes of Meeting held at Fossoway Primary School</span></h2> <p>1.Attendees: Trudy Duffy-Wigman, Alistair Lavery (Chair), Marion Anness (Minutes), Angus Cheape, Kevin Borthwick, Ramsey Cooper, Cllr M.Barnacle and 13 members of the public.<br /> Apologies: Sheila Anderson, A.Morrison, Cllr W. Robertson</p> <p>2. No Declarations of Interest.</p> <p>3. Community Policing: Sgt. Williams attended the meeting<br /> She reported that it had been a quiet month except for wandering animals in the streets. Public Meetings for T in the Park are due to take place and she requested for one of them to take place at the beginning of the next CC Meeting in June. It was agreed that this could happen and would be at 7.00pm on 7th June at Blairingone School. Another T in the Park Meeting would take place in Carnbo Hall on Thursday 23rd June (TBC)<br /> Comments were made by the public about gates being left open and vandalised and farmers not being allowed to padlock their gates. A complaint was made about horses in crop fields.</p> <p>4. Minutes of last meeting : These were signed off with no amendments.</p> <p>5. Matters Arising<br /> Blairingone War Memorial<br /> Cllr Barnacle is awaiting response from P&amp;K Council and will send a reminder.</p> <p>Dunning Glen: Kevin reported that the CC has applied for a grant for cleaning up and sign. Multi- agency meeting will be held soon.</p> <p>Core Path Network Inquiry: Maps showing Core Paths had been received from the Access Office and were displayed during the meeting. Reactions to these were to be in by 13th May. It was felt by the CC that this was short notice and a complaint has been sent. A discussion was held about some of the decisions that had been made with regard to the paths and some members of the public felt that relevant people including Cllr Barnacle had not been informed.</p> <p>6. C.C. Business:<br /> Kinross –shire Fund: Angus reported that the next meeting was 6th June and welcomed applications for projects.<br /> Convention of P&amp;K Community Council: Kevin reported that only 8 members of the possible 18 turned up to decide the future. 4 voted for it to be wound up, 2 for it to remain and 2 abstained. However as there was insufficient attendance no action could be taken. C.C agreed that we will not resign from the convention until their next meeting as they may need support to vote themselves out of existence.</p> <p>7. Councillor’s Report<br /> Cllr Barnacle reported that Scottish Water had suggested a further meeting regarding control of the Devon.<br /> At the AGM of the Civic Trust M. Travers gave a talk on Renewable Energy and Cllr Barnacle has passed information to Secretary.<br /> A letter has been sent to Cllr Baird re Convener of the Development Control having the Casting vote which is used against local opinion. This will be pursued after elections.</p> <p>8. Planning Matters<br /> 11/00600/IPL, Land South of Craigton Farm Road Rumbling bridge, renewal of planning consent 08/00267/OUT, for the erection of 4 dwelling houses with associated business use.<br /> No CC comment.</p> <p>Alastair also reported that the service from the Council has improved as the CC planning officer is now sent a list of planning decisions. This means we can see whether CC recommendations are being followed up or ignored.</p> <p>9. General Correspondence: A report on the C.C. incoming and outgoing correspondence was distributed.</p> <p>AOB<br /> Thompson Homes Update: A presentation was given with information board and handouts were given out with their new proposals for Powmill. Available on Fossoway website. (www.fossoway.org)</p> <p>The Gate at the New Bridge in Crook of Devon has now been fortified following the escaped cattle incident at the beginning of May. Comments were made about the amount of time it took the Police to attend the incident. Concern was expressed from the floor about who takes responsibility for damage when such incidents occur as the law is very unclear in these matters and the implications this has for Core Paths and increased access through farmland. Comments were made about posts being removed from the kissing gate during the construction of the new bridge. Cllr Barnacle will seek redress about maintenance of Core Path routes.<br /> Comments were made from the floor that discussion about Core Paths had not been reflected fully in the CC minutes. It was noted that the minutes were only a record of the meeting and the CC would welcome volunteers for minutes secretary.</p> <p>Concerns were raised about the loop road in the Crook of Devon between A977 and A 91. This road is being increasingly used by a lot of traffic especially HGV’s and this road is not suitable for such traffic. A request was made for the CC to write to P&amp;KC for a sign. Concerns were also raised about Vicar’s Bridge road on both sides of the A977. It was noted that Clackmannanshire Council had much better signage.</p> <p>Apologies were made about the lack of display board in Blairingone as the doors on the Notice Board have fallen off. Marion to look for volunteers to help.</p> <p>CC agreed to give £10 so that the Kinross Newsletter can be sold at Blairingone Primary School as the newsletter has to be paid for up front. Marion and Trudy to liaise.</p> <p>Crook of Devon Church Car Park. No further development. The turbines at this site have been in situ since August of last year, and have been exporting electricity since November. I am pleased to report that the site is now fully operational.<br /> <br /> Since obtaining planning consent for the thirteen 102m to tip turbines at Burnfoot Hill back in 2007, it has become apparent that there may be some scope to extend the existing project. We are currently considering the various options available to us, within both Clackmannanshire and Perth and Kinross. We have had some initial discussions with planning representatives from both local authorities, as well as SNH.<br /> <br /> The area that we currently believe has potential scope to accommodate additional turbines is relatively sizable, as shown on the attached plan and could accommodate as many as 22 additional turbines. The exact scale of any future proposal is yet to be decided, and will be carefully considered following on from a variety of environmental and technical assessments that are currently being carried out. In addition we are keen to widely consult local groups, organisations and members of the public so that we can ensure the most suitable site design is proposed within any future planning application.<br /> <br /> We will therefore be holding two public exhibitions in the coming weeks. The purpose of these is to introduce local residents to the potential projects and to answer any questions they might have. There will be a number of Wind Prospect employees on hand, including myself. On display will be a selection of computer generated photomontages which will offer an idea of how the potential turbines would look from a variety of locations.<br /> <br /> The details of the exhibitions are as follows:<br /> <br /> · Tuesday 17th May at Tillicoultry Community Centre between 3:30pm and 7:30pm.<br /> · Thursday 19th May at Blackford Village Hall between 3:00pm and 7:00pm.<br /> <br /> We are aware that there are many developers currently looking to develop sites throughout Scotland. However, due to our vast experience of wind farm development and construction, detailed within the attached company literature, we are confident that our site selection procedures are second-to-none. We pride ourselves on sustainable and responsible development, as well as careful and considerate construction. Chairman has asked Sgt Williams who will try and speak to the people who are parking in the village. (Note after the meeting: apologies were received by email from Sgt Williams. There is nothing to report for our area.)</p> <p><strong>4.Minutes of the last meeting</strong> –The minutes were signed off.</p> <p><strong>5.Presentation by Malcolm Smith (Wilson Homes):</strong> Carnbo Pitcairnie</p> <p>Proposal is for two semi-detached properties to complete “courtyard”. Extend existing road opposite and add three detached properties – all similar style as existing. Roads, services, etc., already in place. Use garden of existing house. Flood study done and submitted with application for SEPA and PKC Planners to review – A considered proposal taking these concerns into consideration.</p> <p>The CC feels that there is excessive development here and new property has caused flooding to another house. CC would like commitments from developer to ensure prevention of further flooding and also allow continued access to residents during development. M Smith says that the development will take consideration of what SEPA approves, and also that the constructor will take notice of planning constraints. Chair expects there to be a very strong condition in the planning permission to ensure the developer behaves appropriately.</p> <p>Cllr Robertson reminds us all of the You Tube Video showing the previous problems, and the continued unhappiness of the surrounding property owners. Issues: Wall, Flooding, Waste pile in adjacent field. M. Smith asked for Cllr Robertson’s correspondence to be forwarded to him so that the issues can be addressed.</p> <p>Secretary explains that it’s not a question of whether there is or isn’t actually a technical problem (the wall may well be built to standards) but whether people feel that they are being listened to or not. M. Smith hopes that the new development will receive a fair hearing, not based on history – Chair replies that this would be helped if existing development was completed and tidied up. S Wilson (Developer) says that work will re-commence on Monday, but this has been a difficult time for the construction industry, and that future developments will be carried out in a reasonable manner (M. Smith adds “in accordance with planning requirements.) R. Cooper asked if there has been any feedback to the flooding proposals yet? M. Smith said that SEPA are still considering them as part of the application. R. Cooper suggests that flooding problem may be due to water running down the new access road with nowhere to go. M. Smith said that a full survey has been done with estimates of calculated storm levels and the proposed plan will prevent any problems.</p> <p><strong>6.Matters Arising:</strong></p> <p>Blairingone Energy Plant - The Blairingone Biomass Plant Community Action Group (BAG) has been formed. The CC gives the group their support. There have been several meetings. Chair says that it’s important that we keep a dialogue open with the developer so that if the proposal were to go ahead, we could make sure that we can make the best of it. Groups can now make agreements with developers under “Good Neighbour Scheme” which are enforceable in an ongoing way. It is important that there is a permanent group to make the agreement with, so that discussions and benefits can continue.</p> <p>The CC have written to PKC requesting extra time for consultation, but no response as yet. This may be resolved once the application goes in. Cllr Robertson has consulted with the senior planner (Mr Bean) and he’s well aware of the previous history. Cllr Robertson suggests that the Action Group should be “hard-nosed” and hold out for some significant benefits in return for this development.</p> <p>The BAG are now pulling together with the CC, and the two members of the CC seconded to the BAG will form a very useful bridge. The BAG can engage the press and MSPs, etc. BAG requests that the CC keeps them informed of any meetings with the developer. Chair replies that there will be two members of the CC on the BAG so they’ll know. The Chair confirms that the developer will not get any chance to divide the opposition.</p> <p>Member of the public points out that these schemes are being accepted in spite of enormous numbers of objections, so this could be a hard fight and even if PKC reject it, it may still go through, so make sure you have a plan B.</p> <p>War Memorial, Blairingone - Cllr. Barnacle sent apologies for this meeting, so no update.</p> <p>Dunning Glen Problems - The current weather conditions make it difficult to do anything at the moment. We have now got a risk assessment. Ian Taylor from Beinn Skips met with K Borthwick today, and a quotation for the tidy-up will be forthcoming, so CC can source funding for the work. In South Lanarkshire, land owner is informed of fly-tip material and they are charged by Council if they don’t remove it. All agree this is massively unfair. Many thanks to Rod Paterson who did a risk assessment on the cleaning-up exercise.</p> <p>Tracks - George Lawrie<br /> Update from Tracks<br /> A small path round Kelty Mill is been developed. £27k project to add brown “tourist” signs to get people into the area. Tracks are always interested in proposals from communities for paths – they’re good at getting funding. PKC Core Path plan is with Reporter, unlikely to be agreed before October 2011. What about the Rumbling Bridge Gorge Bridge – could they help replace it? George estimates £50k to fix, but doesn’t think it is possible at this time. Cllr Robertson thought replacement was unlikely at this time.</p> <p><strong>7.Community Council Business</strong></p> <p>Lochleven High School Campus Users – R. Cooper is attending meetings but has nothing to report.</p> <p>CPKCC. K. Borthwick and Sandy Morrison went to a poorly attended meeting of the convention. FDCC proposed that it be wound up – the last AGM had no officer’s reports or audited accounts. There will be a special meeting to decide about the future of the CPKCC.</p> <p>Scottish Water – S. Morrison – CC raised issue of flooding from Dam at meeting. SW said they need to keep the dam full to avoid water shortages – they don’t seem to plan ahead for snow melt or other weather conditions. CC has not had a reply to letter of 14th February.</p> <p>Clacks Council – Sandy Morrison attended a planning meeting of Clackmannan-shire Council re: Glenquey Quarry. Report to the Clacks Planning Committee was very critical of PKC who had not consulted with any of the CCs etc., and the development was contrary to plan.</p> <p><strong>8.PKC Business, Councillor’s Reports</strong><br /> Cllr. Robertson reported on A977and Clacks border to A823 road speed limits being lowered to 40mph. Work on the repair to the Dunning Glen Bridge has started and then stopped again while soil samples are taken.<br /> Cllr. Baird – Information about brown bins, you can get more than one. If you’re on a route, then ask for a brown bin if you don’t have one. 						 <h1><span>Fossoway and District Community Council</span></h1> <p><strong>Minutes of Meeting Blairingone School, 1st March 2011</strong></p> <p><strong>1.Attending:</strong> T Duffy- Wigman, S Anderson, M Anness, K Bothwick, A Cheape, R Cooper. Cllrs. W Robertson, M Barnacle<br /> 13 Members of the public<br /> Apologies: S Morrison, A Lavery.</p> <p><strong>2. Declarations of interest:</strong> There were no declarations of interest.</p> <p><strong>3.Community Policing</strong>- The police are concentrating on parking at present, checking on yellow-line parking, inconsiderate parking and parking over driveways and pavements. The community policeman also introduced the “Tayside Community Officers Tweet on the Beat” to enable members of the public to engage with the police, negatively and positively, online. There is a trial period of 3 months. The website for this is www.twitter.com/GlenfargPC or you can visit the MyPolice website at www.tayside.mypolice.org.</p> <p><strong>4.Minutes of the last meeting</strong> – An amendment to include the fact that the CC is closely following the developments at the Glen Quey Quarry is to be recorded. The minutes were then signed off.</p> <p><strong>5.Matters Arising:</strong></p> <p><strong>Tayside Main Issues Report and Consultation</strong>-Cllr. Barnacle has delivered a submission to include the local opinion, endorsed by all the local organisations. Cllr. Barnacle and Cllr. Robertson would like to see a spread of development rather than concentrated new housing in one village. The next stage is to await the full findings of the report. There will be a chance to comment and a further period of consultation during 2011.</p> <p><strong>Blairingone Energy Plant</strong>- A meeting was held in Blairingone to gauge local opinion on the Blairingone Biomass Plant and as a result an Action Group has been formed. The community was given an account by Fred Saunders of the developer’s proposal and a questionnaire was available for them to comment on the plan. The overwhelming feeling was that the plant was not wanted. A meeting the week after with the developers, to ask questions and find out more about the proposals was well attended. The general feeling now is that the Action Group and the CC should try request that the planning application is a “major”, rather than a “local” one. This would necessitate further consultations and impact studies. The new concept of “good neighbourhood agreements” should be explored. Cllr. Robertson agreed to write to the planners asking clarification on the planning status.</p> <p><strong>War Memorial, Blairingone</strong>-Cllr. Barnacle had a meeting with several agencies to remind them that the community definitely wanted the war memorial moved, and if there was a funding gap, the community would explore possibilities. He is now more hopeful of progress. The estate agency for the property should be informed of the unresolved issue of the memorial. A further site meeting is planned and Cllr. Barnacle was thanked for his continuing work on resolving the problem.</p> <p><strong>Dunning Glen Problems</strong>- Kevin has visited the site and there is still a lot of rubbish, some very recent. More multi agency meetings are planned, but progress is slow when there are so few complaints. This makes it difficult for the police to react.</p> <p><strong>6.Community Council Business</strong><br /> CPKCC. Kevin attended a meeting of the convention but there seems to be little support for this organisation. An amendment to the constitution has been proposed by a former member of Kinross CC (Joe Richardson), that people out-with the area can stand for CCs. It was agreed not to support this amendment.</p> <p><strong>T in the Park</strong>- It was agreed that the arrangements for traffic management and security were working well, but we should not become complacent. It was agreed that in general the area benefited from the festival in terms of the Kinross Fund. Any worries about traffic management, for example when weddings are taking place, could be overcome, and people should contact the organisers for advice.</p> <p><strong>7.PKC Business, Councillor’s Report</strong><br /> Cllr. Robertson reported on the repair to the Dunning Glen Bridge. Historic Scotland is involved and work was waiting for their go-ahead. Extra money is available for repairing road pot-holes. Please report any that need attention. Cuts in spending may mean bus shelters may not be replaced, just repaired. Some households will receive garden waste bins.<br /> Cllr. Barnacle has concerns with the cut-backs affecting classroom and language assistants. Staff had to be cut and this was difficult. Roadside drains were not being attended to leading to flooding problems, although a contingency fund for serious flooding was available. The need for reflectors on the traffic lights at Drum was being followed up.</p> <p><strong>8.Planning Applications</strong>-</p> <p>11/00227/FLL, Blairingone Sewage Works Blairingone , Upgrading of wastewater treatment works. The early release of water from the dam might have avoided the damage to the bridge over the Devon from the strong water surge. There is a public meeting in Perth to discuss this and other matters and people are invited to attend.<br /> Newsletter- Marion has spoken to the teacher at Blairingone School and she is willing to have the newsletter in the school for people to buy. The only difficulty is that it has to be paid for up-front. This may be able to be overcome and Marion will look into it further.<br /> Snow Clearing- Trudy has been asked by PKC for the community’s comments on snow clearing arrangements this year. Scottish Planning Regulations under PAN 45 &amp; NPPG6 advise that CHP Plants are classed as<br /> industrial uses and thus require that planning consent to operate. It also advises that consent<br /> should be guided by the local and structure plan.<br /> As this site is not identified in either the local of structure plans and is zoned for agricultural<br /> (Green Belt) does the proposer intend to apply for change of use to industrial consent?<br /> A. NPPG 6 was superseded by SPP6 “Renewable Energy” which was in turn revoked by Scottish<br /> Planning Policy in February 2010. Para. 182 of the current Scottish Planning Policy encourages<br /> the development of biomass technology as a means of increasing the amount of electricity<br /> generated from renewable resources and as a means of supporting sustainable economic<br /> growth. PAN 45 is a Planning Advice Note not policy document. Nevertheless, PAN 45 states<br /> at para. 10; “Scotland has a considerable medium term resource in the shape of forestry<br /> biomass”.<br /> Yes, a biomass plant can be described as an industrial use but a more accurate description for<br /> a planning proposal is a biomass plant. The Government’s planning policy for rural areas is to<br /> encourage diversification and the re-use of brownfield sites. This proposal complies with two<br /> important planks in that it is a renewable energy proposal and would make beneficial use of a<br /> brownfield agricultural site in the countryside.<br /> Development plans are not prescriptive and cannot anticipate every development idea or<br /> proposal that comes forward. They are not “telepathic”. Structure Plans do not allocate sites<br /> for specific purposes. The Kinross Area Local Plan is now almost 7 years old and just because<br /> a piece of ground is not allocated for a specific purpose does not prevent a proposal coming<br /> forward. Each application for planning permission has to be determined on its merits and<br /> that is the case with this proposal.</p> <p>2. National Planning Policy Guideline 6 states that in relation to the local community, (Biomass)<br /> developments should not be permitted where they would have a significant long term<br /> detrimental impact on the amenity of people living nearby, and where the impact cannot be<br /> mitigated satisfactorily. NPPG6&nbsp;2000.<br /> The Scottish Parliament in relation to Blairingone stated on 31 March 2003 that<br /> ‘In the case of Blairingone, the village has undoubtedly suffered enough and deserves a clear<br /> statement as to the risks or otherwise of the activities adjacent to it.’<br /> ‘In reaching our conclusion, the committee is conscious that the health of the public should<br /> never be jeopardised for lack of definitive evidence. Neither should the situation be made worse<br /> by inappropriate and unjustified speculation’.<br /> It can be argued that the long term detrimental impact could be the physical and mental health<br /> of the residents living close to the operation.<br /> How does the operator react to the history of this site and the fact that he will be placing a great<br /> deal of strain on the local community? What guarantees other than he is complying with<br /> legislation can the operator provide to prevent physical and mental health?<br /> A. NPPG 6 has been superseded. Each application has to be determined on its merits. Whilst<br /> the Scottish Parliament made comments about Blairingone in 2003 these comments were not<br /> made in relation to a proposal for biomass. This current proposal has to be judged on its<br /> planning merits.<br /> We would not presume to comprehend the impact on the community arising out of what was<br /> a totally unsatisfactory series of events. However, we are in no way connected to the parties<br /> which caused the problems and neither should our proposed process be viewed in the same<br /> category. We all have a responsibility to represent the proposal in its true form and some of<br /> the inappropriate comparisons that have been made to date are more likely to create<br /> needless concern. Having said that, we appreciate that you need to satisfy yourselves that<br /> the community’s interests are best served, and hopefully we have so far been as open and<br /> responsive as possible.<br /> In terms of the environment and health, it is intended that answers to some of the<br /> subsequent questions address these aspects.</p> <p>3. The Scottish Parliament in relation to previous activity on this site said “Blairingone has<br /> undoubtedly suffered enough and deserves a clear statement as to the risks or otherwise of the<br /> activities adjacent to it… The health of the public should never be jeopardised for lack of<br /> definitive evidence”. John McAllion MSP petitions Committee Chair.<br /> Will you contract with this community to the effect that if any member of the public suffers as a<br /> result of the emissions, noise or dust particles that there will be a mechanism in place to seek<br /> compensation directly from the operators of the plant. A contract will be entered into directly<br /> with the community that will detail the medical steps that will be taken and the level of<br /> compensation if injury occurs. Additionally will you offer a mechanism for the nuisance and<br /> damage to property resulting from ash, chimney residue, sawdust or other contaminants<br /> drifting off this site onto adjoining land and homes affecting washing drying on lines, window’s<br /> or vehicles being covered in airborne particles?<br /> A. We are of course subject to the law of Scotland in this respect and our legal liabilities are<br /> already established. The idea of trying to create a bi-lateral contract which takes the place of<br /> common law is frankly nonsense. Procedures and remedies already exist to address any<br /> failure to meet our duties and obligations. We do not believe that the processes that we<br /> propose to undertake on site will lead to the type of nuisances you describe because of the<br /> technology, methods and management procedures that we will adopt. We will offer some<br /> further explanation of this during the presentation on 15 February. Of course, in the unlikely<br /> event that an incident should occur which is a result of our operation, then we are prepared<br /> to offer appropriate compensation.</p> <p>4. Recognising the history of this site and how this community has suffered with firstly an open<br /> cast mine then the spreading of medical and abattoir waste, if this community rejects your<br /> proposals will you withdraw your interest?<br /> A. If we felt that the basis for objections were substantive and undermined the merits of the<br /> proposal, rather than some linkage to an unfortunate history of the site, then we would<br /> reconsider the application. However, we would also take account of the views of those<br /> people in the community that are either undecided or, favourable to the project.</p> <p>5. Scottish Planning regulations call for uses of this nature to, at the end of their useful life,<br /> reinstate the land back to a condition that is in keeping with the area. Would you confirm what<br /> timescale you would propose to reinstate this land and that a fund would be set aside to do this.<br /> Additionally would you contract with the community other than by a S75 agreement to reinstate<br /> the land?<br /> A. We will comply with the law.</p> <p>VISUAL &amp; ACOUSTIC &amp; LIGHTING IMPACT<br /> 6. What measures are being taken to minimise the visual and acoustic impact of this development,<br /> (tree planting, soil banks, acoustic baffling)?<br /> A. In considering the visual impact, we have attempted to set out the plant in a manner which<br /> uses the existing building and contours, e.g. placing the CHP building on the lower slab to<br /> keep its ridge height at a similar level to the existing building on site – and in line with that<br /> building. Likewise, keeping the extension to the existing building at the same roof height.<br /> The existing tree planting to the north and east of the site will continue to offer increased<br /> screening as it matures. Additional tree plant is an option if this will provide additional<br /> screening.<br /> In terms of acoustics, our intention is to deal with the main noise emitters at source through<br /> the application of technology as the primary means of sound attention. If additional benefit<br /> can be provided by landscaping, screening with trees or banking etc., then this will be<br /> considered but we will not rely on this as being the most effective method of dealing with<br /> noise.<br /> Where feasible, we will house noisy equipment in their own acoustic enclosures, e.g. this is<br /> the norm when installing gas engines. Additionally, silencers will be fitted to exhausts. The<br /> construction of the building will incorporate materials with components designed to have the<br /> appropriate acoustic performance. We can reassure people that these will not be simple<br /> ’wriggly tin’ sheds.<br /> In terms of yard operations, we have undertaken to complete these by 8pm each evening, i.e.<br /> all overnight operations will be confined within the buildings themselves, e.g. bales of<br /> palletised shavings will be stacked within an internal storage area overnight – ready for<br /> loading during daytime operations.<br /> We have carried out a background acoustic study to establish noise levels (day and night) at<br /> what are potential the most sensitive sites for noise (nearest properties). The final design of<br /> the infrastructure and operations will be based on ensuring that these noise levels are not<br /> exceeded.</p> <p>7. Noise – This is a very quiet area. The proximity of this CHP plant to my house is approximately<br /> 230 metres. As my family and I (and other residents immediately adjacent) would directly suffer<br /> from noise pollution (outwith core business hours 8am-6pm) what steps are being taken and<br /> what level of compensation would be offered is noise pollution was found to occur?<br /> Would you be prepared to install noise monitors at 360 degrees surrounding the site for the<br /> duration of the CHP plant and if noise levels are found to be above agreed levels either offer<br /> compensation or take action to bring levels to agreed limits?<br /> A Please see the statement in answer to Q6. The distance of your property from the main noise<br /> sources is actually closer to 400m. As you know, it is likely that achievement of noise levels<br /> will be a condition of the planning consent. Should you believe that we are exceeding these<br /> levels, and do not wish to discuss the matter with us in the first instance, then a complaint<br /> can be made to the Environmental Health Officer. They will assess the situation and<br /> ultimately enforce us to remedy the problem or cease the operation that is causing the<br /> problem. Clearly, the last thing we want is to get phone calls from irate neighbours<br /> complaining about noise. That is why we will take our responsibility in this respect very<br /> seriously. We do not want to run the risk of having planned operations curtailed – this does<br /> not make any sense. Therefore, our approach will, if anything, be overly cautious. We will be<br /> happy to keep neighbours informed of our detailed design plans through the design process.<br /> In terms of establishing noise monitors, we don’t believe that this is practical.</p> <p>8. Visual Impact – You advise that “every effort” has been made to minimise the visual impact,<br /> specifically minimising it from local residents. What do you mean by “every effort” as little<br /> detail on this effort has been demonstrated? Additionally what extra measures such as tree<br /> planting, landscaping and earth works are you planning to obscure this completely from local<br /> residents?<br /> A. Please see answer to Question 6 above.</p> <p>9. Light Pollution – At night time this is a very dark area. What steps will be taken to ensure that<br /> there is no light pollution from the sight onto adjoining land and property?<br /> A. We are aware of the existing lighting levels presently on site. In simple terms, we would work<br /> to ensure that the impact of artificial lighting is certainly no worse than it is at present.<br /> Moreover, we would try and improve the situation by considering a more modern and<br /> sophisticated, and hopefully more beneficial system for everyone. Our focus would be to<br /> concentrate on looking at the necessary local safety and task lighting and introduce features<br /> such as PIR sensors. Whilst lighting in the yard would be necessary during winter hours – say<br /> 4pm-8pm, it will be minimised thereafter.</p> <p>AIR QUALITY<br /> 10. Dr Van Steenis, advisor to the UK Government advises that incineration of wood and the<br /> resulting PM1 and PM 2.5 particle emissions cause a shortening of life by up to 11 years by<br /> increasing a range of diseases including strokes, cancers, heart attacks and infant mortality. He<br /> goes on to advise that the best technique for a wood fired power station is plasma gasification<br /> using an electric welding arc. He advises the emissions are greatly reduced and electricity<br /> produced increases three fold. Can you confirm how your proposal differs from this and if you<br /> would consider using this type of incineration.<br /> A. Firstly, we are not sure that it is correct to state that Dr Van Steenis is an advisor to the UK<br /> Government. Secondly, this is not incineration – it is a gasification process as is plasma arc<br /> gasification. As we understand it, the prime reason why Dr Van Steenis recommends this<br /> technology for ‘waste to energy’ applications (versus incineration) is because the very high<br /> temperatures guarantee destruction of harmful chemicals, heavy metals etc. which are found<br /> in waste materials. True, occasionally, such elements are found in virgin wood – resulting<br /> from absorption predominantly from the atmosphere – and relating to the level of pollution<br /> in the area in which the timber is grown. If they occur, they are at very low levels and this is<br /> why virgin wood is not classified as ‘waste’ in terms of the Waste Incineration Directive.<br /> Additionally, both plasma arc and our technology produce a syngas for use in say an engine to<br /> produce electricity and heat. The clean- up process for the syngas is important to reduce the<br /> particulate levels. Our process includes a cyclone, bag filter and demister clean up –<br /> producing a very clean syngas. We do not believe that Dr Van Steenis is correct with his<br /> ‘three fold’ increase in electricity production. A recent report by Dr Gary Young in the USA<br /> comparing waste conversion technologies suggests that plasma arc gasification is perhaps<br /> 20% more efficient for electricity production from waste than pyrolysis. If it was 3x better,<br /> then we would be creating energy! This report also goes on to suggest (using US assumptions<br /> on input costs and revenues) than it only breaks even when feeding it with between 180-270<br /> tonnes of waste per day. Finally, plasma arc gasification is in its early stages of development<br /> and is very expensive. It is perhaps viable only because the fuel source is, at worst ‘free’, and<br /> in most cases attracts a gate fee, i.e. municipalities pay to have it treated.</p> <p>11. Air Quality – Biomass increases the emissions of nitrogen oxides, particulate matter and sulphur<br /> dioxide as well as formaldehyde, toluene, acetaldehyde etc. These are found to have an impact<br /> on the health of children.<br /> A. Please see the comment above about potential pollutants in virgin wood.<br /> Additionally, particle pollution especially fine particles contain microscopic solids and liquid<br /> droplets that are so small that they can get deep into the lungs and cause serious health<br /> problems.<br /> A. A summary of the air quality analysis will be presented at the meeting on 15 February.<br /> Hopefully, this will demonstrate the impact of the emissions relative to the background levels<br /> in the area and also air quality standards as set in Scotland and comparing these to world-<br /> wide standards and the World Health Organisation recommendations.<br /> As a father of a 15 month old baby and a 5 year old what steps will you take to ensure that my<br /> children are not exposed to any toxins or particle pollution coming from the operation of this<br /> CHP plant.<br /> A. We have described the abatement measures we will take and will show the impact. We<br /> would then pose the question – how do you think this compares to those households in the<br /> village who are burning wood in open fireplaces and stoves – with no abatement?<br /> Also recognising the Scottish legal precedent of ‘Duty of Care’ and particularly numerous cases<br /> where an operator adhering to ‘best practice’ was not found to be sufficiently robust argument<br /> to protect them from litigation when the operator knew of extra measures that could be taken<br /> to address this ‘duty of care’. What extra steps over UK guidelines will you take?<br /> A. We have explained why we believe this process to be superior to traditional combustion.<br /> Will you meet an independent expert, who is advisor to the UK Government and take on board<br /> their recommendations for minimising the emissions of this operation?<br /> A. We will demonstrate that we will exceed the requirements of Scottish air quality standards.<br /> We are not averse to examining what other measures are available.<br /> Would you be prepared to install air pollution monitors at 360 degrees surrounding the site for<br /> the duration of the CHP plant and if levels of pollutant/toxins are found to be above agreed<br /> levels either offer compensation or take action to bring levels to within agreed limits?<br /> A. Air pollution monitors at 360 degrees is simple impractical because the atmosphere in the<br /> vicinity of the site is not ‘pure’. Therefore, there is no way of determining who is causing the<br /> pollution – it could be from your own chimney. We are happy to undertake regular checks of<br /> emissions from our flue stack, and if it was considered that it would deliver a real benefit,<br /> then we might look at continuous emissions monitoring. This would provide data on a<br /> continuous basis and identify what the plant is producing – not what might be arising from<br /> other emitters in the area.</p> <p>12. Dust Contamination – What steps will be taken to ensure that no dust from ash or sawdust will<br /> be blown off the site onto adjoining land and property and what compensation will you offer if<br /> this occurs and affects such issues as washing drying outside, windows becoming dirty more<br /> than normal etc.<br /> A. Ash will be conveyed automatically from the gasifier to closed ash containers. These have<br /> shut-off flaps which operate at container change-over. This is fairly standard procedure in<br /> such plants and should not give rise to the opportunity for ash to blow offsite. Likewise,<br /> shavings and sawdust handling will be undertaken indoors. Good housekeeping is essential<br /> but if you go to a modern, well run shavings plant, you would be surprised by how clean they<br /> are. As we mentioned above, in the unlikely event of an incident as described, then we will<br /> accept our responsibility and deal with it to the reasonable satisfaction of the affected<br /> property owner.</p> <p>FUEL FEEDSTOCK<br /> 13. Scottish Natural Heritage advise that if care is not taken in the production of feedstocks, the<br /> development of bioenergy could have diverse impacts on biodiversity, landscapes, soil and water<br /> quality, further supporting the rejection of a biomass chp plant at this location.<br /> What is the operators view on this and what guarantees will be given that no contamination to<br /> the local land, water courses, soil and air will result from the operation?<br /> A. Before answering this specific point, it is worth clarifying for those who are unaware, that the<br /> above comment refers to an extract from Scottish National Heritage’s document ‘Bioenergy<br /> and the natural heritage’. To set the context, Scottish Natural Heritage (SNH), in the<br /> Introduction state that;<br /> ‘SNH strongly supports the development of renewable energy, including bioenergy, as part of<br /> the Government’s action on climate change’.<br /> ‘The development of bioenergy in Scotland offers the opportunity to utilise land for forestry<br /> and energy crops in a way which could benefit both landscapes and wildlife and which can be<br /> accommodated alongside existing land management practices. The bioenergy industry<br /> provides opportunities for enhanced rural employment and can contribute to the sustainable<br /> and dynamic economy for Scotland’.<br /> In this context, it then goes on to make the statement referred to in the question above.<br /> Specifically, SNH’s comment refers to the production of feedstock, and the following response<br /> assumes that this is what the question refers to as opposed to operation on site.<br /> The EU is introducing mandatory sustainability criteria and greenhouse gas thresholds in<br /> respect of renewable feedstocks. In order to qualify for renewable certification, the operator<br /> will be subject to regular audits, part of which requires a fuel management system to be<br /> maintained – which will track upstream supply. For this reason it is incumbent on the<br /> operator to purchase feedstock from reputable suppliers who can demonstrate compliance<br /> with the extensive regulations which already exist in the UK forest industry. Ultimately we<br /> are not experts in forestry and rely on selecting those companies with that expertise to<br /> manage that portion of the supply chain. Most of them have many years of proven<br /> experience and expertise in this area – managing the aspects of concern mentioned above,<br /> e.g. whether or not to engage in stump removal. We do not see an influx of ‘new’ forestry<br /> management companies into the market to try and take advantage of the increase in activity<br /> in this area.</p> <p>14. Scottish Natural Heritage also advise that at the local &amp; global level there is a risk that<br /> bioenergy feedstocks could be derived from unsustainable production systems namely not<br /> enough wood to supply a biomass plant with fuel. Thus suggesting that biomass which starts<br /> out by burning wood will inevitably burn other biomass such as chicken litter, farm slurries,<br /> sewage sludge and municipal solid wastes. All of which are permitted to be incinerated under<br /> Scottish regulations and a planning consent does not differentiate between fuel types.<br /> What guarantees will be given that no fuel other than wood will be used in the lifetime of this<br /> facility.<br /> A. We are prepared to enter into a Good Neighbour Agreement in respect of the commitment<br /> not to utilise waste as a fuel feedstock. A Good Neighbour Agreements is a voluntary<br /> agreement which is legally binding and entered into between the developer and the<br /> community. The community can enforce it terms akin to a normal contract. They have been<br /> introduced into the planning system in Scotland from 1 February this year and are considered<br /> a mechanism to govern land management/operations and are intended to help alleviate<br /> objections, such as the above.</p> <p>15. You advise that this plant will only burn wood yet Scottish planning regulations allow biomass<br /> plants to burn other fuel types including oilseed rape, cereal straw, and waste such as, municipal<br /> waste, wood waste, poultry litter, abattoir waste and waste vegetable oils. Will you enter into a<br /> contract with the community to the effect that for the lifetime of the operation of this plant that<br /> no fuel other than virgin wood will be used?<br /> A. Please see answer to Question 14 above.</p> <p>MISCELLANEOUS<br /> 16. Wildlife – I walk my dogs on this land almost every morning and evening. Over the past 3 years I<br /> have spotted 4 species of woodpecker, bats, barn and tawny owls, red squirrels, roe and sika<br /> deer, red kite, peregrine falcon as well as badger sets and pine martin droppings. What steps<br /> will be taken to protect these animals especially as some are protected species.<br /> A. Our operations will be confined to the road and slabbed areas marked on the drawings. We<br /> will have no need or desire to encroach into the wooded area and surrounds which are<br /> adjacent to the site. We do not believe the operations will have any adverse impact on these<br /> species or their habitat.</p> <p>17. Impact – The RICS acknowledge that homes adjacent to unacceptable and inappropriate uses<br /> suffer a drop in their capital value. What compensation will you offer home owners who suffer a<br /> drop in the capital value of their homes as a direct result of this operation being sited with close<br /> proximity?<br /> A. We would refute the plant being described as an unacceptable and inappropriate use.</p> <p>18. There is an equestrian and public right of way through the property from Vicars Bridge Road.<br /> The current operator broke legislation by padlocking a gate at the entrance to this site. Will you<br /> allow the public uninterrupted use of this right of way?<br /> A. We cannot comment on the actions of the current operator. Clearly we will be bound by law<br /> and comply with legislation. From an operation, suitability and safety point of view, we are<br /> happy to talk about arriving at a solution which suits all parties. At the Open Day, we talked<br /> about the possibility of establishing a new walkway to the north of the site which might<br /> provide a more convenient and pleasant route to access the woodland area.</p> <p>19. Community Fund – a proposal for a community fund mechanism was tabled to Lambhill Energy<br /> Ltd by a local resident during a recent meeting with the community council. This fund would<br /> operate on the premise that what is important to the community is a degree of control and<br /> peace of mind that this is a safe operation as opposed to outright financial gain. The<br /> mechanism proposed is that Lambhill Energy upon receipt of planning permission would gift the<br /> land to the community who would then lease it back to Lambhill Energy ltd for a term to be<br /> agreed. There would be clauses within the lease that would cover emission levels, noise, fuel<br /> type, management of the plant in terms of minimising materials from blowing off the site to<br /> adjoining houses and future expansion. Would you enter into an agreement with the<br /> community?<br /> If you would not be prepared to enter into this agreement what other contractual agreement<br /> would you offer to back up your verbal promises regarding the fuel type, emissions, noise, air<br /> quality levels etc?</p> <p>A. In terms of the above-mentioned proposal that was tabled, it is wholly unacceptable and<br /> unworkable. We believe that we have covered the points raised in the previous answers. 						 <p>The consultation period for Perth &amp; Kinross Council's <a href="http://www.fossoway.org/strategy:main-issues-report">Main Issues Report</a> has now ended. The Council will now be considering all of the responses and taking them into account in the preparation of the Proposed Plan, which is due to be published in December 2011.</p> <p>Councillor Mike Barnacle has submitted the following response on the Main Issues Report to Perth &amp; Kinross Council's Planning Department.</p> <div> <blockquote> <div class="image-container floatright"><img src="http://www.fossoway.org/local--files/forum:new-thread/Mike-Barnacle.jpg" alt="Mike-Barnacle.jpg" class="image" /></div> <p>Mr Peter Marshall<br /> Planning &amp; Sustainable Development Manager<br /> The Environment Service (Planning)<br /> Perth &amp; Kinross Council<br /> Pullar House<br /> 35 Kinnoull Street<br /> PERTH<br /> PH1&nbsp;5GD</p> <p>Dear Peter</p> <p>MAIN ISSUES REPORT (MIR) FOR PERTH &amp; KINROSS (PKC) LOCAL DEVELOPMENT PLAN (LDP) (SEPT 2010)</p> <p>I write in formal submission to the above document (although I will also be attempting to respond on-line with my answers to the questions posed by the extended deadline that I had requested to 11/2/11). My response has to be seen also in the context of my three previous major submissions to your colleague Brenda Murray prior to the finalisation of your MIR, dated 30/6/09, 31/8/09 and 28/7/10 enclosed. Between the 2009 and 2010 submissions I held six very well attended public meetings in the rural areas of Kinross-shire; since the publication of the MIR I have held 2 further well attended public meetings in December 2010, one in Fossoway (minute enclosed) and one in the Portmoak Community Council areas; these being the areas where the Kinross-shire landward developments are proposed in the MIR. I also referred at these meetings to my letter enclosed of 27/6/10 to Pam Ewan on the Tayplan MIR (2012-2032) because of its necessary consistent relationship to PKC’s MIR. The other local elected members for Kinross-shire attended some of these meetings.</p> <p>Following these meetings (involving significant presentations) I feel well placed to respond to the MIR as the elected member for Kinross-shire since May 1999, a constituency whose broad views, particularly from the rural areas, I have always sought to represent to PKC. Whilst clearly not agreeing with all responses to the MIR, I would particularly endorse the submissions of Cleish, Fossoway and Portmoak Community Councils, Friends of Rural Kinross-shire (FORK) and Kinross-shire Civic Trust (KCT). You should also note that the Fossoway Community Strategy Group (SG) comprising representatives of Fossoway Community Council, FORK, KCT and myself met on 3/11/10 to discuss the MIR and I enclose the notes from that meeting.</p> <p>I note from figure 1 (page 11) the lengthy timescale for the production of the new LDP &amp; reiterate earlier comment that it leaves PKC open to successful challenges from the development sector, given the out-of-date nature of all our existing Local Plans.</p> <p>I note the Vision Statements, 6 key objectives &amp; Drivers for Change in chapters 2 and 3.</p> <p>In earlier submissions of ‘generic comment on policy’ I had felt that the MIR should state ‘at the outset’ 2 significant core values, namely that any development framework should ‘protect &amp; enhance the amenity of existing residents and protect prime agricultural land and our scenic landscape against inappropriate development.’ I wished to see the retention of AGLV’s, called for PKC to recognise the need for major mitigation measures on the A977 (following the failed petition to the Scottish Parliament) and noted from the Kinross Community Council questionnaire a significant level of support for the restoration of a rail link through Kinross-shire. “It is hugely disappointing that NONE of these comments on policy have been incorporated into the MIR.”</p> <p>I note under demographic change and population projections that it’s intended to base Tayplan and the LDP on the 2006 GROS projections (22% growth to 2031) as per PKC’s Single Outcome Agreement (SOA). Our previous PKC Structure Plan growth rate was 3%. I made it clear at PKC in May 2009 under S046 &amp; subsequent submissions that I did not support this ‘alarming &amp; ludicrous’ level of growth proposed and predicted on the latest government projections and contained in that agreement; I reiterate my belief that it poses serious demographic challenges in endorsing a rate of growth and inherent housing density which I view as “neither desirable nor sustainable from an environmental perspective.”</p> <p>The 2008 based GROS projections (27% growth to 2033) are yet more significantly higher than 2006, indicating that PKC per Figure 3 (page 21) is set to remain one of the fastest growing areas of Scotland. It is noted that the projections are based on past trends and take no account of the current economic climate. ‘I suggest they should come with a Government health warning.’</p> <p>At this point it is worth reflecting that the population of Fossoway parish was 947 in 1981, 1735 in 2001 and who knows in 2024? I further note from para 3.4 of the current Kinross-shire Local Plan that the county’s population between 1981 and 1991 increased by 25% which far outstripped the average for PKC area at 6%. The highest growth in the plan area for that decade was 41.7% in Crook of Devon/Drum. I note that if we extrapolated past trends, the Kinross-shire area would be the highest growth in PKC and I believe Planning Officers accept this is not sustainable.<br /> I now turn to addressing the questions posed in the MIR from Chapter 4 onwards. I note there are 22 questions under Main Land Use and Delivery Issues, 16 of which relate to housing &amp; economic development, which shows where PKC’s priorities lie. I will not be covering every issue and question in the MIR; it is so big because it relates to the whole of PKC; as you will know I have argued strongly for the retention of a Kinross-shire Local Plan but was not supported by colleagues at PKC. I aim to concentrate on the parameters of the growth figures, the questions in Chapter 4 and Chapter 5 regarding Perth City and Kinross-shire.</p> <p>Q1&nbsp;NO<br /> Although this may seem a sensible method of approaching the allocation of such land it is subject to the caveat that I am hugely sceptical, as earlier indicated, of the growth projections upon which this whole plan is based; I therefore suggest the traditional 5-year period should be used thereby allowing for revision earlier of the figures if these spurious projections prove wrong.</p> <p>Q2 YES<br /> Your proposal acknowledges the need to slow growth in Kinross-shire and recognises the potential for significant adverse environmental impacts on Lochleven if this situation is not addressed. I welcome the strengthening of policy on phosphate mitigation for the loch’s catchment and strongly urge you to resist the inevitable calls from the development sector to oppose this reallocation. I suggest there is a case for the 10% reallocation to be spread throughout Perthshire, not just Perth itself, given my previous expressed concerns about the proposed expansion of the City.</p> <p>Q3 YES</p> <p>Q4<br /> I strongly disagree with this proposal and note that the housing density ranges per figure 14 (page 39) have been increased in comparison with our current local plan. I strongly suggest that accepting the level of growth in PKC’s SOA forces us to make choices between housing density and the irrevocable loss of prime agricultural land as a resource. I noted at a meeting of Rural Scotland on 27/11/10, to discuss the Scottish Government’s draft land use strategy (consultation ended 17/12/10), that we only have relatively small areas of such prime land, mostly in the east, it is therefore vital it is retained for food production. I would argue strongly against the use of the highest grades (1, 2 &amp; 3.1) of land for housing and suggest it is contrary to national planning policy.</p> <p>Q5 YES<br /> I note from figure 15 (page 41) that Kinross-shire had the highest average house price in PKC in 2007, reflecting it’s ongoing attraction to developers to provide housing at the top end of the market for central belt commuters. We know we have an increasing ageing population (section 4.2.21) and it was clear from previous public meetings and questionnaires that, although there is strong opposition to large scale housing development and widespread concern about the number of development proposals put forward for the rural areas, it was felt that the 25% affordable element therein was a target not being met. There is a lack of housing provision for older people, rent and smaller size so a new policy proposed to increase supply is welcomed.</p> <p>Q6 YES<br /> Rural communities and I felt that the previous 2005 policy had proved detrimental to the countryside and we campaigned for the unanimously approved 2009 policy. I suggest it is fit for purpose and should be enforced. I note that the Planning Department is still currently assessing some applications on the basis of the old policy and I feel this should cease immediately in 2011.<br /> <br /> Q7&nbsp;NO<br /> I note it is suggested that settlements with less than 20 houses should not be enclosed, except within the Lochleven catchment. I suggest small communities want some certainty as to the parameters of their settlements so why not have boundaries? Conversely, opportunities to expand small settlement boundaries could prevent creeping unauthorised development in the countryside on the edge of settlements and I refer here to my earlier submission requesting incorporation of the Greenacres travelling people’s site into the Lochran sidings settlement envelope. A development brief to finally ascertain and contain the parameters of the Greenacres site is urgently needed, this area being synonymous with continual retrospective planning approvals that have expanded the site by stealth, despite strong local objection. The MIR should address this.</p> <p>Q8 &amp; Q9 YES<br /> We urgently need to develop zoned employment land and identify new areas. The SG in Fossoway has indicated they would like to see rural development sites in Blairingone and Crook of Devon but the MIR has not addressed this.</p> <p>Q10 YES<br /> Mixed use development should be supported if the community agree and the policy is not abused; the core value on residential amenity protection I called for is paramount here.</p> <p>Q11&nbsp;NO<br /> I think applications for tourist development should be dealt with as they arise in accord with a policy framework.</p> <p>Q12 YES</p> <p>Q13 &amp; Q14 YES<br /> There is a strong case for supporting key rural businesses within policy. A clear independent appraisal of whether or not farm buildings are redundant or vacant is required because the development sector argues such status usually to justify conversion or demolition for housing. There should be a presumption in favour of rural business use within the policy.</p> <p>Q15&nbsp;NO<br /> Such a policy would be a discouragement to business.</p> <p>Q16 YES<br /> However, section 4.3.32 (page 50) bullet point 1 should include safety and bullet point 2 should embrace artistic and cultural aspects within Perth City.</p> <p>Q17 YES<br /> In responding to this question you should be aware that I am dismayed that AGLV’s are due to be lost from the LDP under Scottish Planning Policy. The community and I worked hard at our last Local Plan Inquiry to acquire the extension of the AGLV’s to our county’s hill and river borders. The MIR suggests the creation of local landscape areas to replace AGLV’s and I propose that these should include the Cleish, Lomond and Ochil Hills, along with the River Devon. A regional park for the Ochil Hills, like the Lomonds, should be considered here. I will be happy to be involved in further discussions on the areas to be included for safeguarding against inappropriate development.</p> <p>Q18 YES<br /> I have reservations about the robustness of the approach and feel that currently not enough attention is paid within planning assessments and reports to this statutory aspect and the duty of PKC to deliver on Action Plans. I commented in my earlier submission of June 2009 on the Perth Lade Biodiversity document, stressing that the Lade (which should be considered for SSS1 status) is seen, along with the Inches and the Tay River, as the green lungs of Perth City and an important template on which to build a sustainable environment.</p> <p>Q19&nbsp;NO<br /> There is much in Key Issue 18 in mitigation measures to deal with climate change that I broadly support and note. However, on the issue of on-shore renewable energy there is a definite deficiency in policy. I understand there is an on-going review in this area but there is a distinct lack of engagement with local members and communities on this. I have received no detail on the outcome of Scottish Government consultations on permitted development for single turbines, meanwhile a considerable number of small clusters and single turbines are being approved in Kinross-shire by the Planning Department, often dealt with seemingly in isolation and little account taken of overall cumulative impact, despite Officer assurances. I suggest this requires to be addressed urgently and also that there should be more encouragement within policy for communities to identify windcroft sites to support their needs rather than simply react to individual development proposals. In the Ochil hills, PKC’s landscape consultant suggested we could accommodate one large windfarm but we now have 3, resulting from Scottish Government policy.</p> <p>Q20 YES<br /> I have noted that Tayplan has a strong approach on avoiding development in flood risk areas, highlighted as a major issue in November 2009 by PKC members of the Environment Committee. The LDP recognises this but should building progress in such areas (e.g. currently at Bridge of Earn), a fundamental re-design guidance for properties that raises living areas above ground level should be undertaken. There are also areas with high water tables (i.e. Drum) that don’t have flood prevention schemes where more assistance for communities to set up localised ditch and water course management schemes would be welcome. There is a perception that periods of intense rain fall have increased recently but that PKC cleaning of roadside ditches and drains has not kept pace.</p> <p>Q21 &amp; Q22 YES<br /> In the current financial climate that local authorities find themselves in, (being ‘between a rock and a hard place’ in facing the ‘double-whammy’ of a seemingly indefinite politically popular council tax freeze from Scottish Government dictat and cuts in the public sector handed down from the new UK Government), it is absolutely essential for developers to make contributions to infrastructure provision. There is a strong feeling in our communities that developer contributions should be directed to the locality of that development, involving community benefit and consultation, rather than controlled and directed by PKC.</p> <p>I note that on Transport and Accessibility the document completely ignores Kinross-shire.</p> <p>Chapter 5 of the MIR dealing with Spatial Strategy in figure 20 (page 66) shows the Tayplan hierarchy of settlements and I note is very much in line with the existing PKC Structure Plan Strategy. Whilst I agree with the overall strategy of concentrating growth in the City and principal settlements (excepting my answer to question 26) the reality is that the level of growth you are accepting signifies much greater development than I am content with, not only in the Perth area but also in Kinross and Milnathort.</p> <p>Q23 &amp; Q24&nbsp;NO<br /> In my submissions I expressed concern on the Perth area at the potential conflict between green belt preservation and growth in outer villages to achieve the Administration’s dubious concept of a Greater Perth and City status (I thought we were already known as “the Fair City” and will lose that quality with the level of growth proposed). Significant development west of Perth’s outer ring road begs the question ‘where does it stop once outer ring roads of cities are breached?’ The green belt inner boundary should be much more tightly drawn to the outer ring road and the A9 west and north.</p> <p>Q25&nbsp;NO<br /> My answers to Q1, 2 and 4 in Chapter 4 state my disagreement to the growth and density levels being planned for and justify this response. Clearly I am opposed to Perth West proposal! (Q28)</p> <p>Q26&nbsp;NO<br /> It would be consistent with my concern over the expansion of the Perth core area to suggest we might leave one new village proposal for consideration in future ‘in the mix’, subject to the views of the community and local members in that area. It may serve to relieve the pressure for development somewhat in the Perth core.</p> <p>Q27 YES<br /> As regards the proposals for the Kinross-shire Area in Section 5.4 of the MIR, I wish to draw Officer’s attention to para 5.20 of our current Local Plan. It identified the settlements of Blairingone, Crook of Devon and Milnathort where PKC with the community, landowners and others would formulate long-term development strategies (LTDS) by 2005/06, the results of which will be incorporated into any subsequent review of the Local Plan (i.e. Now!). This paragraph resulted from a recommendation by the Inquiry Reporter, after community representations, prior to the adoption of the 2004 Plan. PKC Planning Officers encouraged me to include Powmill and Rumbling Bridge in the work of the Fossoway LTDS (see attached letter to residents of November 2010 and earlier correspondence). The SG and myself have been working on this since 2004 in Fossoway, involving the community and landowners, but apart from commissioning a landscape capacity report of August 2005 which the community has made much comment on, PKC Planners have failed to address this requirement in any meaningful way since 2004 and I find it astonishing that this LTDS as a process doesn’t even get a mention in the MIR, despite assurances from PKC Planning that our representations would be taken into account and form a significant input to the MIR, as regards Fossoway.</p> <p>Q35 YES<br /> You should note that figure 28 (Page 114) shows additional housing allocations for the period 2010 - 2014 but this should read 2010 – 2024 as per Figure 27. I note from this table an allowance for windfall sites over the 14 year period of 80 for Kinross-shire; however, I would question the accuracy of this figure given that according to Portmoak Community Council 10 are approved/pending for their area alone in 2010?</p> <p>Q36<br /> I note that of the 525 houses on Map 31 only about 50% are required to 2024. My personal view is that sites B and D should be excluded, which is approximately 300 houses, B being the furthest away from Milnathort and D contributing to the creeping coalescence of Kinross with Milnathort.</p> <p>Before responding to the housing proposals for the landward area of Kinross-shire I would again make reference to the work of the SG on the Fossoway LTDS since 2004 and my earlier submissions to the MIR enclosed, including reference to previous questionnaires carried out in Fossoway by the SG and the Community Council in Powmill. This work culminated in Final Landscape Capacity Maps for Blairingone, Crook of Devon, Powmill and Rumbling Bridge being submitted with my letter of 28/7/10 enclosed.</p> <p>Q37 YES<br /> I agree with the preferred Option 1 that allows for gradual incremental growth across settlements giving a wider choice of sites and range of locations because this option is much more in line with the work of the SG.</p> <p>I am dismayed that Option 2 should feature the Naemoor Road site at Crook of Devon on Map 36. Planning Officers should be well aware that development here has been opposed by the community and myself for many years and was one of the principal reasons for para 5.20, referred to earlier, being incorporated into our current Local Plan.</p> <p>This site is an important village setting gateway to Crook of Devon that should be retained and contains a flood risk. It is hugely disappointing that the developer (who has made no attempt at consultation with the local community regarding their plans for the settlement over many years) and PKC persist with a proposal involving a new bridge to the A977 that would be a prelude to a major expansion of Crook of Devon to the west &amp; north. Both through the consultation on the LTDS and the ‘failed’ appeal by the developer against refusal of outline planning permission, the community has voiced strong objection to development of this site and the SG’s Final Landscape Capacity Map opposed development of CD13 assessment area, so I maintain strong opposition to even the concept of site A being included in Option 2. PKC has had ample opportunity since 2004 to address this issue and have comprehensively failed to do so, despite the best efforts of myself and the SG.</p> <p>Q38<br /> Option 1 is preferred. Sites A and B in Blairingone on Map 32 basically conforms to the SG’s Final Landscape Capacity Map; development here should help to secure the future of the primary school but proposals should consider a site for a replacement village hall and the possible undergrounding of the pylon line that passes through site B. I note that Blairingone’s long established need for a by-pass is not addressed in the MIR. There is concern in Blairingone that two sites are put forward and may proceed together which would double the size of the village, it may be better to preference one of the sites here.</p> <p>Site C at Powmill Farm/Hotel on Map 33 conforms to the SG’s Final Landscape Capacity Map and would presumably be additional to the existing planning approval at Powmill Farm.</p> <p>Site D at Scotlandwell on Map 34 would open up the prospect of the future southern expansion of the settlement boundary and I believe there is opposition to this, which I share.</p> <p>Site E at Wester Balgedie on Map 35 is actually within the Lochleven catchment and should only be developed if mains sewerage connection can be secured. There was a presentation at Portmoak Community Council on 11/1/11 from the developer at which the community made it clear no housing should be built to the east of Mawcarse Road (MIR submission 03/9076) and an opportunity should be taken to re-align the road junction at Balgedie Toll to the west &amp; north of site E. On the 17/1/11 I was informed by a local resident of serious flooding of the A911 and this site; which has persisted and I have passed information to the Roads Maintenance section but I note it is not registered as a planning constraint by Officers.</p> <p>I would comment that, although I do not favour Option 2, site B at Powmill on Map 37 could conceivably conform to the SG’s Final Landscape Capacity Map, if adjusted to P3 and P5 assessment areas. You should take note of my detailed comments on Powmill in my submission of 28/7/10 and the feedback from the Community Engagement Event undertaken by Thomson Homes on 4/10/10; it is my understanding that this developer is prepared to modify earlier proposals for 300 houses to 90 in light of the MIR.</p> <p>Finally as regards Crook of Devon/Drum, I would point out that the SG did highlight assessment areas CD2 and 11 on their Final Landscape Capacity Map that had some development potential, the former area at Muirfield Hatchery is currently being developed and is a site referred to in para 5.20 of our current plan.</p> <p>Q39 YES<br /> I strongly endorse this approach, although some clarity on the brownfield development category would be welcome. Section 5.4.15 should give some reassurance to residents of Carnbo, where a number of developer representations were made but where there is no community appetite for any material change to the existing village settlement boundary.</p> <p>At this point I would ask you to note that the MIR has not addressed 2 small sites that I refer to in earlier submissions viz,</p> <p>a)Keltybridge (site 513 west of Tabernacle Hall). This village setting area should be identified for community usage as car parking and visitor information on local footpaths, etc and should not be identified for housing development.</p> <p>b)An opportunity to reinstate the western boundary of Kilmagadwood to that of the previous Draft Local Plan should be taken, in view of the number of recent planning refusals and community objection to development here.</p> <p>Q40 YES<br /> However, I wish to qualify this answer. I was, and remain, extremely concerned about the potential for the spread of Kinross west of the motorway and its coalescence with Balado from the 8 developer proposals for this area. I am, therefore, somewhat reassured by Map 38 and note from a recent consultation on proposals for an upgraded motorway service area at Turfhills that a large roundabout on the A977 would be introduced, being one of the major mitigation measures we have been seeking funding on. Proposals for a business park at Turfhills have been refused since 1998 and now resurface as site B on the map. I state now enduring community concerns at the status of PKC’s Environment/Roads Depot at this locus resulting from Tayside Contracts restructuring because the recent wintry weather highlights the absolute need for emergency flood equipment and winter gritting/ploughing plant to be retained here in Kinross-shire.</p> <p>This final section of the MIR on Kinross-shire is deficient on key infrastructure proposals, namely no reference to A977 major mitigation measures (3 large roundabouts at Blairingone, Crook of Devon/Drum and Turfhills) restoration of a rail link to the county but even more significantly the need to recognise the deterioration of Kinross Town Centre and an overall strategy for the town to deal with the number of PKC buildings empty and surplus to requirement there; the provision of the link road and a supermarket are only part of the story.</p> <p>Finally, Chapter 6 at the back of the MIR under Policy Framework contains a table summarising the policy issues and seeks comment. Can you confirm there will be opportunities for consultation on these policies before production of the proposed plan in December 2011?</p> <p>I would particularly mention the following:</p> <p>The stated need for the LDP to meet Scotland’s zero waste plan under a new policy is welcome.</p> <p>Conservation Areas – it is disappointing that there doesn’t appear to be any new initiatives for Kinross-shire; Scotlandwell was agreed in 2009 but I had requested we re-examine Back Crook, Keltybridge and Maryburgh.</p> <p>Airport Safeguarding – I welcome this new policy, particularly as regards Balado and Portmoak. I would support the extension and strengthening of the zonal area at Portmoak but have suggested that an independent consultant should be considered, when undertaking a new policy, to produce a draft proposal for local comment and consultation; it is not clear this has been taken up.</p> <p>Perth City Centre Pubs and Clubs – I welcome the inclusion of a new policy that was supported at the 2004 Draft Plan stage by local elected members.</p> <p>In conclusion, I apologise for the length of this submission and fully expect you to take full account of my comments written from my experience as a former Convener<br /> of the Environment Service and Vice Convener of Development Control. I would particularly expect that my comments relating to the Fossoway parish of the landward area of Kinross-shire would be actioned given the work done since 2004 on the LTDS that forms such a key input to the new plan. 						 <p>Fossoway &amp; District Community Council met in Crook of Devon at the Institute on 13 December 2010.</p> <p>As well as discussion on the <a href="http://www.fossoway.org/strategy:main-issues-report">Perth &amp; Kinross Main Issues Report</a>, including where new housing developments should be allowed in Fossoway, there were updates on the ongoing saga of Blairingone War Memorial and the clean up at Dunning Glen.</p> <p>There was also a presentation from Lambhill Energy, who wish to put a <a href="http://www.fossoway.org/local--files/forum:new-thread/Lambhill-energy-plant-former-oran-site-blairingone.pdf" >renewable energy combined heat and power (CHP) plant on the former Oran site in Blairingone</a>. 						 <h1><span>Changes to Rubbish Collection</span></h1> <p>Due to severe weather conditions, Perth &amp; Kinross Council will be collecting only green-lidded bins from Monday 6 December until Sunday 12 December.</p> <p>During this period, any scheduled blue-lidded bin pickups will instead uplift green-lidded bins. Do not leave blue or brown lidded bins at the kerbside until your next scheduled uplift after 12 December.</p> <p>Bagged side waste will also be collected.</p> <p>If possible, the Council requests that residents in cul-de-sacs and side streets take their green-lidded bins to the nearest main road that's clear of snow on their normal collection day. Please disregard previous instructions/information relating to the collection of waste and recyclates.</p> <h2><span>Household waste</span></h2> <p>This means that dry mixed recyclate (blue lidded bins) and garden and food waste (brown lidded bins) collections will be temporarily suspended.</p> <p>Dependent on the weather conditions, this will allow refuse collection crews to uplift the backlog of general waste created by suspending all collections this week, due to severe weather conditions.</p> <p>Householders should present their general waste bin (green lidded bin) to the kerbside on their next normal scheduled collection date during that week (even if the collection is scheduled for a blue lidded bin uplift).</p> <p>Therefore, if householders next scheduled collection day is for dry mixed recyclate (blue lidded bin) during 6-12 December, it is their general waste bin (green lidded bin) that should be presented.</p> <p>The Council will accept a reasonable amount of excess waste from householders that missed a scheduled residual waste collection (green lid bin) between Monday 29th November and Sunday 5th December.</p> <p>Any excess waste should be bagged. Bagged side waste placed beside the general waste bin will be collected.</p> <p>Green lidded general waste bins will be collected where it is safe for the vehicle to access the road and it is practicable to uplift the bins.</p> <p>To help remove the backlog of waste we would request that householders who live in cul-de-sacs and side streets, who are able to take their general wheeled bin to the nearest main or road which is clear of snow, do so on their normal collection day as their own street areas will may still be inaccessible to the Refuse Collection Vehicle.</p> <p>From Monday 13 December waste and recycling collections will return to normal, as per scheduled calendar dates, unless the weather remains inclement. In this case, details of further changes will be released.</p> <p>If householders have blue or brown lidded bins containing recyclable/compostable material these should be not be presented to the kerbside until their next scheduled collection date after 12 December, when collections should return to normal.</p> <p>Householders may also dispose of their waste (both general waste and recyclates) at Recycling Centres which are located throughout Perth and Kinross . Please check the Council website on www.pkc.gov.uk/recycle or call the Customer Service Centre on 01738&nbsp;476476 to confirm whether your local Recycling Centre is open.</p> <h2><span>Commercial waste</span></h2> <p>Businesses affected by the non collection of waste due to the severe weather conditions should present their general waste bins on their normal collection date. The Council will accept a reasonable amount of excess waste from businesses that missed a scheduled residual waste collection between Monday 29th November and Sunday 5th December.</p> <p>Any excess waste should be bagged. It was emphasised by Councillor Barnacle that it is really important that the community gets involved in the consultation process. An additional 90 houses are proposed for the Landward area of Kinross-shire, which might all go onto a single site in either Crook of Devon or Powmill. 						 <p>Crook of Devon was the venue for the Fossoway &amp; District Community Council meeting on 1 June 2010. The <a href="http://www.fossoway.org/local--files/dcc:papers/201006-fossoway-community-council-june-minutes.doc" >minutes</a> are now available for you to read.</p> <p>The results of the <a href="http://www.fossoway.org/forum/t-247065/powmill-development-questionnaire-results-announced-by-fossoway-community-council#post-805077">Powmill Questionnaire</a> were discussed and Ken Thomson of Thomson Homes updated the meeting about his company's further plans for the <a href="http://www.fossoway.org/forum/t-194511/315-new-houses-proposed-for-powmill" >proposed development in Powmill</a> of 300 houses, industrial units, a care home and a new school. Concerns were raised that the development would be too much for Powmill to bear. He was asked to take into account the results of the recent Questionnaire. There would be Community Consultation during the first weekend of September for residents to comment.</p> <p>Sgt. Williams attended the first part of the meeting to discuss arrangements for <a href="http://www.tinthepark.com/content/" >T in the Park</a>. Arrangements for policing and traffic management will be the same as last year.</p> <p>The minutes also state that concerns were raised over the possible approval of The Moss site in Crook of Devon being used for travellers. Although the site had been cleared, there was at present no planning application for this site. Members of the audience expressed their worries, and there was considerable debate on the subject. The C.C. said they would keep an eye on it, and write to the council. In the meantime, residents should be encouraged to show their feelings by writing to their MSP, Local Councillors and the Leader of the Council.</p> <p>There will be no meeting of the Community Council in July so the next meeting will take place on Tuesday 3 August 2010 in Carnbo Hall at 7.30pm.</p>

The cyclists among us will be acutely aware of this as they run the gauntlet of potholes peppering Fossoway's highways and byways. I nearly came a cropper myself the other day on the A977 outside the <a href="http://www.fossoway.org/forum/t-411361/crook-of-devon-institute">Institute in Crook of Devon</a>.</p> <p>What can be done to get such problems repaired promptly? Well we could just hope that someone from the Council happens to notice that our dear old road is in need of a bit of attention; but that might take a while. A better option would be to report it, but who do we tell? Which council department is responsible for our particular issue? Is it better to phone or to write in? Well, I'm able to tell you about a really great on-line service that takes all the hassle out of reporting this sort of thing – and it really works too.</p> <p>Just surf over to <a href="http://www.fixmystreet.com/" target="_blank">FixMyStreet.com</a> and follow the instructions. You'll need to enter a postcode (or street name and area), locate the problem on a map, enter a few details and <a href="http://www.fixmystreet.com/" target="_blank">FixMyStreet</a> will handle the rest. You might be wondering what the catch is, or thinking it's too good to be true, but I can tell you that this service works well – really well.</p> <p>It's not just for potholes either, I used it to report some graffiti on the 30mph signs on Naemoor Road in Crook of Devon and was amazed to find that just 3 days later the signs had been scrubbed and polished and looked as good as new.</p> <p>So next time you notice a hole in the road in Fossoway, a broken paving slab or a flickering street light, just head over to <a href="http://www.fixmystreet.com/" target="_blank">FixMyStreet</a> and get it sorted.</p>

Speaking during a debate on the <a href="http://www.fossoway.org/strategy:planning#Future-Planning-Proc">Tayplan</a> main issues, Councillor Barnacle described the 16% growth figure as "neither desirable nor sustainable". The meeting also discussed the findings of a report produced by the Dundee, Perth, Angus and North Fife Strategic Development Planning Authority, which stated that development driven by population growth would impact on the environment.
